AN ORDINANCE AMENDINGCHAPTER 18.19 OF THE MOSES LAKEMUNICI-PAL CODE ENTITLED "R-2,SINGLE FAMILYANDTWO FAMILYRESIDENTIALZONE"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAIN AS FOLLOWS:
Section 1.Chapter 18.19 oftheMoses Lake Municipal Code entitled "R-2,Single Family and Two FamilyResidentiatZone"is amended as foMows:
O 18.19.020 Permitted Uses:Hematterinthe SingleFamily sndTwo Family ResidentialZone,nobuilding,structure,or land shallbe used and nobuilding or structureshall be erected,altered,enlarged,or relocated thereinwhich is designed or intended tobe used for any other thanthe followingoutrightperinittedusesorasaconditionaluse.Outrightpermitted uses or conditional usesintheSingleFami‡y and Two Famay Residential Zone shad be in compliance with theconditions,theperformance standards,and the bulk regulationsof thischapter.
A.Outricht Pem9itted Uses:
1.Duplex-a structrue on one lot of record containingtwo (2)dwellingunits.
2.Single family dwettingunits,including
a.Single family detached dwelling units,
b.Single family dwellingunits sharing a commonwall or attachment on two lots ofrecord.
c.Condominiums -single family attached dwellingunits developed as a horizontalregimeincoinpliancewiththerequirementsofthischapterorincompliancewithChapter18.87 ofthistitleentitled"Planned Development District."
3.Subordinate Usea -any use whichis incidental and subordinate to the principal useofthelandorbuilding;is located on the same lot with the principal use;and is nototherwiseprohibited.
4.Accessory buildingsand/orstructures appurtenant toany permitted uses in compliancewithSection18.19.040 of thischapter.
5.Factory-built housing constructed to thestandards of the UniformSulldingCode.
6.Manufactured homes
7.Keeping of household pets (dogsand cats)not exceeding three(3)in number whicharefour(4)Inonths old or older.
8.Planned Development Districtsin compliancewithChapter 18.67 ofthistitle,entitled"Planned Development District."
9.Parks and non-commercialrecreational uses.
10.Home occupations in compliance with Chapter 18.55 of thistitle.
11.An accessory dwellingunit intended to accommodate a member(s}of theimmediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.19.190 of thischapter entitled "Residential Density."
12.Other unmentioned uses ruled by the Planning Commission to be similar to andcompatiblewiththespecifiedpermitteduses.
13.Family day care homes as an accessory use toa privatefamily residence providingcareduringpartofthetwenty-four(24)hour day to six (6)or fewer children.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department of SocialandHealthServicesandshalfoperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A city business license shall be required.
B.ConditionalUses:The following uses may be permitted by the Planning CommissionasaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitleantitled"Conditionaland Unmentioned Uses."
1.Churches
2.Schools

3.Group homes forthe developmentally disabled
4.Golf Courses
5.Cemeteries
6.Rental of an apartment appurtenant toa single family residence
7.Manufactured home parks in compliance with Chapter 18.65 of this code entitled
"ManufacturedHome Parks."
8.Essential publicservices and utilities including buildingsand structures.
9.Boarding houses for not more than three(3)people
10.Mini Day Care Facilityand Day Care Centers:
a.Mini Day Care Facility:A day care facility for the care offrom seven (7)through
twelve(12)childrenin thefamily abode of the person holding the license issued
by the State of Washington,Department of Social and Health Services.
b.Day Care Center:A day care facility that provides for the care of from thirteen
(13)through twenty(20)children in the family abode of the person holding the
license issued by the State of Washington,Department of Social and Health
Services,
c.Requirements:Mini day care facilitiesand day care centers shall be in compli-
ance with the following requirements:
1)Outdoor playareas shall not be located in front yards.
2)One (1)on-site parkingspace is required for each employee in additionto
required resident parking.
3)An on-site,off-street loading and unloadingarea shall be required.
4)A city business license shall be required.O5)Signage shall not be permitted,
6)No structural or decorative alteration which wouldalter the character or be
incompatible withthe surroundingresidences shall be permitted.
7)The use and structures shall be in compliance with zoning regulations and
Uniform Building Code requirements.
8)Miniday care facilities and day care centers shall be licensed by the State of
Washington,Department of Social and Health Services and shall operate in
compliancewith the licensed capacityrequirement as determined by the State
of Washington,Department of Social and Health Services except that day
care centers shall operate in compliance with the capacity requirements as
stipulated in this section.
9)The Planning Commission may impose conditions to mitigate any potential
adverse impacts on the surroundingarea.
10)Notification and agreement of adjacent property owners of an application for
a day care facility.
11.Other uses ruled by the Planning Commission to be a conditionaluse providedthat
the use shall be similar to and compatiblewith the expressed permitted and condi-
tional uses.
12.Temporary occupancy and use of recreational vehicles (RV):
a.The following criteria shall be met:
1)Applicant must be a non-profitorganization
2)Request is associated with a constructionprojectwhich requiresa conditional
use permit as listed in 18.16.020.B.1 -8.
3)The location and siting of RV's shall complywithSection 18.65.080 Setbacks
and Separations of Manufactured Home Parks,Chapters 16.36 Fire Appara-
tusaccess and 16.48 Fire Hydrants,

b.The fellowing requirements shall be stipulated as conditionsoftheconditionalusepermitTheseinclude,but are not limited to:
1)The durationof theconditionaluse permit shall be specified and shall not beallowedtoexceedthelifeofthebuildingpermit
2)The number of RV's tobe allowed.
3)The RV site shall be left free of debris,litter or otherevidence of RV occupa-tionupon the completionor removal of the use;
4)A solidwaste disposal plan,
c.Notificationand agreementof adjacent property owners of an application fortemporaryoccupancyanduseofrecreationalvehicles.
18.19.030 Prohibited Uses:Anyuse not expresslypermittedoutrightor as a conditionaluse in the R-2Zoneshallbeprohibited,includingbut not limited to thefollowing examples:
A.Commercialuses except as provided in Section 18.19.020 A and B of this chapter.
B.Multi-familydwellingunit structures except as provided in Section 18.19.020 A and B ofthischapter.
C.Keeping of livestock,poultry,rabbits or bees
D.Industrial uses
E.Occupancy of trailersor recreational vehiclesexcept as otherwiseallowedin thischapter.
F.Public nuisances
G.Removal of son or other natural materials forthe purpose of sale or use as fill materialexceptthatexcavationforthepurposeofconstructionorlandscapingispermitted.
H.Outside storage,collection,or dumping of dismentled,partly dismantled,or wreckedvehioles,trailers,machinery,or theirparts.
1.Outside storage or collection of any junk,scrap,garbage,unsightly material,litter,ordebris.
J.Abandoned sheds or buildings in a state of disrepair
K.Locating any sea orocean-goingcontainerswhich can be detached from a trailer,chassis,
or frame and whichwere formerly used for transportingsea or ocean-going cargo,railroadcarsandcabooses,semi-trailers when intended to be used as storage facilities,or anyotherunitwhichdetedhesfromatrailer,chassis,or frame including car,truck,or vanbodiesorpartsofbodieswhenintendedtobeusedforstoragefacilitiesorthelike.
Section 2.This ordinance shall takeoffectand be in forcefive (5)days after its passage and publicationofitssummaryasprovidedbylaw.
