ANORDINANCEAMENDING CHAPTER 18.22 OF THE MOSES LAKE MUNICI-
PAL CODE ENTITLED "R-3,MULTl-FAMILYRESIDENTIAL"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 18.22 of the Moses Lake MunicipalCode entitled "R-3,Multi-family Residential"isamendedasfollows:
18.22.020 Permitted Uses:Hereafter in theMulti-familyResidential Zone,no building,stru.cture,or land
shall be used and no building or structure shall be erected,altered,or relocated herein whichisdesignedorintendedtobeusedforanyotherthanthefollowingoutrightpermittedusesorasaconditionaluse.Outdghtpermitted uses orconditionaluses in theMulti-family ResidentialZoneshanbeincompliancewiththeconditions,the performance standards,and bulkregulationsofthischapter.
A.Outright Permitted Uses:
1.Multi-familydwelling unitstructure-a structurecontainingmorethantwodwelling units
on a single tot
2.Duplex -a structure on one lot of record containingtwo(2)dwellingunits.
3.Single family dwelling units,inclyding
a.Single family detached dwellingunits.
b.Single family dwetting units sharinga commonwall orattachmenton twolots ofrecord,
c.Condominiums-single family attached dwelling unitsdeveloped as a horizontalregimeincompliancewiththerequirementsofthischapterorincompliancewithChapter18.67 of thistitleentitled"Planned Development District."
O 4,Subordinate Uses -any use which is incidental and subordinate tothe principal useofthelandorbuilding;is located on the same lot withthe principaluse;and is nototherwiseprohibited.
5.Accessory buildings and/or structures appurtenanttoanypermitteduses incompliancewithSection18.22.040 of this chapter,
6.Factory-built housing constructed to thestandards of the Uniform Building Code.
7.Manufactured homes
8.Keeping of household pets (dogsand cats)not toexceed three(3)in number which
are four (4)months old or older.
9.Planned Development Districtsin compliancewith Chapter 18.67 of thistitle,entitled
"Planned DevelopmentDistricts."
10.Parks and non-commercial recreationaluses.
11.Horrie occupations in compliancewithChapter 18.55 of thistitle.
12.An accessory dwellingunit intended toaccommodatea member(s)of the immediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.22.210 ofthischapter entitled"Residential Density."
O 13.Other unmentioned uses ruled by the Planning Commission to be similarto andcompatiblewiththespecifiedpermitteduses.
14.Family day care homes as an accessory use to a private family residence providing
care during part of thetwenty-fout(24)hour day to six (6)or fewer children.Family
day care homes shall be licensed by theState of Washington,Department of SocialandHealthServicesandshalloperateincompliancewiththelicensedcapacity
requirementsfor family day care homes.A city business license shall be required.
B.ConditionalUses:The followinguses may be permitted by the Ptanning Commission asaconditionatuseincompliancewiththepmvisionsofthischapterandChapter18.51 ofthistitleentitled"Conditionaland Unmentioned Uses."

12.Rental of an apartment appurtenant toa singlefamily residence
13.Essential publicservices and utilitiesincluding buildings and structures.

17.Marinas located along the lake shore
18.MiniDay Care Facilitiesand Day Care Centers:
a.Mini DayCare Facility:
1)A day care center for the care of twelve (12)or fewer children in a facility
other thanthefamilyabode oftheperson or persons under whose direct careandsupervisionthechildisplaced;or
2)For the care of from seven (7)through twelve (12)children in the family
abode of such person or persons.
b.Day Care Center:A day care facility that provides for the care ofthirteen(13)or
more children provided thatthe capacity of day care centers located in private
family residences in residential zones shall not exceed twenty(20)children at anygiventimeandthepermittedcapacityofdaycarecenterslocatedinresidential
zones in other than private family residences shall be set by the Planning
Commission on a case by case basis.
c.Requirements:Mini day care facilities and day care centers shall be in compli-
ance with the following requirements:
1)Outdoor play areas shall not be located in front yards.
2)One (1)on-site parking space is required for each employee in addition to
required resident parking.
3)An on-site,off-streetloading and unloading area shall be required.
4)A city business license shall be required.
5)Signage shall not be permitted.
6)No structural or decorative alteration which would alter the character or be
incompatible with thesurroundingresidences shall be permitted.
7)The use and structures shall be in compliance with zoning regulations and
Uniform Building Code requirements.

8)Miniday care facilities and day care centers shall be licensed by the State ofWashington,Department of Social and Heatth Services and shall operate in
compliance with thelicensed capacity requirement as determinedbythe StateofWashington,Departmentof Social and Health Services except that day
care centers shall operate in compliencewith the capacityrequirements asstipulatedinthissection.
9)The Planning Commissionmay impose conditions to mitigateany potentialadverseimpactsonthesurroundingarea.
10)Notification and agreement of adjacent property owners of an application for
a day care facility.
19.Other uses ruled by the Planning Commissionto be a conditionaluse provided thattheuseshallbesimilartoandcompatiblewiththeexpressedpermittedandcondition-al uses or other uses permitted by specific provision of thischapter as a conditionaluse.
20.Temporary occupancy and use of recreational vehicles (RV):
a.The following criteria shall be met:
1)Applicardmust be a non-profit organization
2)Request is associated with a constructionproject which requires a conditional
use permit as tistedin 18.16.020.B.1 -19.
3)The location and sitingof RV's shallcomplywithSection 18.65.080 Setbacks
and Separations of Manufactured Home Parks,Chapters 16.36 Fire Appara-tus access and 16.48 Fire Hydrants.
b.The following requirements shall be stipulated as conditionsof the conditional usepermit.These include,but are not limited to:
1)The duration of theconditional use permitshall be specifiedand shall not beallowpdtoexceedthelifeofthebuildingpermit.
2)The number of RV's to be allowed.
3)The RVsite shall be left free of debris,litter or otherevidence of RV occupa-tion uponthe completion or removal of the use.
4)A solid waste disposal plan.
c.Notification and agreementof adjacent property owners of an application fortemporaryoccupancyanduseofrecreationalvehicles.
18.22.030 Prohibited Uses:Any use not expressly permitted outright or as a conditional use in the R-3Zoneshallbeprohibited,including but not limited to the following examples:
A.Commercialuses except as provided inSection 18.22.020 A and8 of thischapter.
B.Industrial uses
C.Keepingof livestock,poultry,rabbits or bees
D.Occupancyof recreational vehicles except as othenuisestated in thischapter.
E.Public nuisances
O F.Removal of soit or other natural materials for the purpose of sale or use as fill materialexceptthatexcavatîonforthepurposeofconstructionoflandscapingispermitted.
G.Outside storage,collection,or dumping of dismantled,partly dismantled,or wreckedvehicles,trailers,machinery,or theirparts.
H.Outside storage or collection of any junk,scrap,garbage,unsightly material,litter,ordebris.
I.Abandoned sheds or buildings in a state ofdisrepair

J.Locating anysea or ocean-goingcontainerswhichcan be detached from a trailer,chassis,
or frame and which were formerly used for transportingsea or ocean-going cargo,railroad
cars and cabooses,semi-trailers when intended to be used as storage facilities,or anyotherunitwhichdetachesfromatrailer,chassis,or frame including car,truck,or van
bodies or parts of bodies when intended to be used as storage facilities or the like.
Section 2.This ordinance shall takeeffect and be in forcefive (5)days after its passage and publicationofitssummaryasprovidedbylaw.
Adopted by the City Council and signed by its Mayor on February 25,1997.
