AN ORDINANCE AMENDINGCHAPTER 18.19 OF THEMOSES LAKEMUNICI-
PALCODEENTITLED"R-2,SINGLEFAMILYAND TWO FAMILYRESIDENTIAL
ZONE"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAIN AS FOLLOWS:
Section 1.Chapter 18.19 ofthe Moses Lake Municipal Code entitled"R-2,Single Family and Two Family
Residential Zone"is amended as follows:O 18.19.020 Permitted Uses:Hereafter in theSingle Family and Two Family Residential Zone,no building,
structure,or land shallbe used and no building or structure shall be erected,altered,enlarged,
or relocated thereinwhich is designed or intended to be used forany other thanthefollowingoutrightpermittedusesorasaconditionaluse.Outright permitted uses or conditionalusesintheSingleFamilyandTwoFamilyResidentialZoneshallbeincompliancewiththeconditions,the performance standards,and the bulkregulationsof thischapter.
A.Outricht Permitted Uses:
1.Duplex -a structure on one lot of record containingtwo(2)dwelling units.
2.Single family dwelling units,including
a.Single family detached dwelling units.
b.Single familydwelling units sharing a common wall or attachment on twolots ofrecord.
c.Condominiums-single family attached dwelling units developed as a horizontal
regime in compliance with the requirements of thischapter or in compliancewithChapter18.67 of thistitleentitled "Planned Development District"
3.Subordinate Uses -any use which is incidental and subordinate to theprincipal useofthelandorbuilding;is located on thesame lot with the principal use;and is nototherwiseprohibited.
4.Accessory buildingsand/orstructures appurtenant toany permitted uses in compliancewithSection18.19.040of thischapter.
5.Factory-built housing constructed to thestandards of the Uniform Building Code.
8.Manufactured homes
7.Keeping of household pets (dogsand cats)not exceeding three (3)in number which
are four (4)months old or older.
8.Planned Development Districts in compliance with Chapter 18,67 ofthistitle,entitled"Planned Development District."
9.Parks and non-commercialrecreational uses.
10.Home occupations in compliancewith Chapter 18.55 ofthistitle.
11.An accessory dwelling unit intended to accommodate a member(s)of the immediate
family requiring daily care,supervision,or guardianship in compliance with Section
18.19.190 of thischapter entitled "Residential Density."
12.Other unmentioned uses ruled by the Planning Commission to be similar to andcompatiblewiththespecifiedpermitteduses.
13.Family day care homes as an accessory use to a privatefamilyresidence providing
care during part of the twenty-four(24)hour day tosix (6)or fewer children.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department of SocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.A city business license shall be required.
B.Conditional Uses:The followinguses may be permitted by thePlanning Commission asaconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 of
this titleentitled "Conditionaland UnmentionedUses."

1.Churches and church structures or additions which may exceed thirtyfeet (30')in
height.
2.Schools
3.Group homes for the developmentally disabled
4.Golf Courses
5.Cemeteries O6.Rental of an apartment appurtenant to a single family residence
7.Manufactured home parks in compliance with Chapter 18.65 of this code entitled
"Manufactured Home Parks."
8.Essential public services and utilities including buildings and structures.
9.Boarding houses for not more thanthree(3)people
10.Mini Day Care Facility and Day Care Centers:
a.Mini Day Care Facility:A day care facility for thecare offrom seven (7)throughtwelve(12)children in the family abode of the person holding the license issued
bythe State ofWashington,Department of Social and Health Services,
b.Day Care Center:A day care facility that providesfor the care of from thirteen
(13)throughtwenty(20)children in the family abode of the person holding the
license issued by the State of Washington,Department of Social and Health
Services.
c.Requirements:Mini day care facilities and day care centers shall be in compli-
ance with thefollowing requirements:
1)Outdoor play areas shall not be located in front yards.
2)One (1)on-site parking space is required for each employee in addition torequiredresidentparking.
3)An on-site,off-streetloading and unloading area shall be required.
4)A city business license shall be required.
5)Signage shall not be permitted.
6)No structural or decorative alteration which would alter the character or be
incompatible with the surrounding residences shall be permitted.
7)The use and structures shallbe in compliance withzoning regulations andUniformBuildingCoderequirements.
8)Mini day care facilities and day care centers shall be licensed by the State of
Washington,Department of Social and Health Services and shall operate in
compliance with thelicensed capacityrequirementas determined by theState
of Washington,Department of Social and Health Services except that day
care centers shall operate in compliance with the capacity requirements asstipulatedinthissection.
9)The Planning Commission may impose conditions to mitigate any potential
adverse impacts on the surroundingarea.
10)Notification and agreement of adjacent property owners of an applicationfor
a day care facility.
11.Other uses ruled by the Planning Commission to be a conditional use provided thattheuseshallbesimilartoandcompatiblewiththeexpressedpermittedandcondi-
tional uses.

18.19.240 Buildinq Heights:
A.No buildingorstructureshall exceed thirtyfeet (30')in height except structures,otherthandetachedaccessorybuildings,may be constructed up to thirty-fivefeet (35')in height
undertheconditionsset forth herein:
1.The interior side yard setback must be at least ten feet (10')withone (1)additional
foot of setback for each additionalfoot of building height over thirtyfeet (30').
2.A minimum lot size of twelvethousand five hundred (12,500)square feet.O 3.AIIfront,rear,and exterior setbacks shall remain as provided in Section 18.16.090.
B.The following structures are exempted from the building height restriction and may beerectedhigherthanthirtyfeet(30')so long as thestructure permitted is a distance from
all propertylines not less thanits height and it meets any additionalconditionsas noted:
1.Church spires,steeples,and bell towers
2.Flag poles
3.Non-commercial antennas and towersrelated to wireless transmissions and relays,if
permitted by law,so long as thosetowersare no higher thannecessary to reasonablyaccommodatetheuseincludingtheuseoftheshorteststructurepossibleandcrank
up or telescopingdevises are used whenever possible.
4.Water reservoirs
Section 2.This ordinance shall takeeffectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
