AN ORDINANCE AMENDINGCHAPTER 12.40 OF THE MOSES LAKE MUNICI-PAL CODE ENTITLED "STREETCONSTRUCTION OR IMPROVEMENT REIM-BURSEMENT CHARGES"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 12.40 of the Moses Lake Municipal Codeentitled"Street Constructionor ImprovementReimbursementCharges"is amended as follows:
12.40.010 Authority:Pursuant to RCW 35.72 the City of Moses Lake may contract withthe owner(s)ofrealestatefortheconstructionorimprovementofstreetswhichtheowner(s)elect to install asaresultofordinancesthatrequiretheprojectasapre-requisite tofurther propertydevelopmentandfurther,thecitymay joininwith theowner(s)of real estate in thefinancing oftheconstruc-tionor improvement of street projects.
12.40.020 Reimbursement:The owner(s)of real estate who construct or improve a street or streets intheCityofMosesLakeandtheCityofMosesLake,if the city participates in the cost offinancingsuchconstructionorimprovementand,if the contract between the owner(s)of realestateandthecityhasspecifiedtheconditionsofthecity's participation in an ordinance,shallbereimbursedforaportionofthecostofthestreetconstructionorimprovement,pursuant toRCW35.72.
12.40.030 Assessment Reimbursement Area:The City Engineer shall establish the assessmentreimbursementareaupontherequestoftheowner(s)of real estate who constructs orimprovesthestreetwithasubmissionofthecostofthestreetconstructionorimprovementbytheowner(s)of real estate or uponits owninitiationif it has participated in thefinancingof theconstructionorimprovementofanystreet.The assessment improvement area shall bepresentedtotheCityCouncilpriortonotifyingaffectedpropertyowners.
12.40.040 Propertv Development Charges:
A.There shall be two(2)typesof street improvements referred to:
1.Subdividerinstalled street improvements;or
2.Publicly funded installed street improvements.
B.Where street improvements have been constructed at the expense of the subdivider orprivateownersthroughoradjacenttosubdividedareas,other thanthe property withinboundariesofthesubdivisionforwhichthestreetimprovementswererequired,thesubdividerorpropertyownersmayobtainreimbursementrightsasprovidedbystatelaw.If thecityentersinto a contractwith a platter,subdivider,or privateowner for reimburse-mentof street constructioncosts,propertyowners outside the boundaries of thesubdivi-sion shall not be allowedto have development approved until all fees required by thecontractbetweenthecityandthedeveloperhavebeencollected.These developmentlimitationsshallbeenforcedforaperiodnottoexceedfifteen(15)years.Should theFinanceDirectorbeunabletolocatethesubdividerorprivateownersbyregisteredorcertifiedmailpriortofifteen(15)years afteracceptance ofstreet improvements by theCityCouncil,the limitation for development shall cease.
C.Where street improvements have been constructed withpublicfunds throughor adjacenttoplattedareas,the property through which the street improvements are extended orwhichareadjacenttheretoshallnotbegranteddevelopmentpermissionuntilpaymenthasbeenmadetothecityinaccordancewiththeschedulesestablishedinthischapter.
D.Where publicly funded street improvements are throughor adjacent tounplatted areas,theplatterofthoseunplattedareasshallberequired,as a part of the plattingprocedure,toreimbursethecityforthatportionofthestreetimprovementsthroughoradjacenttothepropertytobeplatted.That reimbursement shallalso be in accordance withtheschedulesestablishedinthischapter.
12.40.050 Street Improvement Charges -Wapato Drive:Street improvement charges in Section 33,Township 19 North,Range 28 East,W M.,constructedwithcityfunds as part of thePeninsulaEstatesPhaseIVManufacturedHomeParkshallbereimbursedbythepropertyowneruponpropertysubdivisionorupondevelopment.The reimbursementshall be a portion oftheregularpermitfee.The followingamounts ofthe permitfee shall be deposited in Fund 309.A sixty-threedollar ($63.00)per front foot charge shall be assessed against the following property inSection33,Township 19 North,Range 28 East,W.M.:

The northeasterly one hundred feet (100')of Tract 64,Plat of Battery Orchard Tracts fronting
on Wapato Drive.
That per front foot reimbursement rate shall be adjusted upward commencingon June 1,1999
by the change in theJanuary toJanuary AIIWest Cost Cities CPI-W Index issued in 1999,and
shall be so adjusted each June 1 thereafterusing thesame index.
Section 2.This ordinance shalltakeeffect and be in forcefive(5)days after its passage and publication
of its summary as providedby law.
