1801_00001ORDINANCE NO.1801 AN ORDINANCE AMENDINGCHAPTER 13.12 OF THE MOSES LAKEMUNICI-PAL CODE ENTITLED "WATER ANDSEWER RATES" THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 13.12 of the Moses Lake Municîpal Code entitled "Water and Sewer Rates"isamendedasfollows: 13.12.010 ResidentialWater Rates: A.The following shall be the monthly rate charge for water from thecity water system fromallresidentiallivingunitswithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecity: Amount Used Water Rate(incubic feet 0-500 $15.75per month Over 500 $.50 per 100 cu.ft.of portionthereof B.The following shall be the minimummonthly amounts charged according toeach meter inserviceforallresidentiallivingunitswithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecity: Meter Size Minimum Charge Water Delivered for Minimum(ininches)per Calendar Month (incubic feet) 3/4 or smaller $15.75 500 1 $18.25 1,000 1½$25.75 2,500 2 $63.25 10,000 NOTE:AIIminimum charges are the base rate withall consumption inexcess of500cubicfeetcomputedattheover500cubicfeetrate. C.Unmeteredresidential water services within the corporatelimits ofthecityand outside thecorporatelimitsofthecityshallbebaseduponthefollowingrateschedule: SillingCycle Flat Rate November throughMarch $15.75per month April throughOctober $31.50 per month 13.12.015 Dwellinqs With Two Livinq Units: A.The followingshall be themonthly rate charged for water from thecity systemfora dwellingwithtwoseparatelivingunitswithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecitywithonlyonemeterservingtwolivingunitsorfortwohousesonasinglelotservedbyonemeter: 0 Amount Used (incubic feet)Water Rate 0-1,000 $31.50per month Over 1,000 $.50per 100 cu.ft or portion thereof B.The followingshallbe theminimummonthly amounts charged accordingtothesize of eachmeterinservicetoadwellingwithtwoseparatelivingunitswithonlyonemetertothelivingunitorfortwohousesonasinglelotservedbyonemeterwithinthecorporatelimitsofthecityandoutsidethecorporatelimitsofthecity: MeterSize Minimum Charge Water Deliveredfor Minimum (ininches)per Calendar Month (incubic feet) 3/4 or smaller $31.50 1,000 1 $36.50 2,000 1½$51.50 5,000 2 $126.50 20,000 O 13 12.020 CommercialWater Rates: A.The following shall be the monthlyrate charged for water from the city water system for commercial users and dwellings with three or more living units served by one meter within thecorporate limits ofthe city and outside the corporate limits ofthe city: Amount Used Water Rate (incubic feet 0-500 $25.90 per month Over 500 $.50per 100 cu.ft.of portionthereof B.The following shall be the minimummonthlyamounts charged accordingto each meter in service for commercial users and dwellingswith three or more living units served by one meter within the corporate limits of the city and outside thecorporate limits of the city: Meter Size Minimum Charge Water Delivered for Minimum (ininches)per Calendar Month (incubic feet 3/4 or smaller $25.90 500 1 $28.40 1,000 1½$35.90 2,500 2 $73.40 10,000 3 $123.40 20,000 4 $198.40 35,000 6 $273.40 50,000 8 $473.40 90,000 10 $773.40 150,000 13.12.030 Residential Sewer Rates:The followingshall be the monthlyrate charged customers residing within the corporate limits of the city and outside the corporate limits of the city for sewer service from thecity sewer system for single-family dwellings and each unit of a duplex with separate meters:flat rate,$23.10 per month. 13.12.035 Duplex Sewer Rates:The following shall be the monthlyrate charged customers residing within the corporate limits ofthe city and outside thecorporate limits ofthe cityfor sewer service from the city sewer system forduplexes with onlyone meter servingtwoliving units or for twoliving units on a single lot served by one meter:flat rate,$46.20per month. 13.12.040 Commercial Sewer Rates: A.The following shall be the monthlyrate charged customers residing withinthe corporate limits of the city and outside the corporate limits of the city for all chargeable water discharged into the citysewer system by commercial users and dwellings with three or more living units served by one meter: Amount Used(incubic feet)Water Rate 0-1,000 $24.30per month minimum Over 1,000 $.83 per 100 cu.ft.or portion thereof B.For purposes of calculatingsewer charges,chargeable water shall be defined as follows:Chargeable water shall be measured by thewater consumed on the premises,whateverthesourceofsuchwater,and the same willbe metered either by a publicutilitymeter oroneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedandinspectedbythecity.As an option,if requested by the owner of thepremises,thecitywillinstall a water meterwiththecost for themeter and installation beingpaidbytheownerofthepremisesinaccordancewiththechargesassessedinMLMC13.08.020 for water/sewer connections.Under such circumstances the water meterbecomesthepropertyoftheownerofthepremisesandallcostsofreplacementandrepairOaretheresponsibilityoftheownerofthepremises.In all circumstances where the waterismeteredbyaprivatelyownedwatermeterandisusedtodeterminesewercharges,thecityshallbeallowedaccesstothemeterinordertoreadsuchmeter.Where the use ofwaterissuchthataportionofallthewateruseddoesnotflowintothesewersystem,forwhateverreason,butis lost by evaporation,irrigation,sprinklingor is used in manufacturingorinamanufacturedproduct,or is lost forwhatever reason,and the person in controlprovidesproofofthisfactandinstallsameterorothermeasuringdeviceapprovedbythecitytomeasuretheamountofwatersousedandsolost,or if thecity is capable of deter-mining theamount of sewage entering the city's sewer system by some other mechanicalmeans,thiswater may be deducted from theactualwater consumption used in calculatingthesewercharge. The sewer charges fortriplexesand apartments,mobilehome parks,schools,hospitals andothercommercialestablishmentswithincreasedusageforirrigation,onlyiftheirlandscap-ing exceeds five thousandsquare feet,shall be computed on the average consumptionduringthepreviousnon-irrigationseason,unless the user elects toinstall,at his expense,an approved measuring device to measure water not entering the sewer system.When auserhasaswimmingpoolorcoolingunitsdischargingtothesanitarysewer,he must install an approved meter todetermine the amount of water exempt from sewer charges duringtheirrigationseason.The irrigation season shall be defined as the period in whichstatementsaremailedfortheAprilthroughNovemberbillingcycles. C.Sewer rates for commercial uses discharged into the sewer system may be separatelydeterminedbytheCityCouncil,based upon both volume and chemical characteristics ofthesewage.The City Councilreserves the privilegetorequirepre-treatmentof any materialdischargedintotheseweragesystem,or toprohibitdischarge into thesystem of industrialOwastesthat,because of either volume or concentration,willoverload existing seweragefacilities. D.AIIair-conditioning and refrigeration units thatare installed,replaced or that have capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequiredtoinstallrecirculatingunits.Disposal may not be accomplished by discharging into thesanitarysewersystem. Section 2.This ordinanceshall takeeffect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
