1815_00001ORDINANCE NO.1815 AN ORDINANCE AMENDING CHAPTER 13.04 OF THE MOSES LAKEMUNICIPALCODEENTITLED"SEWER REGULATIONS" THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS: Section 1.Chapter 13.04 of theMoses Lake Municipal Codeentitled"Sewer Regulations"is amended asfollows: 13.04.003 Purpose:The purpose ofthischapter is toset forthuniform requirements for dischargers into theCityofMosesLake's PubliclyOwned TreatmentWorks(POTW)and domestic wastewaterfacility,and enables the Citytoprotect public health in conformitywith allapplicable Local, State and Federal laws relating thereto.The objectives of thischapter are: A.To prevent the introduction of pollutants into theCity's wastewater system,which willinterferewiththenormaloperationofthesystemorcontaminatetheresultingmunicipalbiosolids. B.To prevent theintroduction ofpollutants into theCity'swastewater system,which do notreceiveadequatetreatmentinthePOTWandwhichwillpassthroughthesystemintoreceivingwatersortheatmosphereorotherwisebeincompatiblewiththePOTW. C.To ensure thatthequalityof thePOTW biosolids is maintainedat a level which allows its use and disposal in compliancewith applicablestatutes and regulations. D.To improve the opportunity to recycle and reclaim wastewater and biosolids from thePOTW E.To enable the City tocomply with its State Waste Discharge Permit (SWDP)conditions,biosolids use and disposal requirements,and any other Federal orState laws to whichthePOTWissubject. This Chapter provides for the regulation of discharges into the City's wastewater systemthroughtheenforcementofadministrativeregulations.O 13.04.005 Abbreviations:The following abbreviations,when used in this Chapter,shall have thedesignatedmeaning: BOD -Biochemical OxygenDemand. COD -Chemical Oxygen Demand. mg/I -Milligrams Per Liter,generallyinterchangeable with Parts Per Million(PPM)in water treatmentcalculations. POTW -Publicly OwnedTreatmentWorks. SIU -Significant Industrial User. SWDP -State Waste Discharge Permit. TDS -Total Dissolved Solids. TSS -Total Suspended Solids. 13.04.010 Definitions:Unless the contextspecificallyindicates otherwise,the meaning of terms used inthechaptershallbeasprovidedinthissection: A."BOD"means the quantity of oxygen utilized in the biochemical oxidationof organicOmatterunderstandardlaboratoryproceduresduringfive(5)days at 20°Celsius,usuallyexpressedasaconcentration(e.g.,mg/l). B."Building Drain"means thatpart of the lowest horizontal piping ofa drainage systemwhichreceivesthedischargefromsoil,waste,and other drainage pipes inside the wallsofthebuildingandconveysittothebuildingsewer-beginning two(2)feet outside thebuildingwall. C."BuildingSewer"means the extensionfromthebuilding drain tothe public sewerorotherplaceofdisposal. D."DomesticWastewater"meanswatercarrying human wastes,including kitchen,bath,and laundry wastes from residences,buildings,industrial establishments or other places, togetherwith such ground water infiltrationor surfacewaters as may be present E."Domestic Wastewater Facility"(treatmentplant)means all structures,equipment,or processes required to collect,carry away,treat,reclaim,or dispose of domestic wastewater togetherwith such industrial waste as may be present F."Domestic User"means anyperson who contributes,causes,orallowsthe discharge of wastewater into thePOTW thatis similar involume and/or chemical make-uptodomestic wastewater. G."Garbage"means solidwastesfrom thepreparation,cooking,anddispensing offood,and from the handling,storage,and sale ofproduce. H."Industrial Wastewater"means water or liquid-carried waste from industrial or commercial processes,as distinct from domestic wastewater.These wastes mayresultfromanyprocessoractivityofindustry,manufacture,trade or business,from the development of any natural resource,or from animaloperationssuch as feed lots,poultry houses,or dairies. l."Interference"means a discharge byan industrial userwhich,alone or inconjunctionwith discharges byother sources,inhibits or disrupts thePOTW,its treatmentprocesses oroperations,or its biosolids processes,use or disposal and which is a cause of a violation ofany requirementof the POTWs State Waste Discharge Permit or theprevention of sewage biosolids use or disposal by the POTW in accordance with Local,State and Federal regulations. J."Medical Waste"means isolation wastes,infectious agents,human blood and blood products,pathological wastes,sharps,body parts,contaminated bedding,surgical wastes,potentiallycontaminated laboratory wastes,and dialysis wastes. K."Municipal Services Director"means the Director of Municipal Services or his/her designated representative. L.."Natural Outlet"means any outletinto a watercourse,pond,ditch,lake,orother body of surface water or ground water. M."Noncontact Cooling Water"means water used for coolingwhichdoes not come into direct contact with any raw material,chemical,intermediate product,waste product,or finished product N."Pass Through"means a discharge which exits the POTW into waters of the United States inquantities or concentrations which,aloneor in conjunctionwith a discharge or discharges fromother sources,is a cause ofa violationofany requirementof theCity's SWDP,including an increase inthe magnitudeor duration ofa violation. O."Person"means any individual,firm,company,association,society,corporation,orgroup. P."pH"means a measurement oftheacidityor alkalinityofa solution,expressed instandard units. Q."POTW'means any devices or systems used in the collection,storage,treatment, recycling,and reclamation of sewage or industrial wastes of a liquid nature and any conveyances which convey wastewater to a treatment plant. R."Applicable Pretreatment Standards"meansforany specified pollutant,general discharge prohibitions,City's specific limitations on discharge,State standards,or the National Categorical Pretreatment Standards (wheneffective),whichever standard is most stringent. S."Pretreatment"means the reduction oftheamount of pollutants,the eliminatiori ofpollut- ants,or the alteration ofthe nature of pollutant propertiesinwastewater priorto,or inlieu of,introducing such pollutants into the POTW.This reduction or alterationcan be obtained by physical,chemical,orbiological processes;by process changes;or by other means,except by diluting the concentration of the pollutants unless allowed by an applicable pretreatment standard. T."Public Sewer"means a sewer in whichall owners of abutting properties have equal rights,and is controlledby publicauthority. U."Sanitary Sewer"means a sewer which carries sewage and to which stormwaters,surface waters,and ground_watersare not intentionally admitted. V."Sewage"means a combinationof thewater carried wastes from residences,businessbuildings,institutions,and industrial establishments,together withsuch groundwaters,surface waters,and stormwaters as maybe present. W."Sewer"means a pipe orconduitfor carrying sewage. X."Shall"defines a mandatory requirement.O Y.Significant Industrial User"means a user that: 1.Discharges a nondomestic waste stream of25,000 gallons per day or more or; 2.Contributesa nondomesticwaste stream which makes up 5 percent or more oftheaveragedryweatherhydraulicororganic(BOD,TDS,TSS,etc.)capacityoftheCity'streatmentsystemor, 3,Has a reasonable potential,either individually or as a group or groups of similardischargers,to adversely affect the City'streatment plant operation (inhibition,passthroughofpollutants,biosolids contamination,or endangermentofPOTWworkers)or; 4.Is subject toCategorical Pretreatment Standards as defined in 40 CFR Chapter I,Subchapter N,Parts 405-471. Z."Slug Load or Slug"means any discharge at a flow rate or concentrationwhich couldcauseaviolationoftheProhibitedDischargeStandardsofthisChapteroranydischargenotofaroutine,regular,orepisodicnature,including but not limitedto an accidentalspill or a noncustomary batch discharge. AA.Storm Sewer"or "Storm Drain"shall mean a sewer whichcarries storm and surface waters and drainage,but excludes sewage and polluted industrial wastes. BB."Total Dissolved Solids"means the portionof total solids in water or wastewater that passes througha specificfilter. CC."Total Suspended Solids"means solids that either float on the surface of,or are insuspensioninwater,sewage,or other liquids;and which are removable by laboratoryfiltering. DD."Industrial User"means any non-domestic source of wastewater discharged to thePOTW.This excludes "Domestic Users"as defined herein. EE."Wastewater Discharge Permit"means a permit required for every Significant IndustrialUser(SIU).Permits are issued toa named person at a specified location,grantingtheprivilegeofdischargingSIUWastewaterintothePOTW.No SIU shall dischargewastewaterintothePOTWwithoutfirstobtainingaWastewaterDischargePermitfromtheCityofMosesLakeandtheWashingtonStateDepartmentofEcology. FF."Watercourse"means a channel in whicha flowof water occurs,eithercontinuously orintermittently. 13.04.020 Unlawful to Deposit Certain Wastes Upon Public or Private Property:It is unlawfulfor anypersontoplace,deposit,or permit to be deposited in an unsanitarymanner upon public orprivatepropertywithintheCity,or in any area under thejurisdictionof theCity,any human oranimalexcrement,garbage,orother objectionable waste. 13.04.030 Discharge of Sewage inNatural Outlets:Itis unlawfulto discharge toanynaturaloutlet withintheCity,or in any area under thejurisdictionof the City,any sanitary sewage,industrialOwastes,or other polluted waters,except where suitable treatmenthas been provided inaccordancewithsubsequentprovisionsofthischapter. 13.04.040 Use of Privies and SepticTanks:Except as permitted by GrantCounty Health Department,it is unlawfultoconstruct any privy,privyvault,septic tank,cesspool,orotherfacility intendedtousedforthedisposalofsewage. 13.04.045 Private Systems:Private sewer systems,septic tanks,and on-site disposal systems areprohibitedfornewsubdivisions. 13.04.050 Prohibited Waters:No person shall discharge or cause to be discharged any storm water, ground water,surface water,roof runoff,swimming pool water,subsurface drainage, noncontact cooling waterinsignificant volumes orunpolluted industrial process waters toany sanitary sewer. 13.04.060 Storm Drainage:Storm water,swimming pool water,ground water and allother unpolluted drainage shall be discharged toa specificallydesignated storm drain,natural outlet,oron site disposal approved bytheCity and/or Department of Ecology.Industrial noncontact cooling water or unpolluted process waters may be discharged,upon approvalof the City and/or Department ofEcology,to a storm drain,natural outlet,or on site disposal.O13.04.070 Prohibited Wastes:Except as provided in thischapter,noperson shall discharge orcause tobedischargedanyofthefollowingdescribedtypesofwastewatertoanypublicsewer.Any wastewater exceedingthe following limitations shall be subject tothe review and approvalof the Municipal Services Director,CityCouncil,and/or Department of Ecology: A.Anywaste stream orvaporhaving a temperaturewhich willinhibitbiological activityin thePOTWresultingininterference,and in nocase heat in such quantitiesthatthe tempera- tureat the POTWoollection systemexceeds40°C (104°F)unless theapprovalauthority, upon request ofthe POTW,approves alternativetemperaturelimits. B.Anywastewater which may contain more than100 mg/Ioffats,oils,or greases of animal or vegetable origin.Wastewater shall not contain: 1.In excess of 100 mg/I of petroleum oil,nonbiodegradablecuttingoil,or products of mineral oiloriginin amounts thatwillcause interference or pass throughand/or; 2.Any substance which may solidifyor become discernibly viscous at temperatures above 0°C (32°F)causing or contributingtoobstructionofwastewater flows at any point in thePOTW or result in interference. C.Any pollutant whicheither alone or byinteraction may create a fireor explosive hazard inthe POTW,including,but not limited to,wastestreams with a closed-cup flashpoint of less than 140 F (60°C)using thetest methods specified in 40 CFR 261.21,(40CFR 403.5(b)(1)),or arecapable of creating a public nuisance.(WAC 173-216-060(2)(b)(ii)).OD.Any medical waste,ashes,cinders,rock,sand,mud,straw,shavings,metal,glass,rags, feathers,tar,plastics,wood,paunch manure,or any other solidor viscous substance capable of causing obstruction totheflowin sewers,pass through,or other interference with the properoperationofthe POTW. E.Anywastewater having a pH lower than 6.0 or higher than G-G11.0,orhaving any other corrosive property capable of causing damage or hazard tostructures,equipment,and personnel of the POTW. F.Anywastewatercontainingdangerous wastes as defined inChapter 173- 303 WAC (listed,characteristic,or criteria wastes).The Municipal Ser- vices Director and theWashington State Department ofEcology,Eastern Region Dangerous Waste Unit,shall be notified of a dangerous waste discharge.Anyone who has discharged a dangerous waste shall comply with therequirements containedherein within30 days ofbecoming awareofadischargeofdangerouswastetothePOTW. 1.Such notification shallinclude: a.The name of the dangerous waste as set forth in Chapter 173-303 WAC. b.The dangerous waste number, c.The typeof discharge (continuous,batch,orother). G.Any wastewater containinga toxic or poisonous substance,including antifreeze,in sufficientquantity to injure or interfere with any sewage treatmentprocess,constituting a hazard tohumans or animals,or create any hazard in the receiving waters ofthesewage treatmentplant. H.Any wastewater containingsuspended or dissolved solidsof such char- acter and quantity thatunusualattention orexpense is requiredtohandle such materials at thesewage treatmentplanti. l.Any waste materials,including oxygen demanding waste materials (BOD,COD,etc.),released ineithera slug load or continuous discharge ofsuchvolumeorstrengthastocauseinteiferencetothePOTW. J.Any noxious or malodorous gas or substance capable ofcreating a publicnuisance. K.Any wastewater having a five (5)day biochemical oxygen demand (BOD)greater thanthreehundred (300)milligrams per liter. L Any wastewater containingmorethan three hundred and fifty(350)milligrams per literof totalsuspended solids (TSS). M.Any unacceptable amounts of totaldissolved solids (TDS)thatwill cause an interference with the normal operation of the POTW.Limitations for TDSwillbe set after the Department ofEcology andtheCityofMosesLakereviewengineeringreports,fromthe prospec-tivedischarger,investigating alternatives toreduce effluent TDS. N.Wastewater having an average dailyflowgreaterthantwo(2)percent of thedaily sewage flowof the City. 13.04.075 Pretreatment Facilities:Where necessary in theopinionof the Municipal Services Director,the owner shall provide,at his expense,such pretreatment as may be necessary to reduceobjectionablecharacteristicsorconstituentstowithinthemaximumlimitsprovidedforin Section 13.04.070,or control the quantities and rates ofdischarge ofsuch wastewater.Plans,specifications,and any other pertinent information relating toproposed pretreatment facilities shall be submitted for theapprovalof theMunicipalServices Director and oftheWashingtonStateDepartmentofEcology,and no discharge from such facilities shallbe commenced untiltheapprovalsareobtainedinwriting.Where pretreatment facilities are provided for anywastewater,theyshall be maintained continuouslyin satisfactoryand effectiveoperation,bytheownerathisexpense. 13.04.120 Manholes:When required by the Municipal Services Director,the owner of any propertyservedbyabuildingsewercarryingindustrialwastesshallinstallasuitablecontrolmanholeinthebuildingsewertofacilitateobservation,samplingand measurement ofthewastes.Such manhole,when required,shall be accessible and safely located,and shall be constructed inaccordancewithplansapprovedbytheMunicipalServicesDirector.The manhole shallbeinstalledbytheownerathisexpense,and shallbe maintained by him so as to be safe andaccessibleatalltimes. 13.04.130 Tests andAnalysis:Allmeasurements,tests,andanalysisofthecharacteristicsofwastewater to which reference is made in Sectione 13.04.070 shall be performed by a Department ofEcologyaccreditedlaboratoryanddeterminedinaccordancewith"Standard Methods for theExaminationofWaterandWastewater,"and shall be determined at the control manholeprovidedforinSection13.04.120,or upon suitable samples taken at thecontrol manhole.Intheeventthatnospecialmanholehasbeenrequired,thecontrol manhole shall be consideredtobethenearestdownstreammanholeinthepublicsewertothepointatwhichthebuilding sewer is connected.When requested bytheMunicipal Services Director,a user shall submitinformationonthenatureandcharacteristicsofit's wastewater toassure fullcompliancewiththischapter.The Municipal Services Director is authorized topreparea form for thispurposeandmayperiodicallyrequireuserstoupdatethisinformation.Samples takento meet therequirementsofthischaptershallberepresentativeofthevolumeandnatureofthetestparameters,including representative sampling of any unusual discharge or dischargecondition.AIIcosts associated withtestingand analysis shall be borne by the user. 13.04.140 Wastewater Discharge Permit:Statements contained in Sections 13.04.050 through13.04.070 shall not be construed as preventing any wastewater discharge permit between theCityCouncil,Department of Ecology and any industrial concern whereby an industrial waste ofunusualstrengthorcharactermaybeapprovedbytheCitycounciland/Or Department ofEcologyfortreatment,subjectto paymentthereforby theindustrial concem. 13.04.145 Discharge to Sewer System Without Physical Connection to Sewer Svstem:Regular orintermittentdischargeofwastewatertotheCity'ssewer system by anyone not physicallyconnectedtothesewersystemmaybepermitted.Authority to so discharge can onlybegrantedbytheMosesLakeCityCouncilwhentheCouncildeterminesthatpermittingthedischargeshallnothaveanydeleteriousordamagingeffectsonthehealthandwelfareoftheCity's residents and thatpermitting the discharge willbe in the City's best interests. A.Permission,ifgiven,todischarge wastewater to the City's sewer system shall be uponsuchtermsandconditionsdeemedappropriatebytheCityCouncilinitsdiscretion.Thepermitshall,at a minimum,contain provisions whichshall: 1.Require thepaymentoftherate which shallbe set by theCityCouncil. 2.Set limitations on thequantity and qualityor characteristicsofthe wastewater. 3.State that thepermit is terminableby theCity Council at willwithinthirty(30)days of notice being provided inwriting by the City to the discharger. 4.Provide where and how thewastewater istobe discharged totheCity'ssewersystem. 5.Require periodictestingofthewastewateraccordingtothestandardsestablished by the City. O.The permission to discharge wastewater to the City's sewer system will include the requirement to execute an extra-territorialutilityextension agreement upon forms prepared bythe Cityifthewastewateris generated froma site outsidethecorporatelimits of the City unless the Council enters into the record a finding that the wastewater discharger is incapable of executing such an agreement as distinguished from the wastewater discharger's reluctance toexecute theagreement and such a waiver is inthebestinterestsofthecitizensoftheCityofMosesLake. 13.04.150 Installation and Connection of Toilet Facilities With Sewer: A.The ownerof allhouses,buildings,orproperties used forhuman occupancy,employment, recreation,or other purpose,situatedwithin twohundred feet (200')of a public sanitary sewer ofthe City,is required at hisexpense and toconnect such facilities directly withthe Citysewer within six(6)monthsafterthedate ofofficialnoticetodo so.Provided thatthe connectionshallnotbe requiredifthecostofmakingtheconnection,including theprice of obtaining a private way of necessity as authorized by RCW 8.24,exceeds four thousanddollars ($4,000).Determinationof the cost of making theconnectionshall be made by theMunicipal Services Director.Ifthe person required tomake theconnection disagrees with thefinding of theMunicipalServices Director,the person can appeal the decision tothe City Council withinten(10)days ofthedecision ofthe Municipal Services Director.The decision of the City Council shall be final.Furthermore,ifa person is not required to make a connection because of cost,at such timeas theseptic system fails, either the tankor the drain field,the connection tothe City's sewer system shall be required and made. B.Forareas outside theCitylimitsrefer toGrantCounty Health DistrictOrdinanceNo 91-1, Sewage Waste Disposal and theWashington State Department of Health Chapter 246- 272 WAC,On-Site Sewage Systems. 13.04.160 Permit Requirements: A.No unauthorized person shalluncover,makeany connectionswithor openinginto,use, alter,or disturb any public sewer or appurtenance thereof without first obtaining the appropriate permits from theMunicipal Services Director. B.No significant industrial user shall discharge wastewater into the POTW without first obtaining a wastewater discharge permitfrom the Municipal Services Director. C.The Municipal Services Director may require other users toobtain wastewater discharge permits as necessary tocarryoutthe purposeof this chapter. D.The Municipal Services Director may require any person discharging into the POTW to install andmaintain,on theirproperty and at theirexpense,a suitable storage and flow controlfacility to ensure equalization of flow.A wastewater discharge permit may be issued solelyfor flow equalization. E.Any violation of the terms and conditions of a wastewater discharge permit shall be deemed a violationof this chapter and subjects the wastewater discharge permittee to sanctions set out in Sections 13.04.310 through13.04.330 of thischapter.Obtaining awastewaterdischargepermitdoesnotrelieveapermitteeofit's obligation tocomplywith all Federal and State pretreatment standards or requirements,orwithany otherrequire- ments of Federal,State,and Local law. 13.04.170 Application for Permit -Fee: A.Permit:The owneror his agent shall make applicationfor sewer service.The permit application shall be supplemented by any plans,specifications,or other information considered pertinentin thejudgmentof theMunicipal Services Director. B.Eges: 1.Atthe timeanapplication forsewer service is filedwiththe City,theapplicant shall payapermitfeeassetforthintheapplicableUniformPlumbingCodeforbuildingsewers. 2.Anapplicant fora Wastewater Discharge Permit shall pay at the timeofapplication forthepermitthecostofinvestigatingandprocessingthepermitperMosesLakeMunicipalCodeChapter3.54. -3.Wastewater Discharge Permit renewal fees per Moses Lake Municipal Code Chapter 3.54. 4.Wastewater Discharge Permit annual fees per Moses Lake Municipal Code Chapter3.54. 13.04.175 Insoections:The applicant for the building sewer permit shall notify the Municipal ServicesDirectorwhenthebuildingsewerisreadyforinspectionandconnectiontothepublicsewer.The connection shall be inspected by theMunicipalServices Director. 13.04.180 Expense of Installation:AII costs and expense incident tothe installation and connection ofthebuildingsewershallbebornebytheowner.Ownershipof the building sewer from the Citysewermaintothebuildingremainswiththepropertyowner.The owner shall indemnify theCityfromanylossordamagethatmaydirectlyorindirectlybeoccasionedbytheinstallationofthebuildingsewer. 13.04.190 Separate Sewer for Each Building:A separate and independent building sewer shall beprovidedforeverybuildingandconnectedtotheCitysewerexcept; A.When a building stands at therear of another on an interior residential lotand no sewerisavailableorcanbeconstructedtotherearbuildingthroughanadjoiningalley,court,yard or driveway,the building sewer from the front building may be extendedto therearbuildingandthewholeconsideredasonebuildingseweror; B.When separate buildings which are an integral part of a single business or industry or; C.When separate buildingswhich are underthesame ownershipand located on the samelotorwithinasinglebindingsiteplan. 13.04.200 New Buildinas:Old building sewers maybe used inconnectionwith new buildings only when theyare found,uponexamination bythe Municipal Services Director,tomeet allrequirementsofthischapter. 13.04.290 Right of Entry:The MunicipalServices Director,bearing proper credentials and identification, shall be permitted to enter upon all properties for the purpose of inspection,observation, measurement sampling,and testing in accordance withtheprovisions of thischapter. 13.04.310 Notice toCease Violation:Any person found tobe violatinganyprovisionofthischapter shallbeservedbytheCitywithwrittennoticestatingthenatureoftheviolationandprovidingareasonabletimelimitforthesatisfactorycorrectionthereof.The offender shall,within theperiodoftimestatedinsuchnotice,permanently cease allviolations. 13.04.320 Penalty for Continued Violation:Any person who continuesanyviolation beyond the timelimitprovidedforinSection13.04.310 is deemed to have committed a civilinfraction,and uponconvictionthereof,shallbe subjecttoa C-1 penalty and punishable as defined inChapter 1.08oftheMosesLakeMunicipalCode.Each day in which any such violation shallcontinue isdeemedaseparateoffense.Failure or refusal to comply shall also constitute grounds fordiscontinuingsewerservicetothepremisesuntilsuchrequirementshavebeensatisfactorily met 13.04.330 Liabilityfor Excense or Damage: A.Damage resulting from an accident or from unauthorized or improper use of sewerfacilitiesshallbecomeanobligationagainsttheagencyorpersoncausingsuchdamage. B.Additionally,any person violating any oftheprovisions of thischapter shallbecome liabletotheCityforanyexpense,loss,or damage occasioned the City by reason of suchviolation. 13.04.340 Severability:The provisions of thischapter are severable,and ifany provisionofthischapter, or application ofany provision of thischapter toany circumstance is held invalid,theapplica- tionofsuch provision to other circumstances,and theremainderofthischapter shallnotbe affectedthereby. Section 2.This ordinanceshalltakeeffectand be in force five (5)days after its passage and publication of its summary as provided by law.
