1820_00001ORDINANCE NO.1820 ANORDINANCEAMENDINGCHAPTER 18.16 OF THE MOSESLAKEMUNICIPALCODEENTITLED"R-1,SINGLE FAMILYRESIDENTIALZONE" THE CITYCOUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DOORDAINAS FOLLOWS: Section 1.Chapter 18.16 of theMoses Lake Municipal Codeentitled"R-1,Single Family Residential Zone"is amended as follows: 18.16.020 Permitted Uses:Hereafterin theSingle Family Residential Zone,no building,structure,or landshallbeusedandnobuildingorstructureshallbeerected,altered,enlarged,or relocated thereinwhichisdesignedorintendedtobeusedforanyotherthanthefollowingoutrightpermittedusesorasaconditionaluse.Outright permitted uses or conditionaluses in the Single FamilyResidentialZoneshallbeincompliancewiththeconditions,theperformance standards,and bulkregulationsofthischapter. A.OutrightPermitted Uses: 1.Single familydwelling units,including a.Singlefamilydetached dwelling units. b.Single family dwelling unitssharing a commonwall or attachment on two lots ofrecord. c.Condominiums -single family attached dwelling units developed as a horizontalregimeincompliancewithChapter18.67 of thistitleentitled"Planned DevelopmentDistrict" d.Factory builtstructures noton a permanent chassis. 2.Subordinate Uses -Any use which is incidental and subordinate totheprincipal use ofthelandorbuilding;is located on the same lot with the principal uses;and is nototherwiseprohibited.O 3.Accessory buildings and/orstructures appurtenanttoany permitted uses in compliancewithSection18.16.040 of thischapter. 4.Factory-built housing constructed tothe standards of theUniformBuilding Code. 5.Keeping ofhousehold pets (dogsand cats)not exceeding three (3)in numberwhich arefour(4)monthsold or older. 6.Planned DevelopmentDistricts in compliance with Chapter 18.67 ofthis title. 7.Home occupations in compliancewithChapter 18.55 ofthistitle. 8.Parks and non-commercial recreational uses. 9.An accessory dwelling unitintended to accommodate a member(s)of theimmediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.16.190 ofthischapter entitledResidential Density. 10.Otherunmentioned uses ruled bythePlanning Commission tobe similarto and compati-ble with thespecified permitted uses. 11.Family day care homes providing care during part of the twenty-four(24)hour day totwelve(12)or fewer childrenin thefamily livingquarters of the provider's home.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department ofSocial andOHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.Certification by the officeof child care policy licensor asprovidingasafepassengerloadingarea,and a city business license shallbe required.The building and lot shall complywith all building,fire,safety,and health code require-ments,and shall conform to the lot size,buildingsize,set backs,and lot coveragestandardsofthezone,except for legal nonconforming structures.Signage shallnot bepermitted.Hours of operation may be limited to facilitate neighborhoodcompatibility,while also providingappropriate opportunitiesfor persons who use family day-care andwhoworkanonstandardshift.Proof thatadjoiningproperty owners have been notifiedinwritingoftheintenttolocateandmaintainsuchafacilityshallberequired. ORD.1820]Page 2 12.Adult familyhomes in a regular abode of a person or persons providing personal care, special care,room,and board tomorethan one but notmore than six adults who are not related by blood or marriage totheperson or persons providingthe services.Adultfamily homes shall be licensed by the Department of Social and HealthServices and a city business license shall be required. B.ConditionalUses:The following uses maybe permitted by the Planning Commissionas a conditional use incompliance withtheprovisions of thischapter andChapter18.51ofthistitle entitled "Conditional and Unmentioned Uses." 1.Cemeteries 2.Churches and church structures or additionswhich may exceed thirtyfeet (30')in height 3.Essential publicservices and utilities including buildings and structures. 4.Golfcourses 5.Other unmentioned uses ruled by the Planning Commissionto be a conditionaluse provided thatthe use shall be similarto and compatible with theexpressed permittedand conditional uses. 6.Rental of an apartment appurtenant to a single family residence 7.Schools 8.Day Care Center: a Day Care Center:Aday care facilitythatprovidesfor thecare of from thirteen(13) throughtwenty(20)childrenin thefamily abode of the person holding thelicense issued by the State of Washington,Departmentof Social and Health Services, b.Requirements:Daycare centers shallbe incompliancewith the following require- ments: 1)Outdoor play areas shall not be located infront yards. 2)One (1)on-site parking space is required for each employeein addition to required resident parking. 3)An on-site,off-street loading and unloadingarea shallbe required. 4)Acity business license shall be required. 5)Signage shallnot be permitted. 6)No structuralor decorative alterationwhich would alter the character or be incompatible with thesurroundingresidences shallbe permitted. 7)The use and structures shall be in compliance with zoning regulationsand UniformBuildingCode requirements. 6)Day care centers shallbe licensed by the State ofWashington,Department of Socialand Health Services and shall operate in compliancewith thelicensed capacity requirementas determined by the State ofWashington,Department of Social and Health Services except that day care centers shall operate in compliance with the capacity requirements as stipulated in thissection. 9)The Planning Commission may impose conditions to mitigate any potential adverse impacts on the surrounding area. 10)Notification and agreement of adjacent property owners of an applicationfor a day care facility. 11)Iftheday care center is located in a private family residence,the portion ofthe residence where the children have access shall be used exclusively for the children during the hours the center is inoperation oritshall be separate from the usual livingquarters ofthe family. ORD.1820 /Page 3 18.16.030 Prohibited Uses:Any use notexpressly permitted outrightoras a conditionaluse intheR-1 Zoneshallbeprohibited,including but not limited tothefollowingexamples: A.Abandoned sheds or buildingsina state ofdisrepair B.Commercialuses except as provided in Section 18.16.020 (A)and (B). C,Two familyormulti-familydwelling unit structuresexcept as providedforin Section 18.16.020A.1.c. D.Keeping of livestock,poultry,rabbits or bees E.Industrial uses F.Occupancyof trailersor recreationalvehicles G.Public nuisances H.Removal of soil orothernaturalmaterials forthe purpose of sale or use as fillmaterialexceptthatexcavationforthepurposeofconstructionorlandscapingispermitted. I.Outside storage,collection,ordumping ofdismantled,padly dismantled,orwreckedvehicles,trailers,machinery,or theirparts. J.Outside storage orcollectionof any junk,scrap,garbage,unsightly material,litter,ordebris. K.Manufacturedhomes L.Factory-builthousing constructed ona chassis. M.Locating any sea or ocean-going containerswhich can be detached from a trailer,chassis,or frame and whichwere formerly used for transportingsea orocean-goingcargo,railroadcarsandcabooses,semi-trailerswhenintended tobe used as storage facilities,orany otherunitwhichdetachesfromatrailer,chassis,or frame including car,truck,or van bodies orpartsofbodieswhenintendedtobeusedasstoragefacilitiesorthelike.O N.Manufactured HomeSubdivisions Section 2.This ordinanceshall takeeffectandbe in force tive(5)days after its passage and publication ofitssummaryasprovidedbylaw.
