AN ORDINANCEAMENDINGCHAPTER18.190F THEMOSES LAKEMUNICIPALCODEENTITLED"R-2,SINGLE FAMILYANDTWOFAMILYRESIDENTIALZONE"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 18.19 of the Moses Lake MunicipalCode entitled "R-2,Single Family and Two FamilyResidentialZone"is amended as follows:
18.19.020 Permitted Uses:Hereafter in the Single Family and Two Family Residential Zone,no building,structure,or land shall be used and no buildingor structure shall be erected,altered,enlarged,or relocated thereinwhichis designed or intended to be used for any other thanthefollowingoutrightpermittedusesorasaconditionaluse.Outrightpermitteduses orconditionaluses intheSingleFamilyandTwoFamilyResidentialZoneshallbeincompliancewiththeconditions,theperformancestandards,and the bulk regulations of this chapter.
A.Outright Permitted Uses:
1.Duplex -a structureon one lot ofrecord containing two(2)dwelling units.
2.Singlefamily dwelling units,including
a.Single family detached dwelling units.
b.Single familydwellingunitssharing a common wallor attachment on twolots ofrecord.
c.Condominiums-singlefamily attached dwelling units developed as a horizontalregimeincompliancewiththerequirementsofthischapterorincompliancewithChapter18.67 of this titleentitled"Planned Development District."
3.Subordinate Uses -any use which is incidental and subordinateto theprincipal use ofthelandorbuilding;is located on the same lot withtheprincipal use;and is nototherwiseprohibited.O 4.Accessory buildings and/or structuresappurtenant toany permitteduses in compliancewithSection18.19.040ofthischapter.
5.Factory-built housing constructedtothestandards of the Uniform BuildingCode.
6.Manufactured homes
7.Keeping of household pets (dogsand cats)notexceedingthree (3)innumberwhicharefour(4)monthsold or older.
8.Planned Development Districts in compliancewithChapter 18.67 of this title,entitled"Planned Development District."
9.Parks and non-commercialrecreationaluses.
10.Home occupations in compliancewith Chapter 18.55 ofthis title.
11.An accessory dwelling unit intended to accommodate a member(s)ofthe immediatefamilyrequiringdailycare,supervision,or guardianship in compliance withSection18.19.190 of thischapter entitled "Residential Density."
12.Other unmentioneduses ruledby thePlanning Commission tobe similartoand compati-ble withthe specified permitted uses.
O 13.Family day care homes providingcare during part of the twenty-four(24)hour day totwelve(12)or fewer childrenin thefamily livingquarters of the provider's home.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department of Social andHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.Certificationby the office of childcare policy licensor asprovidingasafepassengerloadingarea,and a citybusiness license shallbe required.The building shall complywithallbuilding,fire,safety,and health code requirements;andthebuildingandlotshallconformtothelotsize,buildingsize,set backs,and lotcoveragestandardsofthezone,except for legal nonconforming structures.Signage shallnot bepermitted.Hours ofoperation may be limited tofacilitate neighborhoodcompatibility,while also providing appropriate opportunities for persons who use familyday-care and

whowork a nonstandard shift.Proof thatadjoiningpropertyownershave been notified
inwritingofthe intent to locate and maintain such a facilityshallbe required.
14.Adult family homes in a regulärabode of a person or persons providing personal care,
specialcare,room,and board to more than one but not morethansix adultswho are not
related by blood or marriagetotheperson or persons providingtheservices.Adultfamily
homes shall be licensed by the Department of Social and Health Services and a city
business license shallbe required.
B.Conditional Uses:The following uses may be permittedby thePlanning Commission as a
conditional use incompliance withtheprovisions ofthischapter and Chapter18.51 ofthistitle
entitled"Conditional and UnmentionedUses."
1.Churches and church structures or additions which may exceed thirtyfeet (30')in height
2.Schools
3.Golf Courses
4.Cemeteries
5.Rental ofan apartmentappurtenant to a single family residence
6.Manufactured home parks in compliance with Chapter 18.65 of this code entitled
"Manufactured Home Parks."
7.Essential public services and utilities including buildings and structures.
8.Boarding houses for notmorethanthree (3)people
9.Day Care Centers:
a.Day Care Center:Aday care facilitythatprovides for thecare offrom thirteen(13)
throughtwenty(20)childrenin thefamily abode of the person holding the license
issued by the State of Washington,Department of Social and Health Services.Ob.Requirements:Day care centers shall be in compliance withthefollowíng require-
ments:
1)Outdoor play areas shall not be located in front yards.
2)One (1)on-site parking space is required for each employee in addition to
required resident parking.
3)An on-site,off-street loading and unloading area shallbe required.
4)Acitybusiness license shall be required.
5)Signage shall notbe permitted.
6)No structuralor decorative alteration which would alter the character or be
incompatible withthe surrounding residences shall be permitted.
7)The use and structures shall be in compliancewith zoning regulations and
Uniform BuildingCode requirements.
8)Day care centers shall be licensed by the State of Washington,Department of
Social and Health Services and shall operate in compliancewiththe licensed
capacityrequirementas determined by theState ofWashington,Department of
Social and Health Services except that day care centers shall operate in
compliancewiththe capacityrequirementsas stipulatedin thissection.
9)The Planning Commission may impose conditions to mitigate any potential
adverse impacts on the surroundingarea.
10)Notification and agreement of adjacent property owners ofan application for a
day care facility.
11.Other uses ruled by thePlanning Commissiontobe a conditionaluse provided thatthe
use shallbe similartoandcompatiblewiththe expressed permitted and conditionaluses.

12.Temporary occupancy and use of recreational vehicles (RV):
a.The following criteriashallbe met:
1)Applicantmust be a non-profit organization
2)Request is associated with a construction projectwhich requiresa conditional
use permit as listed in 18.16.020.B.1 -8.
O 3)The location and sitingof RV's shall comply with Section 18.65.080 SetbacksandSeparationsofManufacturedHomeParks,Chapters 16.36 FireApparatusaccessand16.46 Fire Hydrants,
b,The following requirements shall be stipulated as conditions of the conditional usepermit.These include,but are not limitedto:
1)The duration of the conditional use permitshall be specifiedand shall not beallowedtoexceedthelifeofthebuildingpermit.
2)The numberof RV's to be allowed.
3)The RVsite shallbe leftfree of debris,litter or otherevidence ofRV occupationuponthecompletionorremovaloftheuse;
4)A solid waste disposal plan,
c.Notificationand agreement of adjacent property owners of an application fortemporaryoccupancyanduseofrecreationalvehicles.
Section 2.This ordinanceshall takeeffectand be inforce five(5)days after its passage and publicationofitssummaryasprovidedbylaw.
