1822_00001ORDINANCE NO.1822 ANORDINANCEAMENDINGCHAPTER 18.22 OF THE MOSESLAKEMUNICIPALCODEENTITLED"R-3,MULTI-FAMILYRESIDENTIALZONE" THE CITYCOUNCIL OF THECITYOF MOSESLAKE,WASHINGTON DO ORDAIN AS FOLLOWS: I8.22Section1.Chapter /of the Moses Lake MunicipalCode entitled"R-3,Multi-familyResidential Zone"isamendedasfollows: 18.22.020 Permitted Uses:Hereafterin the Multi-familyResidential Zone,no building,structure,or land shallbeusedandnobuildingorstructureshallbeerected,altered,or relocated herein which isdesignedorintendedtobeusedforanyotherthanthefollowingoutrightpermittedusesorasaconditionaluse.Outrightpermitted uses or conditional uses inthe Multi-family Residential Zoneshallbeincompliancewiththeconditions,theperl'ormance standards,and bulk regulations of thischapter. A.Outright Permitted Uses: 1.Multi-familydwelling unit structure -a structurecontainingmore thantwodwelling units on a singlelot. 2.Duplex -a structure on one lotofrecord containingtwo(2)dwelling units. 3.Single family dwelling units,including a.Single family detached dwelling units, b.Singlefamily dwellingunits sharing a commonwall or attachment on twolots ofrecord. c.Condominiums -single family attached dwelling units developed as a horizontalregimeincompliancewiththerequirementsofthischapterorincompliancewithChapter18.67 of thistitleentitled "Planned Development District." 4.Subordinate Uses -any use whichis incidental and subordinate tothe principal use ofthelandorbuilding;is located onthesame lotwiththeprincipal use;and is not otherwiseprohibited. 5.Accessory buildings and/or structures appurtenant toany permitted uses in compliancewithSection18.22.040 ofthis chapter. 6.Factory-built housing constructed tothestandards of the Uniform BuildingCode. 7.Manufactured homes 8.Keeping ofhousehold pets (dogsand cats)nottoexceed three(3)innumber whicharefour(4)monthsold or older. 9.Planned Development Districts in compliance withChapter 18.67 of this title,entitled"Planned Development Districts." 10.Parks and non-commercialrecreational uses. 11.Home occupations in compliance withChapter 18.55 ofthistitle. 12.An accessory dwelling unitintended to accommodate a member(s)of the immediatefamilyrequiringdailycare,supervision,or guardianship in compliance with Section18.22.210 of thischapter entitled "Residential Density," O 13.Otherunmentioned uses ruledby thePlanning Commissiontobe similar to and compati-ble with the specified permitted uses. 14.Family day care homes providing care during part of the twenty-four (24)hour day totwelve(12)orfewer children inthe family livingquartersof the provider's home.FamilydaycarehomesshallbelicensedbytheStateofWashington,Department ofSocial andHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.Certificationby theofficeof child care policylicensor asprovidingasafepassengerloadingarea,and a citybusiness license shall be required.The buildingshall complywithallbuilding,fire,safety,and health code requirements;andthebuildingandlotshallconformtothelotsize,building size,set backs,and lotcoveragestandardsofthezone,exceptforlegal nonconformingstructures.Signage shall conformtoChapter18.56.Hours ofoperation maybe limitedtofacilitate neighborhood compati-bility,while also providing appropriateopportunitiesfor persons who use familyday-care ORD.1822/Page 2 and who work a nonstandard shift.Proof thatadjoiningproperty owners have been notified inwriting of the intent to locate and maintain such a facility shallbe required. 15.Adult familyhomes in a regularabode of a person or persons providing personal care, special care,room,and board to more thanone but not more than sixadultswho are not related byblood or marriage tothepersonor persons providingtheservices.Adultfamily homes shall be licensed by the Department of Social and Health Services and a city business license shallbe required. B.Conditional Uses:The following uses may be permittedby thePlanning Commissionas a conditionaluse incompliancewiththe provisions ofthischapterand Chapter18.51 ofthistitle entitled "Conditional and Unmentioned Uses." 1.Golf Courses 2.Cemeteries 3.Manufactured home parks in compliance with Chapter 18.65 of this code entitled "ManufacturedHome Parks." 4.Clubs,lodges,and assembly halls 5.Athletic clubs 6.Boarding houses 7.Schools 8.Churches andchurchstructuresor additions whichmayexceed thirtyfeet (30')in height 9.Clinics 10.Professional offices 11.Rental of an apartment appurtenantto a single family residence 12.Essential publicservices and utilities including buildings and structures. 13.Hospitals 14.Hotels 15.Motels 16.Marinas located along thelake shore 17.MiniDay Care Facilityand Day Care Centers: a.Mini Day Care Facility:A day care center for the care of twelve (12)or fewer children in a facility other than the family abode of the person or persons under whose direct care and supervisionthe child is placed. b.Day Care Center:A day care facility that provides for thecare of thirteen(13)or more childrenprovided thatthecapacityofday care centers located in privatefamily residences in residentialzones shallnot exceed twenty(20)children at anygiven timeand the permitted capacity of day care centers located in residential zones in other than private family residences shall be set by the Planning Commission on a case by case basis. c.Requirements:Miniday care facilities and day care centers shall be in compliance with the followingrequirements: 1)Outdoor play areas shall not be located in front yards. 2)One (1)on-site parking space is required for each employee in additionto required resident parking. 3)An on-site,off-streetloading and unloading area shallbe required. 4)A citybusiness license shall be required. 5)Signage shall not be permitted. ORD.1822/PAGE 3 6)No structural or decorative alterationwhich would alter the character or beincompatiblewiththesurroundingresidencesshallbepermitted. 7)The use and structures shall be in compliance with zoning regulationsandUniformBuildingCoderequirements. 8)Miniday care facilities and day care centers shall be licensed by the State ofWashington,Departmentof Social andHealth Services and shall operate incompliancewiththelicensedcapacityrequirementasdeterminedbytheStateofWashington,Department ofSocial and HealthServicesexceptthatday carecentersshalloperateincompliancewiththecapacityrequirementsasstipulatedinthissection, 9)The Planning Commission may impose conditions to mitigate any potentialadverseimpactsonthesurroundingarea. 10)Notification and agreement of adjacent property owners ofan application for adaycarefacility. 18.Other uses ruledbythePlanning Commissiontobe a conditional use provided thattheuseshallbesimilartoandcompatiblewiththeexpressedpermittedandconditionalusesorotherusespermittedbyspecificprovisionofthischapterasaconditionaluse. 19.Temporary occupancyand use of recreationalvehicles (RV): a.The followingcriteriashall be met: 1)Applicant must be a non-profitorganization 2)Request is associated witha constructionproject whichrequires a conditionalusepermitaslistedin18.16.020.8.1 -19. 3)The location and sitingof RV's shall comply withSection 18.65.080 SetbacksandSeparationsofManufacturedHomeParks,Chapters 16.36 FireApparatus access and 16.48 Fire Hydrants. b.The following requirements shall be stipulated as conditions ofthe conditional usepermitTheseinclude,but are not limited to: 1)The duration of theconditionaluse permit shall be specifiedand shall not beallowedtoexceedthelifeofthebuildingpermit. 2)The numberof RV's tobeallowed. 3)The RVsiteshall be leftfree of debris,litterorotherevidence of RVoccupationuponthecömpletionorremovaloftheuse. 4)Asolidwaste disposal plan. c.Notification and agreement of adjacent property owners of an application fortemporaryoccupancyanduseofrecreationalvehicles. Section 2.This ordinanceshalltakeeffectand be in force five (5)days afterits passage and publication ofitssummaryasprovidedbylaw. Adoptedby theCityCouncil and signed by its Mayor on October27,1998.
