1823_00001ORDINANCE NO.1823 ANORDINANCE AMENDINGCHAPTER 18.25OF THE MOSES LAKEMUNICIPAL CODE ENTITLED"R-4,RESIDENTIALZONE" THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DOORDAINASFOLLOWS: Section 1.Chapter 18.25 of the Moses Lake MunicipalCode entitled"R-4,Residential Zone"is amended asfollows: 18.25.020 Permitted Uses:Hereafter inthe Residential Zone no building,structure,or land shall be used and no buildingor structureshall be erected,altered,enlarged,or intended to be used foranyotherthanthefollowingoutrightpermittedusesorasaconditionaluse.Outright permitteduses or conditional uses in the R-4 Residential Zone shall be in compliancewith all performance standards,conditions,and bulkregulations ofthischapter. A.OutrightPermitted Uses: 1.Single family detached dwelling units,manufactured homes,and factory built housingconstructedtothestandardsoftheUniformBuildingCode. 2.Any use which is incidental and subordinate tothe principal use oftheland or building;is located on the same lotwith theprincipaluse;and is nototherwiseprohibited. 3.Accessory buildings and/orstructuresappurtenanttoany permitteduses incompliance with Section 18.25.040 ofthischapter. 4.Cultivation of land for agriculturalproducts,vine yards,gardening,and fruitgrowing. 5.Keeping oflivestock,poultry,rabbits,andbees inaccordance with Section18.25.050 ofthischapter. 6.Selling of agricultural products raised or grown on the premises. 7.Keepingof household pets (dogsand cats)not exceedingfour (4)in numberwhicharefour(4)months old or older. 8.Planned Development Districtsin compliancewithChapter 18.67 ofthistitle. 9.Home occupations in compliancewithChapter 18.55 of thistitle. 10.Parks and non-commercialrecreational uses. 11.An accessory dwelling unit intended to accommodate a member(s)oftheimmediatefamilyrequiringdailycare,supervision,or guardianship in compliancewith Section18.25 190 of thischapter entitled Residential Density. 12.Other unmentioneduses ruledby the Planning Commission tobe similartoand compati-ble withthe specifiedpermitted uses. 13.Family ChildCare Home providing care during part of thetwenty-four(24)hour day totwelve(12)or fewer dhildreninthe family livingquarters of theprovider's home.FamilyChildCareHomesshallbelicensedbytheStateofWashington,Department of SocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequire-ments for familyChildCare Homes.Iflocated withinthecorporate limitsa city businesslicenseshallberequired.Certification by the officeof child care policy licensor asprovidingasafepassengerloadingareashallberequired.The buiding and lot shallcomplywithallbuilding,fire,safety,andhealth code requirements,and shallconformtothelotsize,building size,set backs,and lotcoverage standards ofthezone,except forlegalnonconformingstructures.Signage shallnotbe permitted.Hours ofoperationmayObelimitedtofacilitateneighborhoodcompatibility,while also providingappropriateopportunitiesforpersonswhousefamilyday-care and who work a nonstandard shift.Proof that adjoining property owners have been notified in writing oftheintent to locateandmaintainsuchafacilityshallberequired. 14.Adult family homes in a regular abode of a person or persons providing personalcare,special care,room,and board tomore than one but not more thansixadultswhoarenotrelatedbybloodormarriagetothepersonorpersonsprovidingtheservices.Adult family homes shall be licensed by the Department of Social andHealthServices.Iflocated within the corporate limits,a city business license shallberequired. ORD.1823/PAGE 2 B.ConditionalUses:The following uses may be permittedbythePlanningCommissionas aconditionaluseincompliancewiththeprovisionsofthischapterandChapter18.51 ofthistitle entitled Conditional and Unmentioned Uses. 1.Cemeteries 2.Churches 3.Essential public services and utilities including buildings and structures. 4.Golfcourses 5.Other unmentioneduses ruled by the Planning Commissionto be a conditionaluseprovidedthattheuseshallbesimilartoandcompatiblewiththeexpressedpermittedand conditional uses. 6.Schools 7.Stables,riding academies,and commercial dog kennels 8.Rental ofan apartment appurtenanttoa singlefamily residence. 9.Selling ofseasonal agriculturalproducts i.e.commercialfruitstands. Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication of its summaryas provided by law.
