ANORDINANCEAMENDINGCHAPÎER 18.28 OF THE MOSES LAKEMUNICIPALCODEENTITLED"C-1,CENTRAL BUSINESS DISTRICT ZONE"
THE CITYCOUNCIL OF THE GITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 18.28 of theMoses Lake Municipal Code entitled "C-1,Central Business DistrictZone"
is amended as follows:
18.28.030 Examples of Permitted Uses:The following specificand generally described uses are listed asexamplesofthetypesofusesthatmaybelocatedintheC-1 zone.The list is not all inclusive.
A.Retail uses
B.Govemmentaloffices
C.Service uses
D.Professional offices
E.Cultural,recreational,and entertainmentuses
F.Lodging,assembly and food services
G.Planned development districts
H.Essential public services and utilities including buildingsand structures
I.Accessory uses appurtenanttoany primary uses and not otherwise prohibited.
J.Banking and financial services
K.Locating steelsea orocean-goingcontainersmarked withtheAmerican Bureau ofShipping'sEmblemormeetingtheInternationalStandardsOrganizationstandardswhichcanbedetachedfromatrailer,chassis,orframe and,which were formerly used for transportingseaorocean-going cargoor semi-trailers when intended tobe used as storage facilities orthelikeatconstructionsites.Construction storage facilities maybe located ten (10)days priortostartofconstructionandshallberemovedwithinten(10)days of finish of construction.Start ofconstructionshallbedefinedasten(10)days priortothephysical presence of constructionactivityonthesiteforwhichabuildingpermithasbeenissued.Finishof construction shallbedefinedasthedateofissuanceofaCertificateofOccupancy.O L.Adultfamilyhomes ina regularabode ofa person or persons providingpersonal care,special
care,room,and board tomorethanone butnotmorethansix adults whoare notrelatedbybloodormarriagetothepersonorpersonsprovidingtheservices.Adultfamily homes shallbelicensedbytheDepartmentofSocialandHealthServicesandacitybusinesslicenseshallberequired.
M.Family day care homes providing care during part of the twenty-four(24)hour day totwelve(12)or fewer childrenin the family living quarters of theprovider's home.Family day carehomesshallbelicensedbytheStateofWashington,Department of Social and HealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.Certification by theofficeofchild care policylicensor as providinga safepassengerloadingarea,and a citybusiness license,shall be required.The buildingshallcomplywithallbuilding,fire,safety,and health code requirements;and thebuildingand lotshallconformtothelotsize,buildingsize,set backs,andlotcoveragestandards ofthezone,except for legal nonconformingstructures.Signageshall conformtoChapter 18.56.Hoursofoperationmaybelimitedtofacilitateneighborhoodcompatibility,while also providingappropriateopportunitiesforpersonswhousefamilyday-care andwho work a nonstandardshift.Proof that adjoining property owners have been notified inwritingoftheintent tolocateandmaintainsuchafacilityshallberequired.
Section 2.This ordinanceshall takeeffectand be inforce five(5)days afterits passage and publication ofitssummaryasprovidedbylaw.
