ANORDINANCEAMENDINGCHAPTER18.32 OF THE MOSESLAKEMUNICIPAL
CODE ENTITLED "C-2,GENERAL COMMERCIALANDBUSINESS ZONE"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section1.Chapter18.32 oftheMoses LakeMunicipalCode entitled "C-2,GeneralCommercialand Business
Zone"is amended as follows:
18.32.030 Examples of Permitted Uses:The followingspecificand generallydescribed uses are listed asexamplesofthetypesofusesthatmaybelocatedintheC-2zone.The list is not all inclusive.
A.Retail and wholesale uses
B.Offices
C.Services
D.Cultural,recreational,and entertainmentuses
E.Essential public services and utilities including buildings and structures
F.Lodging,assembly,and food service
G.Planned development districts
H.Banking and financial services
I.Repair and maintenance
J.Storage,warehousing,and distribution
K.Light manufacturingwhen conducted as partofa retail sales outlet
L.Private or publictransportationsystems
M.Accessory uses appurtenant to any primary uses and not otherwise prohibited.
N.Locating steel sea orocean-going containersmarkedwiththeAmerican Bureau of Shipping'sEmblemormeetingtheInternationalStandardsOrganizationstandardswhichcanbedetachedfromatrailer,chassis,orframeand,whichwere formerly used for transpodingseaorocean-goingcargoorsemi-trailerswhen intended tobe used as storage facilities orthelikeatconstructionsites.Constructionstorage facilitiesmay belocatedten(10)days priortostartofconstructionandshallberemovedwithinten(10)days of finish ofconstruction.Start ofconstructionshallbedefinedasten(10)days prior tothephysicalpresence ofconstructionactivityonthesiteforwhichabuildingpermithasbeenissued.Finish of construction shallbedefinedasthedateofissuanceofaCertificateofOccupancy.
O.Adultfamilyhomes ina regularabode ofa person or persons providing personal care,special
care,room,and board tomorethanone but not more thansixadultswho are not related bybloodormarriagetothepersonorpersonsprovidingtheservices.Adult family homes shallbelicensedbytheDepartmentofSocialandHealthServicesandacitybusinesslicenseshallberequired.
P.Family day care homes providing care during partofthetwenty-fourhour day totwelve(12)or fewer children inthe family livingquarters oftheprovider's home.Familyday care homesshallbelicensedbytheStateofWashingtonDepartmentofSocialandHealthServicesandshalloperateincompliancewiththelicensedcapacityrequirementsforfamilydaycarehomes.Certification by the office of child care policylicensor as providing a safe passengerOloadingarea,and a city business license shallbe required.The building shallcomply withallbuilding,fire,safety,and health code requirements;and the building and lot shall conform tothelotsize,building size,set backs,and lotcoveragestandards ofthe zone,except for legalnonconformingstructures.Signage shallconformtoChapter 18.56.Hours ofoperationmaybelimitedtofacilitateneighborhoodcompatibility,whilealso providing appropriate opportuni-ties for persons who use family day-care and who work a nonstandard shift Proof thatadjoiningpropertyownershavebeennotifiedinwritingoftheintenttolocateandmaintainsuchafacilityshallberequired.
Section 2.This ordinance shall take effectand be in force five(5)days after its passage and publicationofitssurnmaryasprovidedbylaw.
