ANORDINANCE AMENDINGCHAPTER 8.28 OF THE MOSES LAKEMUNICIPALCODEENTITLED"NOISE CONTROL*"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 8.28 oftheMoses Lake Municipal Codeentitled "Noise Control"is amended as follow:
8.28.050 Noises Exempt-Completely or Partiallv:
A.The followingnoises are exempt from theprovisions ofthischapter at alltimes,provided,thatOnothingintheseexemptionsisintendedtoprecludethepossiblereductionofnoiseconsis-tentwitheconomicfeasibility.
1.Noise originating from aircraft in flight,and sounds which originate at airports and aredirectlyrelatedtoflightoperations;
2.Noise created by safety and protective devices,such as relief valves where noisesuppressionwoulddefeatthesafetyreliefintentofthedevice;
3.Noise createdbyfirealarms,ornoisecreated byemergency equipment,including butnotlimitedtoemergencystandbyorback-up equipment,and emergency worknecessary intheinterestsoflawenforcementorofthehealth,safety,or welfareofthe community,andincluding,but notlimitedto,any emergency worknecessary toreplaceorrepair essentialutilityservices;
4.Noise created byauxiliary equipmenton motor vehicles used for highway maintenance;
5.Noise originating from officiallysanctioned parades,sporting events,and other publicevents;
6.Noise created by warning devices not operated continuously for more than30 minutesperincident;
7.Noisecreated bymotorvehicleswhen regulated by Section 8.28.030;
8.Noisecreated by natural phenomenonand unamplified human voices;
9.Noise created by motor vehicles,licensed or unlicenced when operated off publichighwaysexceptwhensuchsoundsarereceivedinresidentialzonesofthecity;
10.Noise created by existing stationary equipment used in the conveyance of water byutilitiesandnoisecreatedbyexistingelectricalsubstations;
11.Noise created bysources inindustrial districts which overthe previousthreeyears haveconsistentlyoperatedinexcessof15hoursperdayasademonstratedroutineorasaconsequenceofprocessnecessity.
B.The following sources of noise are exempt or partiallyexempt fromtheprovisions of thischapter:
1.Noise created bytheoperation of equipmentorfacilities ofsurface carriers engaged incommercebyrailroad;
2.Noise created byaîrcraft and float planes;
3.Noise emanating from the temporaryconstruction sites except between the hours of 10p.m.and 7 a.m.except as approved by the City Council;
4.Noisecreated by aircraft engine testingand maintenance not related toflightoperationsexceptbetweenthehoursof10p.m.and 7 a.m.;
5.Noise originatingfrom motor vehicleracingevents at existingauthorizedfacilities.
C.It is theintention of City Council to consider amendments to thischapter controlling thesourcesexemptedinsubsectionBofthissectionwhenevertheWashingtonStateDepart-ment of Ecology promulgates specificregulationsrelating tothespecificsources inthefuture.
