ANORDINANCEAMENDINGCHAPTER 18.35 OF THE MOSES LAKEMUNICIPALCODEENTITLED"MUNICIPALAIRPORT ZONE"
THE CITY COUNCIL OF THECITY OF MOSES LAKE,WASHINGTON DO ORDAINASFOLLOWS:
Section 1.Chapter 18.35 ofthe Moses Lake Municipal Codeentitled"MunicipalAirportZone"is amendedasfollow:
6 18.35.050 DevelopmentStandards:Nothingcontained herein shallrequire any change or alteration of alawfullyconstructedorestablishedstructureoruseinexistenceatthetimeofadoptionoramendmentoftheseregulations.These regulationsare intended to regulate theerection orestablishmentofanynewstructureoruse;themoving or relocation of anystructureoruse toanewlocation;the operation or continuance,at any time following the effective date of theseregulations,or any structure or use which has been lawfullyestablished,erected,remodeled,orrehabilitated;and the change from one use to another of any structure,or land,or the re-establishment of a use after its discontinuance for a period of one hundred and eight (180)consecutive days or more.
A.General
1.AIIuses shall be compatible withthecontinuedoperationoftheairport Nouses shallbeallowedwhich:
a.Release into theair any substances which would impair visibilityor othenWiseinterferewiththeoperationofaircraft.
b.Produce lightemissions,either director indirect (reflective),which would interferewithpilotvisionincludingthereductionofnightvisioncapabilityofpilotswhileontheground.
c.Produce emissionswhich wouldinterfere with aircraft communicationssystemsornavigationalequipment.
2.No temporaryor permanent development intended for human occupancy may beerected,moved toor occupied within theMoses Lake Municipal Airport Zone exceptthosefacilitiesnecessarytotemporarilyshelterindividualsrespondingtoanemergencyasidentifiedbytheCityofMosesLakeorothergovernmentalentityandthosenecessary4tohouseworkersonatemporarybasis.
3.No uses shall cause or produce objectionable effects whichwouldimpose a hazard ornuisancetoadjacentpropertiesbyreasonofsmoke,soot,dust,radiation,odor,noise,vibration,heat,glare,toxicfumes or other conditionsthat wouldadversely affect thepublichealth,safety,and general welfare.
4.No uses whichare labor intensive or whichpromote the concentrationof people forextendedperiodsoftimeshallbepermitted,except as expressly authorized in thissection.
5.No uses which require the manufacturing or warehousing of materials which areexplosive,flammable,toxic,corrosive,or otherwise exhibithazardous characteristicsshallbepermittedexceptforthestorageofaircraftfuel,oil,hydraulic fluid,paint,andmaterialsintendedforaerialapplicationforagriculturalpurposesprovidedthosematerialsarewarehoused,and loaded and unloadedaccording to thischapter.
6.The delivery,storage,loading,unloading,dispensing and clean-up of pesticides andfertilizersintendedforaerialapplicationforagriculturalpurposesshallbeaccomplishedaccordingtothetimetableandapplicableportionsofWashingtonStateDepartmentofAgricultureregulationsChapter16-229 and 16-201 dated March 1994 ofthe WashingtonAdministrativeCode.
7.No structure or any portion thereofon the premises of a permitted use shall be used foraresidentialdwellingbytheowner,operator,caretaker,theirfamily members or othersexceptthosefacilitiesnecessarytotemporarilyshelterofindividualsrespondingtoanemergencyasidentifiedbytheCityofMosesLakeorothergovemmentalentity.

ise originatingfromaircraft in flightand that is directly related toflightoperations shallbeexpectedtoimpactpeopleinsurroundingzonesandisgenerallyexemptfromnoisestandards.Noise from aviationtestingand maintenance,that is not related toimminentflight,shall be restricted tocertain hours,locations,or other effective conditionsby theCityCounciluponfindingthatthenoisecausesunreasonableimpacts.
2.Reserved for noise levels from other thanflight operations.
C.Lightina:
1.Structural lighting with the exception of airport navigational lighting shall not projectdirectlyintoanyresidentialzone.
2.Sign and buildingexterior lighting shall notproject directly into the runway,taxiway,or
airportapproachsurfaces totheextent thatitis a hazard or a distraction toaircraft.
3.Lighting of vehicle and aircraftparking areas shall not create a nuisance to adjacent
zones nor shall it pose a hazard toother vehiculartraffic.
4.Airport lighting used to illuminate runways,taxiways,airplaneparking areas and to
providevisualguidance for landing aircraftshall comply withthischapter.
D.Parking:A parking site plan must be submittedwithan application for a land use permit.It
must include a parking plan which shows the locationand number of parking spaces,circulationpattems,and ingress and egress provisions.
1.Allindustrial uses withintheMunicipal AirportZone shall provideat least two(2)parking
spaces for every three(3)employees on themajorshift during the normalseason.
2.Allcommercial uses shall comply with Chapter 18.54,Off-StreetParking and Loading.
3.AIIoff-streetparkingspaces shall have a minimum dimension ofnine feet (9')by twenty
feet (20')for each space and shall be subjecttothefollowing conditions:
a.Each shall have an allweather surface
b.Each shall be exclusiveof drivewaysand/or alleys
c.The design and location of entrances and exits tocommercial parking lotsshall
be consistentwithcommercial standards.
4.AIIoff-streetparkingfacilities forcommercial,publicinstitutional,and industrialuses shall
be located notmorethanthreehundred feet (300')fromthebuilding housing theuse.
5.Uses which are expanded or enlarged shall providethe additionaloff-streetparking
spaces in accordance with this chapter and Chapter 18.54,Off-Street Parking and
Loading.
6.Each parkingarea whichis 4,500 square feet or more in size willbe required toprovide
a planof facilitiesto handlesurface runoff.Such a planof facilitiesshall be consistent
withcommercialstandards.
7.AIIoff-streetparkingareas whichare lighted shall be illuminated in such a way as not to
create a nuisanceor hazard to passing trafficor cast light on any residential property.
8.AIIoff-street parking shallbe hard surfaced and maintainedifit has an area inexcess of
1,200 square feet Such surfacing shallbe of such a naturethatiteliminates dust and
mud.
E.Loadinq Area Reguirements:Those uses whichhave a need for or intend to make use of
loading and unloadingberths shallcomplywith thefollowingconditions:
1 Each berth shallbe at least ten feet (10')wide bytwenty-fivefeet (25')long byfourteen
feet (14')high.
2.Each berth or berths shall be surfaced and maintainedso as toeliminate dust and mud.
3.No part of a loading or unloadingberth mayextend into a public right-of-way.
F.Landscaping:A landscapingsite planmustbe submittedwith an applicationfor a land use
permit Itmustincludethelocation and typeof plant materials,
1.AIIlandscaping shall occur at the timethe subject property is developed.
2.Boulevard landscaping shall be used alongmain access roadways.Landscaping shall
be uniformalong the length of the perimeterroads and shall consistofgroundcover,
shrubs,smalltrees,nativegrasses,and/or gravel.
3.Buffer landscaping may be required on perimeter property lines of individual develop-
ments to minimizenoiseandvisualimpacts and todiscourage trespass.Bufferlandscap-
ing shallconsist of ground cover,shrubs,and smalltrees.
G.Height Restrictions:The height restrictions contained in thissectionare in accordance with
Federal AirRegulations Part 77 "ObjectsAffecting Navigable Airspace"andFederal Aviation
Administration Advisory Circular 150/5300-13 "Airport Design".
1.Nostructure or objectexcept those whose placement is required for airportoperations
may be located within theMoses Lake MunicipalAirport ObjectFree Area defined as a
rectanglewhose boundaries are threehundred feet (300')from the ends ofthe prepared
runwaysurface and one hundred twenty-fivefeet (125')on both sides of thecenterline
ofthe runway.

2.No structure or objectmay be located so as to break theplane ofa seven (7)to one (1)slopethatbegins atand extends outward at right angles from theedge ofthe ObjectFreeArea.
3,No structure orobject may be located closer thanforty-five feet (45')from thecenter ofanyfuturetaxiwayasdefinedintheAirportDevelopmentPlan,
4.No structure or object maybe located so as to penetrate the twenty(20)to one (1)approach departure surface extendingfromtheedges ofthe ObjectFree Area at bothendsoftherunway.
H.Setbacks:Setbacks shall be a minimum of:
1.Front setback -fifteen feet (15')
2.Side setback -fifteen feet (15')
3.Rear setback -none
I.OtherRegulations
1.A business license must be secured fromthe City of Moses Lake for all businessactivitiesconductedonairportproperty.
2.Anyindividual,builder,or developer must submitand have approved by the PlanningCommissionabuildingsiteplanpriortocommencingconstruction.
3.Any individual,builder,or developer mustsubmitand have a recommendationfrom theAirportCommissiontothePlanningCommissionpriortositeplanreview.
Section 2.Thisordinanceshall take effectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
