ANORDINANCE AMENDINGCHAPTER 18.16 OF THE MOSES LAKEMUNICIPALCODEENTITLED"R-1,SINGLE FAMILYRESIDENTIALZONE"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter18.16 ofthe Moses Lake Municipal Code entitled "R-1,Single Family Residential Zone"is amended as follows:
18.16.180 Fences,Walls,and Hedges:O A.Fences,walls,and hedges shall not exceed four feet (4')above finished ground level inanyfrontyardnorexceedeightfeet(8')on any interior side or rear yard or corner lot exteriorsideyard.
B.Electric fences and barbed wire fences shallbe prohibited.
C.An installation permit shallbe required for theconstruction,erection,or installationofa fence,wall,or screening plantings.Allpermit applications shall be reviewed and approved bytheBuildingOfficialandtheCityEngineerforvehicularandpedestriansafety.Fences and wallsexceedingsixfeet(6')in height are regulated by the Uniform Building Code and require abuildingpermit.
D.Subdivision Fencing:
1.Subdivisionfencing,walls,or screening plantings may be allowedas a conditionalusesubjecttothereviewandapprovalofthePlanningCommission.
2.A subdivision may be enclosed partially or entirely with a permanently maintainedouterperimeterfence,wall,or screening plantings or combination thereofnot to exceed eightfeet(8')inheight and taperingtonohigher thanfour feet (4')at street intersections and/orsubdivisionentrances.
3.AIIapplications forsubdivisionfencing,walls,orscreening plantings shall be reviewed bytheBuildingOfficialandtheCityEngineerforvehicularandpedestriansafety.TheBuildingOfficialandtheCityEngineershallrecommendtothePlanningCommissionthattheapplicationbeapproved,conditionallyapproved,ordenied.
Section 2.The City councildeclares that an emergency exists and thisordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 oftheentire City Council present vote in favor ofpassage.
