ANORDINANCE AMENDINGCHAPTER 18.19 OF THE MOSES LAKEMUNICIPALCODEENTITLED"R-2,SINGLE FAMILYAND TWO FAMILYRESIDENTIALZONE"
THE CITYCOUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 18.19 ofthe Moses Lake Municipal Codeentitled "R-2,Single Family and Two FamilyResidentialZone"is amended as follows:
18.19 180 Fences.Walls,and Hedges:O A.Fences,walls,and hedges shallnot exceed four feet (4')above finished ground level in anyfrontyardnorexceedeightfeet(8')on any interior side or rear yard or cornerlotexteriorsideyard.
B.Electric fences and barbed wire fences shall be prohibited.
C.An installation permit shallbe requiredforthe construction,erection,orinstallation ofa fence,wall,or screening plantings.AIIpermit applicationsshall be reviewed and approved by theBuildingOfficialandtheCityEngineerforvehicularandpedestriansafety.Fences and wallsexceedingsixfeet(6')in height are regulated by the Uniform Building Code and require abuildingpermit.
D.Subdivision Fencing:
1.Subdivision fencing,walls,or screening plantings may be allowed as a conditional usesubjecttothereviewandapprovalofthePlanningCommission.
2.A subdivision may be enclosed partially orentirelywith a permanently maintainedouterperimeterfence,wall,or screening plantings or combination thereofnotto exceed eightfeet(8')in height and taperingtono higher than four feet (4')at street intersections and/orsubdivisionentrances.
3.Allapplications forsubdivisionfencing,walls,or screening plantings shallbe reviewedbytheBuildingOfficialandtheCityEngineerforvehicularandpedestriansafety.TheBuildingOfficialandtheCityEngineershallrecommendtothePlanningCommissionthattheapplicationbeapproved,conditionallyapproved,ordenied.
Section 2.The City council declares that an emergency exists and thisordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of the entire City Council present vote in favor ofpassage.
