1863_00001ORDINANCE NO.1863 ANORDINANCEAMENDINGCHAPTER 18.22 OF THE MOSES LAKEMUNICIPALCODEENTITLED"R-3,MULTI-FAMILYRESIDENTIALZONE" THI¯CITYCOUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 18.22 oftheMoses Lake Municipal Code entitled"R-3,Multi-FamilyResidential Zone"is amended as follows: 18.22.200 Fences.Walls,and Hedges:O A.Fences,walls,and hedges shall not exceed four feet (4')above finished ground level in anyfrontyardnorexceedeightfeet(8')on any interior side orrear yard or corner lot exterior sideyard. B.Electric fences and barbed wire fences shall be prohibited. C.An installation permitshallbe requiredfor the construction,erection,or installation ofa fence,wall,or screening plantings.AIIpermit applications shall be reviewed and approved by theBuildingOfficialandtheCityEngineerforvehicularandpedestriansafety.Fences and wallsexceedingsixfeet(6')in height are regulated by the Uniform Building Code and require abuildingpermit D.SubdivisionFencing: 1.Subdivision fencing,walls,or screening plantings may be allowed as a conditional usesubjecttothereviewandapprovalofthePlanningCommission. 2.A subdivisionmay be enclosed partially or entirelywith a permanently maintained outerperimeterfence,wall,or screening plantings or combination thereofnot toexceed eightfeet(8')inheight and taperingto no higher thanfour feet (4')at street intersections and/orsubdivisionentrances. 3.Allapplicationsforsubdivisionfencing,walls,orscreening plantingsshall be reviewed bytheBuildingOfficialandtheCityEngineerforvehicularandpedestriansafety.TheBuildingOfficialandtheCityEngineershallrecommendtothePlanningCommissionthattheapplicationbeapproved,conditionally approved,ordenied.O Section 2.The City council declares that an emergency exists and thisordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of the entire City Council present vote in favor ofdospede by theCityCounciland signed byits Mayor on IVFayor I nance Director APP VED AS TO FOR GityAttorne PUBLISH:7/16/99 O
