ANORDINANCEAMENDINGCHAPTER 13.12 OF THE MOSES LAKEMUNICIPALCODEENTITLED"WATERAND SEWER RATES"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTON DO ORDAINASFOLLOWS:
Section 1.Chapter 13.12 oftheMosesLake Municipal Code entitled"Water and Sewer Rates"is amendedasfollows:
O 13.12.047 Deposit -Skyline Water System:The owners of the SkylineWater System willbe required todepositwiththecitythesumoftwenty-threethousand dollars($23,000)before a connectionisallowedfromtheCityofMosesLake's watersystem to theSkylineWater System.The twenty-three thousanddollars ($23,000)represents an estimated charge for twomonths of waterchargestotheSkylineWaterSystemofeightthousanddollars($8,000)and an estimated chargeoffifteenthousanddollars($15,000)for theQuincyBasin Subarea permit issued by the UnitedStatesBureauofReclamation.The fifteen thousanddollar ($15,000)permitportionof thedepositcanbereducediftheU.S.Bureau of Reclamation reduces or eliminatesthefee.ThedepositwillaccrueinterestataratecomparabletothatreceivedbytheCityofMosesLakeonitsdeposits.
The annual permit charge for the QuincyBasin Subarea will be deducted from the fifteenthousanddollars($15,000).Any funds rernaining after thethirdyear permit payment will beaddedtotheeightthousanddollar($8,000)security portionofthedeposit.
The eightthousanddollar ($8,000)security portion ofthedeposit and anyaccrued interest alongwithanyremainderofthefifteenthousanddollar($15,000)permit portion of the deposit willpartiallysecurethepaymentoftheutilityorwaterchargeowingtotheCityofMosesLake.Thecitycandeductfromthedepositanysumsoutstandingforutilityorwaterservicewhicharepastdueandapplytheappropriateamountfromthedeposit.When thedeposit falls below theeightthousanddollar($8,000)amount thecity willmake demand of theSkyline Water System for anamountsufficienttobringthedeposittoeightthousanddollars($8,000).SkylineWater Systemwillberequiredtopovidethedemandedfundswithinthirty(30)days ofthe request,Ifthedemandedfundsarenotprovided,thecityshallhave theauthoritytoterminatetheWater serviceuponanadditionalthirty(30)days notice totheSkyline Water System.
Alldeposits and accruedinterest remaining afterwaterservice isterminatedtotheSkyline WaterSystem,shall be retumed to Skyline Water System ortheparty whichhas providedthedeposit
on behalfoftheSkyline Water System.
Section 2.This ordinance shall takeeffect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
