1873_00001ORDINANCE NO.1873 ANORDINANCE AMENDINGCHAPTER 18.56 OF THE MOSES LAKEMUNICIPALCODEENTITLED"SIGNS AND BILLBOARDS" THE CITYCOUNCIL OF THECITYOF MOSES LAKE,WASHINGTON DOORDAINAS FOLLOWS: Section 1.Chapter 18.56 oftheMoses Lake Municipal Code entitled"Signsand Billboards"is amended asfollows: 18.56.015 Definitions:The followingdefinitions shall apply for thepurpose of thiscode: A."Abandoned sign"means a signthatno longer correctlyidentifies,exhorts,or advertisesanyperson,business,lessor,owner,product,oractivityconductedoravailableon thepremiseswheresuchsignislocated. B."Awning Sign"means a sign painted or printed on an awning. C."Billboard"means an outdooradvertising sign or poster panel which advertises products,businesses,and/or services notconnected with thesite on which thesign is located,andwhichsignisasubstantialpermanentstructurewithdisplayservicesofatypewhicharecustomarilyleasedforcommercialpurposes. D."Building"means a roofedand walledstructure builtfor permanentuse. E."Change"means therelocationof a sign or the replacement of fiftypercent (50%)or moreofthestructuralmaterialinthesignarea.Normal maintenance and a change of name arenotchangeswhichrequireapermit. F."Changeable Copy Sign"means a sign on which the copy changes automatically on alampbank,throughmechanical means,oron which copy is changed manuallyinthefieldwithchangeableletters. G."Development Site"means an undivided parcel ofland or twoor more contiguous parcels oflandundercommonownershiporcontrol.For purposes ofthischapter,theterm"contigu-ous"means parcels of land thathave substantialcommon boundaries withoutinterveningpublicright-of-way. H."Districts"sign overlay (seemapon filein thePlanning Division): 1)Area 1 2)Area 2 3)Area 3 I."Double-faced sign"means a sign that has advertising copyon opposite sides of a singledisplaysulfaceorsignstructure. J."Electrical sign"means a sign or signstructureinwhichelectricalwiring,connections and/orfixturesareusedaspartofthesign. K."Facade"means theentirebuilding front or street wallface of a buildingextendingfrom thegradeofthebuildingtotheparapetoreavesandtheentirewidthofthebuildingelevation L."Flashing Sign"means asign orsignstructure orportion thereofwhich changes lightintensityorswitchesonandoffinaconstantpattern.Changing message centers shall not beconsideredflashingsigns. M."Free StandingSign"means a signattached tothe groundby a signstructureand supportedbyuprightsplacedonorintheground. N."Freeway Interchange Area"means thefreewayinterchange area ofInterstate 90 (1-90) O."GroundSign"means a sign oflimited height constructedand affixedon a foundation uponorintheground. P."Incidental Sign"means a smallnon-electricinformation sign sixteen (16)square feet orless O in area,including both sides ofsign,which pertainstogoods,products,services,orfacilitieswhichareavailableonthepropertywherethesignoccursandisintendedprimarilyfortheconvenienceofthepublicwhileonthepremises.The sign shall not exceed four feet (4')inheightandtwofeet(2')in widthat the base. Q."Institutional Sign"means a sign toidentify educational,civic,and religiousinstitutions. R."Landscaping"means theplanned use oftrees,shrubs,and otherplantmaterials inconjunc-tionwitha sign and other decorative features. S."Marquee"means a permanent structureattached to,supported by and projecting fromabuildingandprovidingprotectionfromtheweatherelements,but does not include aprojectingroof.For the purpose of this ordinance,a free standing permanent roof-like structure providing protection from the elements willalso be considered a marquee.This also includes canopies. T."Neighborhood Identification Sign"means a signfortheidentification ofa particularresiden-tialarea or development U."Neon Sign"means a symbol,logo,or message comprisedofilluminated neontubingusedtoattractattentionforadvertisingpurposes.Neonsigns shallnotflash,oscillate,or revolve. V."Off-Premise Directional Sign"meansa permanently installed signwhichprovides directional information toa business service located inthe Moses Lake area and is notlocated on thesamepropertyasthebusiness. W "Off-Premise Sign"means a sign or sign structures advertising an establishment,merchan-dise,service,orentertainmentwhichisnot sold,produced,manufactured,orfumished atthe property on which thesign is located. X."On-Premise Directional Sign"means a permanent signthat directs thepublic toa specificplacesuchasanentrance,exit,orparkingor service area. Y."On-Premise Sign"means a signidentifyinga business or products sold on a lot,parcel,tract, or plot ofland togetherwiththebuildings and structures located thereon. Z."Portable Sign"means a sign made of any material,which by its design is readilymovableandisnotpermanentlyaffixedtotheground,structures,or buildings. AA."Projecting Sign"meansa signwhichis attached toand projects more thanone foot (1')from a structure,building face,or marquee. BB."Readerboard"means a sign face consisting of tracksholding readilychangeable lettersallowingfrequentchanges. CC."Revolving Sign"means a sign which rotates or turnsina circularpattern. DD."Roof Sign"means a sign supported by and erected on and above a roof or parapet of abuildingorstructure. EE."ShoppingCenter"means a development site containing four or more commercialbusi- nesses in one buildingtotalinga minimum of 50,000 square feet of gross floor area.A shoppingcenter is characterizedby a planned,unified site and marketing design under onemanagementcontrol. FF.'Shopping Center Identification/Directory Sign"means a free-standing signthatis located within a shopping center,intended tobe seen from public right-of-way,includes thename of the shopping center and may includean integrated directory of one or more of the busi- nesses thatare located withintheshopping center. GG."Sign"means anyvisualcommunicationdevice,structure,or fixture whichis visible from anyright-of-wayand is intended to aid the establishment in question in promoting the sale ofproducts,goods,services,events or to identifya building,usinggraphics,letters,figures, symbols,or trademarks.Painted walldesigns orpattems whichdo notrepresent a product,service or registered trademark,or whichdo not identify the user,shall not be considered signs.Ifa design or pattern is combined with a sign,onlythat part of the design or pattern which cannot be distinguished from the sign will be considered as part of thesign. HH."Temporary sign"means any sign or advertisingdisplay constructed ofcloth,canvas,light fabric,paper,cardboard,or other light materials,with or without frames,intended to be displayed for a limited timeonlyand not permanently attached toa buildingor site. II."Wallsign"means a sign attached orerected parallel toand extending not more thanonefoot(1)from the facade or face of any building to which it is attached and supportedthroughoutitsentirelength,withtheexposed face ofthesign paralleltothe plane ofsaidwall or facade. 18.56.080 On-Premises Signs:On-premises signsshallbe permitted inthecommercial and industrial zonesofthecityincompliancewiththeprovisionsofthischapter. A.A special sign overlay districtis adopted and portrayed on a map on filein the Planning Division of the Municipal Services Department The standards of this chapter shall be appliedas defined in thespecificoverlayareas. B.Sign Size:Businesses with frontages ofless thanthirty-twofeet (32')mayconstruct a sign withan area nottoexceed thirty-two(32)square feet.Onlyone(1)face ofa doubleface sign willbe considered in computingits sign face size.The totalarea of signs shall notexceed thefollowing ratios: 1.Area 1:One square foot (i')ofarea foreach lineal foot ofdeveloped business frontagealongthestreetorsidetowhichthesignisdirected,with a totalarea not toexceed onehundredfiftysquarefeet(150'). 2.Area 2:One and a half square feet (1.5')of area foreach lineal foot of developedbusinessfrontagealongthestreetorsidetowhichthesignisdirected,with a totalareanottoexceedonehundredfiftysquarefeet(150'). 3.Area 3:Two square feet (2')ofarea for each lineal footof developed business frontagealongthestreetorsidetowhichthesignisdirected,with a totalarea not toexceed fivehundredsquarefeet(500'). C.SignHeight:Roofmounted signs projectingupwardand notbeyond thewallofthestructureshallnotprojectmorethantenfeet(10')above thebuildingcontainingthebusiness whichthesignidentitiesandshallnotexceedtheheightstandardsofthezoneinwhichthebuildingislocated.Free standingsigns shall not exceed an overallheight oftwenty-fivefeet (25')except as maybe permittedbythischapter.Signs projecting outwardbeyondthewall of abuildingshallnotexceedtheheightofthesurfacetowhichthesignismountedoranoverallheightoftwenty-fivefeet (25'),whicheveris less. D.Signs Exceeding Permitted Sizeand Height:On-premises signsmay bepermittedtoexceedtheheightand/orsign face size standards ofthischaptersubjecttothereviewand approvalofthePlanningCommissionafterithasbeenshownthatthesignwouldnotadverselyaffectadjacentusesandtheextraheightorsignfacesizeisessentialforthesigntobevisible. E.Signs Projecting Over City Right-of-Way:Signs projecting outward beyond the wall of abuildingtowhichtheyaremountedshallnotprojectoutovercityright-of-wayexcept in theC-1 Zone,Central Business District,and on existing buildings in the C-2 Zone,GeneralCommercialandBusiness,thathave no front yard set back from cityright-of-way.Signsprojectingoutwardbeyondthewallofthebuildingtowhichtheyareattachedmayprojectoutoverthepublicsidewalknotmorethaneightypercent(80%)of the distance between thepropertylineandthecurbline.AIIsigns projectingovercityright-of-wayshall be a minimumofeightandonehalffeet(8½')from finished grade level except for signs attached to theundersideofacanopyorotherarchitecturalprojectionwhichmaybeaminimumofsevenandonehalffeet(7½')from finished grade level. F.Freeway/Freeway Interchange Signs:Freeway/freeway interchange signs shall be definedasasigndesignedandplacedtoattracttheattentionoffreewaytraffictravelingonI-90 oroftrafficenteringorexiting1-90at a freewayinterchange.On-premises freeway/freewayinterchangesignsareallowedinthecommercialandindustrialzoneswithinonethousandOfeet(1,000')of a freeway interchange or within twohundredfiftyfeet (250')of a freewayright-of-way.On-premisesfreewaylfreewayinterchangesignsshallnotexceed forty-fivefeet(45')inheightora signface size,oneface,offivehundred(500)square feet,except thatthePlanningCommissionmaypermitfreewaylfreewayinterchangesignsexceedingforty-fivefeet(45')in height and/or a signface size,one face,exceeding fivehundred (500)squarefeetuponafindingthattheextraheightandsignfaceareaisessentialtothesignbeingseenbyfreewayorfreewayinterchangetrafficandthatthesignwouldnotadverselyaffectadjacentornearuses.On-premises freewaylfreeway interchange signs shall be in com-pliance withall local,federal,and state regulationsfor such signs.A copyoftheWashingtonStateDepartmentofTransportationSignPermitorcertificationfromtheWSDOTconfirmingthatanyproposedfreewaylfreewayinterchangesignisincompliancewithallstateregula-tionsshall be required toaccompany an applicationfor a citysignpermit and/or an applica-tionfora conditional use permit for a freeway/freeway interchange sign. G.Shopping Center Identification/Directory Sign:Each shoppingcenter is limitedto one free-standing sign which shall be a shopping center identification/directory sign that shall belocatedinalandscapedarea.The totalsign area for a shopping center identifica-tion/directorysignshall not exceed a totalof one hundred fifty(150)square feet Section 2.This ordinanceshall take effectand be in force five (5)days afterits passage and publication Ad ptsummary as provided bylla gned by its Mayor on cto r 2,1999 ATTEST:Mayor IWance Director APPROVED AS TO FOR : Attorne PUBLISHED:10/15/99
