AN ORDINANCE AMENDINGCHAPTER 5,04 OF THE MOSES LAKEMUNICIPALCODEENTITLED"LICENSINGREGULATIONS"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 5.04 oftheMoses Lake Municipal Code entitled "Licensing Regulations"is amendedasfollows:
5.04.030 License -Contents:Alllicensesprovided forinthischaptershallbe issued bythe FinanceDirectorOuponpayingtotheFinanceDirectortheproperlicensefeeasprovidedinthischapter.AIIlicensesshallbearthenameofthelicensee,and shall designate the nature of thebusiness,trade,orprofessionoperatedbythelicensee;and shallalso designate the location where thebusiness,trade,or profession is carried on,the date ofexpirationofthelicense,thedate of theissuance ofthelicense,and theamount paid for the license.Each licensee shall conspicuously post suchlicenseinhisplaceofbusinessoroffice,and shall produce such license for inspection ifrequiredtodosobyanyauthorizedcityofficial.
5.04.040 Application For New Business:If the licensee is a new business,priorto the issuance of thebusinesslicense,theFinance Director shallsubmit the applicationthereforto the Fire ChiefandtheBuildingInspectorofthecityforapprovalofthelocationwherethelicenseeistocarryonthebusiness,tradeor profession,and thebusiness license shall be issued only if the location is incompliancewithbuildingandfirecodesofthecityasthosecodesrelatetoexistingand/or newstructures.
5.04.050 Location Change:Ifan existinglicensee desires tochange the location ofthebusiness,trade,orprofessionfromthelocationdesignatedonthebusinesslicense,applicationmust be made totheFinanceDirectorpriortothechangeinlocationandtheFinanceDirectorshall,priorto theissuanceofanewbusinesslicense,submit the applicationthereforto the Fire Chief and theBuildingInspectorofthecityforapprovalofthenewlocationwherethelicenseeistocarryonthebusiness,trade,or profession,and thebusiness licenseshall be issued onlyifthelocation is incompliancewithbuildingandfirecodesofthecityasthosecodesrelatetoexistingand/or newstructures.There shall be no additionalbusiness license fee assessed an existing businesschangingitslocation,and the newbusiness license issued shallcarry the same expirationdate.
5.04.070 TemporaryLicenses:
A.Licensesissued forthefollowing businesses by the Finance Director shall be temporaryand0apermanentlicenseshallnotbeissuedbytheFinanceDirectoruntilthebusinesshasbeenapprovedbytheGrantCountyHealthDepartment,whichapproval must be obtained withinthirty(30)days after the issuance ofsaid temporarylicenses:
1.Bakeries;
2.Cafes and restaurants;3.Confectioneries;4.Grocery stores;6.Meatmarkets;6.Produce stores (wholesaleand retail)7.Soda fountains;
8.Taverns;
9.Auto courts;10.Cabin courts;11.Hotels;
12.Trailer courts.
B.Ifat any timeany of the businesses licensed inthissectiondo not meet withthe approvaloftheGrantCountyHealthDepartment,the license shall be revokedand shall not be reissueduntilsuchbusinessagainmeetswiththeapprovaloftheGrantCountyHealthDepartment.
5.04.080 Fee Schedule:The business license fee schedule is fixed intheamount of eightydollars ($80)per year,payable in advance,for each business,tradeor profession,conducted or carried onwithinthecorporatelimitsofthecity;provided,thattaxexempt nonprofitcompanies,associations,corporations,orcopartnershipsofwhatever kind as defined by thefederal or state government,shall notbe required to pay thebusiness license fee,but,nevertheless,shallobtaina businesslicense,without fee,if conductinga business in order to raise funds from members outside theOorganization,Fortheinitialbusiness license fee theeightydollars ($80)shallbe prorated overfour(4)quarters,eighty dollars (580)payable between January 1 and March 31,sixty dollars($60)payable between April1 and June 30,forty dollars ($40)payable between July 1 and September31,and twentydollars ($20)payablebetween October 1and December 31.The business licensefortaxexemptnonprofitcompanies,associations,corporations,orcopartnershipsofwhateverkind
as referred to herein shallbe obtained once and shallbe effectivefor the lifetimeofthe organiza-tion.This exemptionis anadditiontothat providedinSection5.04.090.Nobusiness,professionortradeconductedorcarriedoninasinglelocationunderonemanagementorownershipshallpaymorethanonelicensefeeregardlessofthemultiplenatureofthebusinesscarriedon;Provided further thatno taxexemptnonprofitcompany,association,corporation,orcopartnershipofwhateverkindasdefinedbythefederalorstategovernmentswhichoperatesorconductsacommunityfestivaloreventofnomorethanfourdaysindurationshallberequiredtoobtainabusinesslicenseashereinpreviouslyprovidedandtheexemptionwhichhasbeenprovidedshall
extend to the festival's or event's participants operatingunder sanction of said festival or eventAnybusiness,professionor trade in more thanone location withinthecityshall pay a license fee
for each location where thebusiness,profession,or trade is conducted.
5.04.090 CertainBusinesses Exemot:Recognizing thatthere are locallyowned and operated smallor part-timebusinesses which would be undulypenalized byrequiring licensing under thischapter andthepaymentofthebusinesslicensefeeasprovidedinSection5.04.080,there is exempted fromthisbusinesslicensingchapterthoselocallyownedandoperatedbusinesses,professions,ortradeswhereintheannualgrossincomeislessthantwothousanddollars($2,000)peryear.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effect
immediately as providedby law upon one reading if2/3 of the entire City Council present vote in favor of
passage.
