ANORDINANCE AMENDINGCHAPTER 5.16 OF THE MOSES LAKEMUNICIPALCODEENTITLED"CIRCUSES AND CARNIVALS"
THE CITY COUNCILOF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 5.16 oftheMoses Lake Municipal Code entitled"Circuses and Carnivals"is amended
as follows:
5.16.030 Fee Schedule:The proprietor or manager of every show,carnival,or place of amusement,nototherwiseprovidedfor,shall paya license fee as follows:
A.Carnival:First day,one hundred fiftydollars ($150);Second day,seventy dollars ($70);Third,and any days thereafter,forty-five dollars ($45)per day
B.Circus:First day,one hundred fiftydollars ($150);Second,and any days thereafter,seventy dollars ($70);
C.Road Show:First day,sixtydollars ($60);Second,and any days thereafter,thirtydollars ($30)
5.16.040 Application for License:Before any person operates any amusement licensed under theprovisionsofthischapter,he shallapplyinwriting tothe Finance Director for a license thereforeandpaythelicensefeeprovidedinSection5.16.030.The application shallspecifythe following:
A.The name of the person,firm,or corporation which will use the structure;
B.The location ortheprincipal place of business of such person,firm,or corporation;
C.The names and addresses oftheofficersofsuch firm or corporation;
D.The length oftimethelicense is intended tobe used for thepurpose applied for;
E.Nature of activity tobe conducted;
F.Such other relative information as theFinance Director may require.
5.16.050 Deposit of Bond:
A,An applicantfor a carnivalor circus shall furnish evidence that a publicliabilityinsurancepolicyintheamountspecifiedbytheFinanceDirectorisineffectbeforethepremisesareoccupiedasaplaceofpublicassemblage.
B.The applicant shall depositwiththeCityTreasurer a cash bondin thesum of five hundreddollars($500)conditioneduponsavingharmless thecityfrom anyand allliabilitiesorcausesofactionwhichmightarisebyvirtueofthegrantingofalicensetotheapplicant,and condi-tionedfurther thatno damage willbe done tothe street,sewers,trees,oradjoining property,and thatno dirt,paper,litter,or otherdebris willbe permitted toremain upon thestreet,oruponprivateproperty,by such applicant Such cash bond shall be returned tothe applicantuponcertificationbythePoliceChiefthatallconditionsofthischapterhavebeenfullycompliedwith.
C.The applicant shall pay tothe Finance Director all license fees whichmaybe required bytheordinancesofthecity,including the admission tax.
D.If the Fire Chief determines thatthe attendance of fire equipmentat the location of thestructureduringtheuseofsuchstructureasaplaceofassemblageisnecessaryforthesafetyofpersonsandproperty,the Finance Director shall require thattheapplicantdepositwiththeCityTreasurerasumequaltothereasonablevalueoftheuseoftheequipmentandthefurnishingofthenecessarypersonnelforsuchtimeaswillberequired,in order toreimbursethecityforsuchexpense.
5.16.060 Inspection by Fire Chief BeforeErection of Structure:The application shall be submitted to theFireChiefpriortothedateoftheopeningofanystructure,and he shall be notified at least forty-eight (48)hours prior totheerectionofsuch structure,so that he,or his authorizeddeputy,maymakeaninspectionduringreasonabledaylighthours.
The Fire Chief shall determine iftheapplicant has made provision for thefollowing:
A.Adequate aisles,seats,platforms and poles;
B.Sufficientexits,wellmarked and properlylighted;
C.Lighted and unobstructed passageways to areas leading away from the structure;
D.Removal,before thestructure is tobe used as a place of public assembly,orany pole,rope,or other obstructionin any aisle or exit;
E.Sufficientfirst-aidfireappliancesto be distributed throughoutthestructure with operatingpersonnelfamiliarwiththeoperationofsuchequipmentavailableandassignedduringthe
use of such structure as a placeofassembly;
F.An employeeat each entranceto require the extinguishing of allcigarettes,cigars,and othersmokingmaterials;
G.Proper safeguardingofany use of open flames or its use prohibited;
H.The clearing ofstraw,dry grass,sawdustand anycombustibletrash from thestructurebeforeitisopenedtothepublicandarrangementsmadetokeeptheareaswheredebrismaybeexpectedtoaccumulatewellserviced,especiallyunder open seats;
I.Proper facilities for callingthe cityFire Department;
J.Such special fire equipment of thecity toattend at such structure during its use as a placeofpublicassemblageastheFireChiefmaydecideisnecessaryforproperfireprotection;
K.The tent and canvas parts of thestructuread all combustible decorative materials,including
curtains,acousticmaterials,streamers,cloth,cottonbatting,straw,vines,leaves,trees,and
moss to be rendered fireproof.
5.16.070 Inspection After Erection of Structure:
A.Upon completion of such structure,itshall not be used as a place ofassembly untiltheFireChiefhasinspectedtheentirepremisesuponwhichthestructureislocated.
B.Ifthe Fire Chieffindsthatall of thelimitations and requirementsofthechapter have been
compliedwith,the Finance Director shall grant a permit to occupysuch premises.
C.Itis unlawfulfor any person to cause or permit theoccupancyofsuch structureas a placeofassembly,withoutthe issuance ofsuch licenseto occupy such structure as provided inthischapter.
D.Ifthe Fire Chief finds thatsuch structure,or the premises on which it is located,is being
maintained in violation of any ofthe provisions ofthe license toerect or maintain any of theprovisionsofthischapter,or.insuch a manneras to constitute a fire hazard,he may revokethelicensetooccupyprovidedforinthischapter.
E.Any person,firm,or corporation whose license to occupy has been revoked may appeal totheCityCouncilforahearingthereon,and thedecision oftheCouncilinthis regard shallbefinal.Ifno appeal is takenwithinten(10)days,theactionofthe Fire Chiefshall be final.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effect
immediately as provided by law upon one reading if2/3 of theentire CityCouncilpresent vote in favor of
passage.
