ANORDINANCE AMENDINGCHAPTER 6.05 OF THE MOSESLAKEMUNICIPALCODEENTlTLED"ANIMALCONTROL"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter6.05 oftheMoses Lake MunicipalCode entitled"AnimalControl"isamended asfollows:
6.05.040 License Fee and Taq:The license fee shall be in the sum of five dollars ($5)per year forneuteredmaledogsandspayedfemaledogs,and thirtydollars ($30)per year for non-neuteredOmaleandunspayedfemaledogs.Upon thepaymentofsuch license fee totheFinance Directororhisdesignee,and uponbeingshown proof ofa current rabiesvaccination,itshallbe thedutyoftheFinanceDirectororhisdesigneetoissuealicensetothepartymakingapplicationtherefor.
A.The license shallexpireonthefirstday ofJanuary next succeeding thedate oftheissuancethereofandthetimefixedfortheissuingofalicenseshallcommenceonthefirstdayofJanuaryofeachyearandnolicenseshallbeissuedtoexpireatanyothertimethanthatdate.The license fee shall be paid in fullfor any year or part thereof.
B.The Finance Director or his designee shall,togetherwith thelicense,furnish a suitable tagwhichshallbewornbythedogforwhichsuchlicenseisissuedandshallbefastenedtosuchdoginsuchmannerthatitcaneasilybeinspectedatalltimesbycityauthorities,LosttagswillbereplacedbytheFinanceDirectororhisdesigneeuponapaymentofanadditionalfeeoftwoandonehalfdollars($2.50).
C.Allpersons must present a current rabies vaccinationreceiptbefore a city dog license canbeobtained.
D.Pursuant to RCW Chapter 16.08,thecity is required to regulate and issue certificates ofregistrationfordangerousdogs.Such certificateshall be issued on an annualbasis with noprorationofthefeeprovidedforhereinforlessthanafullyear's registration of a dangerousdog.The annual license period shallextendfrom January 1throughDecember 31 ofeachcalendaryear.It shall be the duty of each owner to obtaina current registrationfor adangerousdogpriortoJanuary1ofeachlicensingperiodorthecostofregistrationshallbedoubled.The annual fee for registration of a dangerous dog shall be thee hundreddollars($300).
6.05.050 Kennel License Reauired:No person,groupofpersons,or business entity shall own,keep,orharbormorethanthreedogsorfourcatsoranycombinationthereofofmorethanfouranimals,O ofsixmonths ofage orolderor engage inthecommercialbusiness of breeding,buying,selling,trading,trainingor boarding cats ordogs orboth cats anddogs without having obtained a kennellicensefromtheFinanceDirectororhisdesignee.
A.The kennel license shall expireon thefirst dayofJanuary next succeeding the date oftheissuancethereof.The timefixed for the issuing ofa license shallcommence onthefirst dayofJanuaryofeachyearandnolicenseshallbeissuedtoexpireatanyothertimethanthatdate.The license fee shall be paid in fullfor any year or partthereof.
B.The yearlyfee forlicensing a kennel shall be fiftydollars whichshallbe theonly businesslicensefeethecityrequiresofkennelowners.
C.This section shall not apply to and will not be construed to require a kennel license for alicensedveterinariantooperateananimalclinicorhospital,
D.This section shallnotapplytoand willnot be construed to requirea kennel licensefor anypetshopwhichsellsanimalsoflessthansixmonthsofage.
E.Kennel licenses shallnot be issued for use in areas zoned R-1 and R-2.
6.05.175 License and Permit Issuance and Revocation:
A.The City of Moses Lake may revoke any animalpermitor license iftheperson holding thepermitorlicenserefusesorfailstocomplywiththischapter,theregulations promulgated bytheCityofMosesLake,or any lawgoverning theprotection and keepingof animals.
B.Any person whose animal permitor license is revoked shall,within ten(10)days thereafter,humanely disposeofallanimalsowned,kept,orharbored bysuch person and nopartofthepermitorlicensefeeshallberefunded.O C.It shallbe a conditionof theissuance of any permit or license thatthe Cityof Moses Lakeshallbepermittedtoinspectallanimalsandthepremiseswhereanimalsarekeptatanytimeandshall,ifpermission for such inspection is refused,revoke the permit or license oftherefusingowner,
D.Iftheapplicant has withheld or falsified any information on theapplication,the CityofMosesLakeshallrefusetoissueormayrevokeapermitorlicense.
E.No personwho has been convictedofcrueltyto animals shall be issued a permit or licensetooperateacommercialanimalestablishment
F.Any person having been denied a license or permit may not reapply fora period of thirty(30)days.Each reapplication shall be accompanied by a twentydollar ($20)fee.
G.Any dog impounded underthe provisionsofthischapter shallnot be released untiltheownerofsuchdogshallhavepaidallfeesandchargesdue.
6.05.180 Records:
A.Itshall be theduty oftheAnimal ControlOfficertokeep,or cause to be kept,accurate anddetailedrecordsoftheimpoundmentanddispositionofalldogscomingintohiscustodyandofallreportsofanimalbitesreportedtohim.
B.Itshall be the duty of theFinance Director or his designee to keep a record ofthe names ofallpersonstowhomlicensesareissuedwiththenumberofeachlicenseandwhetherforamaleorfemaledogandwhetherthemaledoghasbeenneuteredorthefemaledogspsyed.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of the entire City Council present vote in favor of
passage.
