1891_00001ORDINANCE NO.1891 AN ORDINANCE AMENDINGCHAPTER 8.24 OF THE MOSES LAKEMUNICIPALCODEENTITLED"BURGLARALARMSYSTEMS" THECITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINASFOLLOWS: Section 1.Chapter 8.24 of the Moses Lake Municipal Code entitled "Burglar Alarm Systems"is amendedasfollows: 8.24.030 Alarm Businesses -License -Application: A.Any person engaginginan alarm business inthecityshall,withinthirtydays afterthe effectivedateoftheordinancecodifiedinthistitle,applytotheFinance Director fora license tooperateonaformtobefurnishedbytheFinanceDirector.Businesses which sell onlythose alarmsystemsexcludedfromthedefinitionofalarmsystemsinsubsection3ofSection8.24.020 arenotrequiredtoobtainalicenseunderthissection. B.Such applicationshallbe signed bytheindividual proprietor ofsuchbusiness,or bya partner,or by theproper corporate official,as is appropriate for theform ofthe business seeking thelicense,and shall include thefollowing: 1.The name,address,and telephone number of the alarm business,and the type ofbusinessorganizationitis(individual,partnership,or corporation).Ifthe business is anindividualproprietorship,the name,address,and telephone number of the owner;if apartnership,thename,address,and telephonenumberofeach partner (general,limited,silent,etc.);ifa corporation,thenames and addresses of the directors,principal officersandstockholders(anystockholder holding morethen twentypercent of the corporation'sauthorizedandissuedstock)and thestate where incorporated; 2.Certification thatwithinninetydays after theeffectivedate oftheordinancecodified inthischapter,or upon receipt of notice of approval of a license,whichever occurs later,thealarmbusinessshallmaintainadescriptionofthealarmsystemsanddevicesofferedforsaleorleasetothepublicandadescriptionofanyservicesrelatedtoalarmdevicesofferedtothepublic; 3.Certification thatwithin ninetydays after theeffective date of theordinancecodified inthischapter,or upon receipt of notice of an approvalof a license,whichever occurs later,aOcompletelistofthenamesandaddressesofallpersonsforwhomalarmsystemshavebeensoldand/orare currently undercontracttothe alarm business for serviceon or aftertheeffectivedateoftheordinancecodifiedinthischapter,shall be maintained forinspectionbythePoliceChiefduringthecourseofhisofficialbusiness; 4.A complete list of criminalconvictions,if any,except for minor trafficoffenses of theapplicant,or a listof criminal convictions,ifany,except for minor trafficoffenses ofeachpartner,officer,or local officemanager iftheapplicant is other than an individual; 5.Astatement that theapplicantwillinform the Police Department withintendays afteranysubstantialchangeintheinformationrequiredbythissectioninwriting; 6.Acopyofa valid Washington State Electrical License issued by theDepartment of LaborandIndustriesasrequiredbyRCW19.28.120,iftheapplicant isgoingtobe involved inthebusinessofinstallingwiresorequipmenttoconveyelectriccurrentorinstallingapparatustobeoperatedbysuchcurrentasitpertainstotheelectricalindustry. C.License application shall be accompanied by a nonrefundablefee of ninetydollars ($90)tocoverthecoststothecityofprocessingtheapplicationandinvestigatingtheapplicant 8.24.050 Alarm Businesses -License -Application Review and Issuance: A.The Finance Director shall request a background report on theapplicanttobe prepared bythePoliceChieforhisdesignatedrepresentativebasedontheinformationcontainedintheapplicationtogetherwithsuchotherrelevantinformationasmaybeobtainedpertainingtotheapplicantandhisbusinesswitharecommendationtoapproveordenythelicense. The background check willrequirea fullset ofrolledfingerprint impressions oftheapplicantOwhichwillbesenttothestateandnationalidentificationsectionsoftheStateofWashingtonandtheFederalBureauofInvestigation.Inaddition tothe fingerprints,theMoses LakePoliceDepartmentwillphotographtheapplicantwiththephotographtoberetainedintheFinanceDirectofsbusinessfilesandidentificationfilesofthePoliceDepartment B.On thebasis of thisreport,the Police Chief shall,within sixtydays after thereceipt of theFinanceDirectofsrequestforareportofanapplicationforanalarmbusinesslicense,makearecommendationtoeitherapproveordenytheissuanceofalicense.Upon makingadecision,the Finance Director shall: 1.In the case of approval,notifytheapplicantinwritingoftheapproval,and inform himthat uponthe presentation ofthewritingto theFinance Director,orhis designated representa- tive,and thepaymentoftherequired fee,theapplicantwillbe issued a license tooperate; 2.In the case ofdenial,notify theapplicant in writingofthe denial and ofthe basis for thedenial,which may be nonconformancewithany part ofthischapter.Ifthe basis for thedenialcanbecorrected,thewriting shallso state and shall explain how thesecorrections may be made and set a reasonable timelimitfor making such corrections.The notice of denial shall informthe applicant thathe may appealthe denial and set forth theprocedure for appeal.The procedure for appeal shall be as follows: a.Within tendays after receiptofthe noticeofdenial,theapplicantshall filea notice of appealwiththeCity Manager addressed totheCityCouncil and statingthebasis oftheappeal, b.Withintendays after receipt ofthenoticeofappeal,the CityManager orhis designated representative shallarrange for a conferencewiththeapplicantand thePolice Chief to attempt toreach an agreement concerningthe appeal. c.If the conference fails to settle the matter in a way acceptable to the applicant, arrangements shall be made tohave the appeal heard before theCityCouncil.Such hearing shall be held withintwentydays aftertheconference.The City Managershall cause the applicant to be given notice ofthe hearing by certifiedmail at least sevendaysinadvanceofthedateofthehearing.Notice ofsuch hearing shallalso be posted as partoftheCityCouncifs agenda forthatmeeting.The applicantmayappear before theCityCounciland the applicant or his designated representativemaymakean oral presentation of his appeal,orhe maymake theappeal througha writtenstatement,orhemaydoboth.The City Council shall rule on theappeal within thirtydays after itis heard,and such rulingshallbe final. 8.24.070 Alarm Businesses -License -Revocation: A.In addition toany penalties which may be imposed for theviolation ofcertainprovisions ofthischapter,thecitymay,pursuantto the provisions of thissection,revokethe license ofan alarmbusinessonanyofthefollowinggrounds: 1.Fraud or willfuland knowing misrepresentationor false statement made inan application for a license; 2.Fraud orwillfuland knowing misrepresentation or false statementmade in an application for a license; 3.Failure to comply within a reasonable timewith any order or notice issued by the City Manager after the licensee's rightstohearingand appeal have been exhausted or failure after reasonable notice topermit thePolice Chieftoinspect anylists whichhe isauthorizedtoinspectunderthischapter;or failure to complywiththe standards imposed by thischapterwithinareasonabletime,not less than thirtydays,after noticeor order from thePoliceChief. B.No alarmbusiness license shall be revoked until a hearing is held by the Finance Director. Written notice of thetimeand placeofthe hearing shallbe served on the holder ofthelicense at least ten days before thedate set for the hearing.The notice shall set forth a summaryof thegroundsadvanced as the basis for the revocationofthelicense. C.At the hearing before the Finance Director,the holder of the license or his authorized representative shallbe givenan opportunitytoconfrontandexamineany adverse witness,and to present evidence on his own behalf.After the hearing theFinance Director shall either dismiss thecomplaintorshallforward thecomplaintto theCity Manager with his recommenda- tionthatthelicense be revoked.Within ten days after receiving such recommendation,the City Manager shall approve or disapprove the recommendation.In either event,the City Manager shall cause the holder ofthe license tobe given notice inwriting of his decision within ten days after makingit. D.Any person whose license is revokedpursuant tosubsection C of thissection shallhave the right,withinten days afterreceiving notice inwritingofthe revocation from the City Manager, offilinga written appeal withtheCityCouncil.Suchappeal shallset forthindetail the specific groundor grounds on which it is based.The City Councilshallhold a hearing on theappeal within thirtydays after its receipt by thecity and shall cause theappellanttobe givenat least ten days'written notice of such hearing.At the hearing the appellant or his authorized representative shallhave therightto present a written ororalargument,orboth,insupport of his appeal.The determination of the CityCouncil on theappeal shall be final. E.Withinten days afteran alarm business receives notice of revocation of its license,or after it has exhausted allappeals with respect tosuch revocation,itshallnotifyall persons for whom it is required to maintaina list pursuant to subsection A (3)of Section 8.24.030 of such revocation,and the notice shall advise such persons that the alarm business must cease providingservice fororsellingburglar and robberyalarmsystems tosuch persons withinthirty days after they receive notice of revocation.For the purposes of thissection,any alarm business otherthana central station,modified centralstation,ortelephone answering service may satisfy thenoticerequirementsby placing an advertisement ina newspaper or newspa- pers published in thegeographicareas inwhichit's customers are located,which advertise-ment shall be inaform prescribed by theFinance Director.Such advertisement should appearatleastonedayaweekforthreesuccessiveweeks.When the notice required by thissubsectionhasbeencompleted,thealarm business shall submit a sworncertificate to theFinanceDirectorthatithasmettherequirementsofthissubsection. F.After notice of revocation has been given,an alarm business licensee may continuetooperatehisbusinessuntilallofhisrightsofappealunderthischapterhavebeenexhausted. 8.24.080 Alarm Agents -Identification Cards -Reguired -Application: A.Every alarm agent employedbyan alarm business within Moses Lake shall be requiredtoobtainanidentificationcardfromtheFinanceDirector.UntiltheFinance Director acts upontheapplicationofanalarmagentforanidentificationcard,an alarm business may issue atemporaryidentificationcard,as provided in subsection B of this section.The owners,managers,corporateofficers,and partnersofallalarmbusinesses are also required toobtainidentificationcardsfromtheFinanceDirectoriftheydirectlyengageinselling,installing,servicing,maintaining,orrespondingtoalarmsystems withinMoses Lake.Any person whoisnotanalarmagentwho,as an employee of a licensed alarm business,has access toconfidentialinformationofanalarmuser,ortomonitoringradioequipment,must alsoobtainanidentificationcard.Withinthirtydays of the effectivedate oftheordinance codified in thischapter,alarm agents and,if required by thissubsection,owners,managers,corporateofficers,and partners shallsubmit applicationstotheFinance Director for identification cards.The applicationfor theidentification cardshallbe ina form prescribed by theFinanceDirectorandshallincludethefollowing: 1.The applicant'sfullname and any aliases or other names previously used,residence andbusinessaddresses,and telephonenumbers; 2.The applicant's date and place of birth; 3.A listof all felony and misdemeanorconvictionsoftheapplicant; 4.Two classifiablesets offingerprints; 5.Two recent photographs of theapplicantofa typeprescribed by theFinance Director; 6.The name and address ofthealarm business where the applicantis or willbe employed; 7.The applicant's employmentrecord for thepriorthree years; 8.A statement thatthe applicantwillinform the Finance Directorofany change intheaboveinformationortheterminationoftheapplicant's employmentby thealarm business withintendaysofsuchchange; 9.Any other information whichthe Finance Directormay deem necessary to determinewhethertheapplicantforanidentificationcardmeetstherequirementsofthischapter. B.Atemporary identification card may be issued byan alarmbusiness for itsalarmagents oranyotherpersonrequiredtoobtainanidentificationcardinsubsectionAofthissectionpriortotheobtainingofanauthorizedidentificationcardfromtheFinanceDirector.The form fortemporaryidentificationcardsshallbeprescribedbytheFinanceDirectorandshallprovideforthefollowing: 1.The name of the alarm agent or card holder 2.The home address ofthealarmagent or card holder; 3.The name and address ofthealarm business forwhichthealarmagent or card holderisemployed; I4.The date upon which thealarm agent or card holder commenced employment with thealarmbusinessandtheexpirationdateofthetemporaryidentificationcard; 5.A recent photograph of thealarm|agent or card holder. Prior to employing an alarmagent,an alarmbusiness shallrequirethenames ofat leasttworeferencesandthenamesandaddressesofemployersforthepastthreeyearsofsuchpersonandshallmakereasoriableandprudentinquiriespriortoissuingatemporaryidentificationcardtodeterminewhetherthepersonapplyingforemploymentmeetstherequirementsofthissection,Ifthealarm business has reason to believe thatthejobapplicantdoesnotmeettherequirementsofthissection,no temporaryidentification cardshallbeissuedbythealarmbusinpss.Withinfourteen days ofthe commencement ofemploymentwithanalarmbusiness,any new alarm agent must submit an applicationtotheFinanceDirectorforapermanentidentificationcardunderthissection. C.The temporaryorpermanent identification card required by this section shall be carriedby apersonrequiredtoobtainanidentificationcardwheneversuchpersonisengagedinthebusinessofthelicenseeandshallbeexhibitedatthedemandofanylawfulauthority. D.Application foran identification card must be accompanied bya ninetydollar ($90)fee tocover costs of processing the application and investigating theapplicant. 8.24.090 Alarm Agents -Identification Cards -Application Review and Issuance: A.The Police Chief shall cause a report ontheapplicant for the Finance Director tobe prepared based on the information contained in the application togetherwith such other relevant information as may be obtained pertaining totheapplicant No identification card shall be issued if: 1.The applicant has been convicted ofa felony or a misdemeanor involvingmoral turpitude. 2.The application contains any false statements made willfully and knowingly. 3.The applicant is not employed as an alarm agent or is not to be employed as an alarm agent by an alarm business ifhe is issued an identification card. B.Iftheapplication is approved,the Finance Directorshallcause an identification card to be issued to theapplicant. C.Iftheapplication is denied,the Finance Director shall notifytheapplicant,in writing,of thedenialandofthebasisforthedenial.The notice of denial shall inform the applicant that he mayappeal thedenialand set forth the procedurefor appeal.The procedurefor appeal shall be as follows: 1.The applicant shall have tendays afterreceipt of the notice of denial tofile a notice of appeal with theCity Manager or his designated representative,stating the basis for theappeal. 2.Withinten(10)days after receipt of the notice of appeal,theCity Manager or his desig- nated representative shall either reverse theFinance Director and order an identification cardtobe issued,or uphold the decision oftheFinance Director and cause theapplicanttobesonotified.The rulingoftheCityManager or his designated representativeshall be final. 8.24.100 Alarm Agents -Identification Cards -Suspension or Revocation: A.In addition to any penalties which may be imposed for the violation of provisions of thischapter,the city may,pursuant to the provisions of thissection,revoke the identification cardofanalarmagentonanyofthefollowinggrounds: 1.Fraud or willfuland knowing misrepresentationor false statements made inan applicationforanidentificationcard; 2.Fraud or willfuland knowing misrepresentation or false statement made while employed as an alarmagent; 3.Conviction of a felony or of a misdemeanor which reflects unfavorably upon thecardholder's fitness to be an alarm agent B.No identification card shall be revoked untila hearing is held by theFinance Director.Written notice of the timeand place ofthe hearing shallbe served on the holder of an identification card at least ten days before thedate setforthe hearing.The noticeshallset forth a summaryofthegroundsadvancedasthebasisfortherevocationoftheidentificationcard. C.At the hearing before the Finance Director,the holder of the identification card shallbe given an opportunity toconfrontand examineany adverse witness,and topresent evidence in his own behalf.After thehearing theFinance Director shalleitherdismiss thecomplaint,or shall forward the complainttothe CityManager withhis recommendation thatan identification card be revoked.Within ten days after receivingsuch recommendation,the City Manager shall approve or disapprove the recommendation.Ineither event,the CityManager shall cause theholderofanidentificationcardtobegivennoticeinwritingofhisdecisionwithintendaysafter making it. D.Any person whose identification card is revoked pursuant tothis section shallhave the right, within tendays afterreceivingnoticeinwritingoftherevocation fromtheCityManager,offiling a written appealwiththeCityCouncil.Such appeal shallset forth in detail the specific ground on which it is based.The City Council shall hold a hearing on the appeal within thirtydays afterits receipt by thecity,and shallcause the appellant to be given at least ten days written noticeofsuch hearing.Atthe hearing theappellantor hisauthorizedrepresentativeshall have theright topresent a written or oral argument,or both,in support ofhis appeal.The determi- nationoftheCityCouncil on theappeal shall be final. E.After noticeofrevocation is given,an alarm agent identification card shallremain in fullforce andeffectandtheholder ofan alarmagent identificationcardshallbe permittedtoperform the authorizedfunctionsof a licensed alarm agent untilany appeal has been concluded. 8.24.110 Alarm Agents -Identification Cards -Form -Return of Cards: A.An identification card issued by theFinance Director shallcontaina recent photograph oftheapplicant,the date ofissue,the applicant'ssignature,a statementthatthe card is valid for twoyearsfromthedateofissueandsuchotherinformationastheFinanceDirectormayinhisdiscretionrequire.Allidentification cards shall be consecutively numbered. B.Itshallbe a misdemeanor forthe applicantwillfullytofailto return an identification card totheissuingagencyorbusinessuponterminationofhisemploymentwithanalarmbusiness.ItshallbeamisdemeanorforthealarmbusinesstofailtoreturntotheFinanceDirectoranOidentificationcardissuedbytheFinanceDirectoruponterminationoftheemploymentofthealarmagent 8.24.120 Administrative Rules:The Finance Director shallpromulgate such rules as maybe necessary fortheimplementationofthischapterandfordeterminationofgroundsforclericalsuspensionorrevocationofanylicenseorpermitrequiredbythischapter.The rulesshallbe approved bytheCityManagerandshallbeopentoinspectionbythepublic. 8.24.140 Automatic Dialinq Device -OperatingInstructions -Service: A.Every alarm business sellingor leasing to any person an automatic dialing device which isinstalledonsuchperson's premises inthecityafterthe effective date oftheordinancecodifiedinthischaptershallfurnishthatpersonwithinstructionsthatprovideadequateinformationtoenablepersonsusingsuchdevicetooperateitproperlyand,ifthe device is tobe servicedormaintainedbyanotheralarmbusiness,shall furnish such otheralarmbusiness with a manualorotherinformationnecessarytoenableittoserviceorproperlymaintainsuchdevice. B.IftheFinance Director reasonablyfinds such information tobe incomplete or unclear,or inade-quate to explain how the device operates and is constructed,he mayrequire the alarmbusinesstorevisetheinformationtomeethisapproval,and then todistribute the revisedinformationtopersonswhohavehadsuchdevicesinstalledaswellastopersonssubse-quentlyhaving such devices installed. C.Every alarm business sellingor leasing to any person an automaticdialing device whichisinstalledonsuchperson's premises inthecityaftertheeffectivedate oftheordinancecodifiedinthischaptershallprovideormakeavailableatalltimesservicetorepairsuchdeviceshoulditmalfunction,and shall furnish totheperson buying orleasing such device written informationconcerninghowservicemaybeobtainedatanytime,including thetelephonenumbertocallforservice. 8.24.145 VARDAAlarms: A.A person,partnership,orcorporationowningand/oroperating a business shall be permittedtodonatetotheCityofMosesLakethefundsnecessarytopurchaseaVardaAlarmSystem(VAS)which would be owned by thecity butwhich would be placed in thebusiness ownedand/or operated by theperson,partnership,orcorporationdonating thefundsforitspurchase.The VASwillbe allowed toutilizethe LERNfrequency,ifappropriate,in order tocompletetheusabilityoftheVAS. B.Each person,partnership,or corporationdonating funds to the City of Moses Lake for thepurchaseofaVASwhichwillbeplacedinthebusinessoperatedbythedonorshallexecuteacontractwiththeCityofMosesLakeandshallabidebyallpolicies,rules,and regulationsoftheCityofMosesLakewithregardtothedonationofaVASandtheplacementoftheVASinthelocationofthebusinessownedbythedonor.The contractform and thepolicies,rules,and regulationsshall be reviewed and adopted bytheCouncil. C.The person,partnership,or corporation donating the funds necessary to purchase a VASwhichisthenlocatedinthebusinessownedbytheperson,partnership,or corporationdonatingthefundsshallbeallowedone(1)service callper monthby theMoses Lake PoliceDepartment.If the person,partnership,or corporationrequires an additionalservice call,whether theservice is performed in the person's,partnership's,or corporation'sbusiness orattheMosesLakePoliceDepartment,the person,partnership,or corporation shall beassessedafeeofseventy-five dollars ($75)for each additionalservice call. 8,24,180 Alarm Systems -Standards and Inspection: A.Allalarmsystems installed incommercialor public buildingsafterthepassage oftheordinancecodifiedinthischaptershallutilizeequipmentandmethodsofinstallationsubstantiallyequivalenttoorexceedingthefollowingminimumapplicableULorANSIstandards:UL609(ANSI SE2.1-1972)"LocalBurglar Alarm Unitsand Systems";UL 636 (ANSI 8E2.7-1073)"Hold-upAlarm Unitsand Systems";UL681 (ANSI8E2.3-1972)"Installation and ClassificationofMercantileandBankBurglarAlarmSystems." B.AIIalarm systems installed in residences after the passage of theordinance codifiedinthischaptershallutilizeequipmentwhichshallbesubstantiallyequivalenttoorexceedtheminimumapplicableULStandards1023(ANSISE2.4-1972)"Household Burglar AlarmSystemsUnits,"and such equipment shallbe in-stalled in a safe,reliable,and workmanlikemanner. C.The equipment or hardware used and/or themanner of installation ofthealarmsystem maycorrespondtoanyoftheseverallevelsofprotectionorgradesofservicelistedintheapplica- ble standards;provided,however,thatalarm system users shall not be requiredto provide protection for all of the areas or openings which may be required to be protected by theapplicablestandards. D.The standards referred to in this section are adopted as part of thischapter subject to themodificationsandqualificationssetforthinthischapterandacopyofsuchstandardsshallbe kept onfileat the City Hall and be availablefor publicinspection. E.In those instances where UL and/or ANSI have not established standards for categories ofequipmentorwherenewequipmentisundergoingfieldtesting,the Finance Director mayrequirethatthealarmsystembeinspectedattheexpenseofthealarmuserbyaprofessional electricalengineerwhoshallcertifywhether thealarm system appears tobe safe and reliable. 8.24.190 Inspection of Alarm Devices and Businesses: A.For the purpose of enforcing theprovisions of thischapter,the PoliceChiefshall have theauthority,at reasonable timesand upon reasonable oral notice,toenter any premises inthecityinoruponwhichalarmbusinessessubjecttothischapterarelocated,to inspect theinstallationand/or operation of such alarm systems or alarm businesses on officialpolice business. B.If such inspection reveals any violations of the provisions of this chapter,a written report detailing such violations shall be promptly sent tothe Finance Director and to the owner,lessee,or other person responsible for the alarm system or business in violation of thischapter.Such reportshall requirethecorrectionwithinthirtydays after receiptofthe noticeoftheviolationdiscovered,and shallstate thata failure tocomply may result intherevocation of thealarm business'license tooperate,inaccordance withprovisions ofthischapter relating to revocationof licenses and permits.The alarmuser oralarm business shall be granted areasonableextensionoftimetocorrectsuchviolationupongoodcauseshown. 8.24.230 False Alarms: A.It is unlawful to have to maintain on any premises an audible type burglary and/or robbery alarm unless: 1.The alarmwillshut itself offaftersoundingfor a period of seven minutes maximum; 2.Unless there is posted at the main entrance to such premises a prominent notice of thetelephonenumbersatwhichthepersonorpersonsauthorizedtoentersuchpremisesand turnoffsuch alarmcan be reached at alltimes,and itis unlawfulfor any such person tofailtoappearandturnoffanysuchalarmwithinonehourafterbeingnotifiedbythepolice todo so. B.Itis unlawfulforanyone toactivateany robbery or burglary alarm forthe purpose of summon-ing police except in the event of an actual or attempted burglary or robbery,or for anyonenotifyingthepoliceofanactivatedalarmandhavingknowledgethatsuchactivationwasapparentlycausedbyanelectricalorothermalfunctionofthealarmsystemtofailatthesametimetonotifythepoliceofsuchapparentmalfunction. C.For a police response toany false alarmthePolice Chiefshallinformthe Finance Director andtheFinanceDirectorshallchargeandcollectfromthepersonhavingormaintainingsuch burglary and/or robbery alarm on premises owned or occupied by him fees as follows: 1.For a response to premises at which no other false alarm has occurred within theprecedingthree-monthperiod,hereinafterreferred toas a "firstresponse,"nofee shallbe charged,but theperson having ormaintaining such burglary and/or robbery alarmshall,within three working days after notice todo so,makea writtenreportto the Police Chief on forms prescribed by him setting forth the cause of such false alarm,the corrective actiontaken,whether such alarm has been inspected by an authorized serviceman,andsuchotherinformationasthePoliceChiefmayreasonablyrequiretodeterminethecauseofsuchfalsealarmandcorrectiveactionnecessary. 2.For a second response toa premiseswithinthree monthsafter a first response,a fee of fifty dollars ($50)shall be charged and a written report shall be required as for a first response and the Police Chief shallbe authorizedto inspect or cause tobe inspected the alarm system at such premises,prescribe necessary correctiveaction,and shall give notice to the person having or maintaining such alarm system of the conditions and requirementsof thissection. 3.For a thirdresponse to premises withinthreemonths after such a second response,and for all succeeding responses within threemonths of the last response,a fee of onehundreddollars($100)shall be chärged,and if such third false alarm or any such succeeding false alarm is as a result of failure to take necessary corrective action prescribed by thePolice Chief,the Police Chief mayorderthe disconnection ofsuch alarm system and itshallbe unlawfultoreconnect such alarmsystem untilsuch correctiveaction is taken;provided,that no disconnection shall be ordered as toany premises requiredby law to have an alarmsystem in operation. Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of theentire City Council present vote in favor ofpassage.
