AN ORDINANCEAMENDINGCHAPTER 12.44 OF THE MOSES LAKEMUNICIPALCODEENTITLED"STREET VACATION"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 12.44 ofthe Moses Lake Municipal Code entitled"Street Vacations*"is amended asfollows:
O 12.44.020 Processing Fee:A non-refundable fee oftwohundred dollars ($200)shall accompanyeach andeverypetitionforastreetvacation.The petition shall not be presented totheCity Councilnorprocessedfurtheruntilthefeehasbeenpaid.
12.44.030 Appraisal Fee:The petitioners,in additionto paying thetwohundred dollars ($200)processingfee,shall deposit with theCityofMoses Lake a sumestablishedby theMunicipalServices Directororhisorhersuccessorintitle,but in noevent less than four hundred dollars ($400).The cost ofappraisingthepropertysoughttobevacatedinordertoestablishtheappraisedvalueofthepropertyshallbebornebythepetitionersanddeductedfromthepetitionersdeposit.The balanceofthedeposit,after deducting the cost of the appraisal,shallbe returned to the petitioners.
12.44.040 Compensation:The twohundred dollars ($200)processing fee and the cost oftheappraisal ofthepropertysoughttobevacatedshallbepaidbythepetitionersinadditiontothecompensationforthepropertythatthecitymayrequirepursuanttoRCW35.79.020 ifthe property isvacatedandregardlessofwhetherornotthevacationisactuallyapproved.
Section 2.The City Councildeclares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of theentire CityCouncil present vote in favor ofpassage.
