B.The followingshall be themonthly rate charged customers residing within thecorporate limits of the cityand outside the corporate limits ofthe cityfor sewer service from the citysewersystemforsingle-familydwellings and each unit of a duplex with separate meters:flat rate,$25.50per monthafterMay 1,2001.O13.12.035 Duolex Sewer Rates: A.The followingshallbe themonthlyrate chargedcustomers residingwithinthecorporate limits of thecity and outside thecorporate limits of the city for sewer service from thecity sewersystemforduplexeswithonlyone(1)meterservingtwo(2)livingunitsorfortwo(2)livingunits on a single lotserved byone (1)meter:flat rate,$49.50 per monthafter May 1,2000. B.The followingshall be themonthly rate charged customers residing withinthe corporate limits of the city and outside the corporate limits of the city for sewer service from thecity sewersystemforduplexeswithonlyone(1)meter servingtwo(2)livingunits orfortwo(2)livingunits on a single lot served by one (1)meter:flat rate,$51.00per month afterMay1,2001. 13.12.040 Commercial Sewer Rates: A.The followingshall be themonthly rate chargedcustomers residingwithinthe corporatelimits of the cityand outside the corporate limitsof thecity for all chargeable water discharged into thecity sewer system by commercialusers and dwellings withthree (3)or more living unitsservedbyone(1)meterafterMay 1,2000: Amount Used (incubic feet)Sewer Rate 0-1,000 $25.50per monthminimum Over 1,000 $.88per 100 cu.ft.or portion thereof The followingshallbe themonthlyrate charged customers residing withinthecorporate limits ofthecityand outsidethecorporate limitsofthecityfor allchargeable water discharged into the city sewer system by commercial users and dwellings with three(3)or more living unitsservedbyone(1)meter after May 1,2001: Amount Used(incubic feet)Sewer Rate 0-1,000 $26.30per month minimum Over 1,000 $.91per 100 cu.ft,or portionthereof B.For purposes of calculating sewer charges,chargeable water shall be defined as follows: Chargeable water shall be measured by the water consumed on the premises,whatever the source of such water,and the same will be metered either by a public utility meter or oneinstalledandmaintainedbytheownerofthepremisesathisownexpenseandapprovedandinspectedbythecity.As an option,ifrequested by the ownerof thepremises,the city will install a water meter withthe cost for the meter and installation being paid by theownerofthepremisesinaccordancewiththechargesassessedinMLMC13.08.020 for water/sewerconnections.Under such circumstancesthewater meter becomes the property of the ownerofthepremisesandallcostsofreplacementandrepairaretheresponsibilityoftheownerof the premises.In allcircumstances where the water is metered by a privately ownedwater meter and is used to determine sewer charges,the city shall be allowedaccess to themeter inordertoread such meter.Where theuse ofwater is such thata portion ofallthe water used does notflowintothesewer system,for whatever reason,but is lost by evaporation,irrigation, sprinkling or is used in manufacturingor in a manufacturedproduct,or is lost for whatever reason,and the person incontrol provides proof ofthisfact and installs a meter or other mea-suringdevice approved by the city to measure the amountofwater so used and so lost,or if the cityis capable of determining the amount of sewage enteringthe city'ssewer system by some other mechanicalmeans,thiswatermay be deducted fromtheactual water consumption used in calculatingthe sewer charge. The sewer charges for triplexesand apartments,mobilehome parks,schools,hospitals and othercommercial establishments with increased usage for irrigation,onlyiftheirlandscaping exceeds fivethousand(5,000)square feet,shallbe computed on the average consumption during the previousnon-irrigation season,unless the user elects toinstall,at his expense,anapprovedmeasuringdevicetomeasurewaternotenteringthesewersystem.When a user has a swimmingpool or coolingunitsdischargingto the sanitary sewer,he mustinstall an approved meter todetermine the amount ofwater exempt from sewer charges during the irrigationseason.The inigation season shallbe defined as theperiod inwhichstatements aremailedfortheAprilthroughNovemberbillingcycles. C.Sewer rates for commercialuses discharged into the sewer system may be separatelydeterminedbytheCityCouncil,based upon both volume and chemicalcharacteristicsofthesewage.The CityCouncilreserves the privilege to require pre-treatment of any materialdischargedintotheseweragesystem,or to prohibit discharge into the system of industrialwastesthat,because of either volume or concentration,will overload existingseweragefacilities. O D.Allair-conditioning and refrigeration units thatare installed,replaced orthat have capacityincreasedaftertheeffectivedateoftheordinancecodifiedinthischaptershallberequiredtoinstallrecirculatingunits.Disposalmaynot be accomplishedby discharginginto thesanitary sewer system. 13.12.085 Service Charge: A.The service charge forallwaterturn-onsor turn-offsafter4 p.m.and before 8 a.m.and at anyothertimewhichisnotanormalworkingdayforthecityshallbethirtydollars($30).This feeisinadditiontothefeeimposedbythissection. B.A delinquentservice charge ofseven dollars ($7)willbe assessed on each water,sewer,orgarbageaccountoranycombinationofwater,seweror garbage servicewhichis billedon one(1)accountifnot paid and receivedby the Finance Department,UtilitiesDivision,by 5 p.m.onthedaypriortodateshownuponthedelinquentnoticeprovidednoextensionsaregrantedassetforthinSection13.12.053.The assessment of theseven dollars (7)delinquentservicechargeshallbewaivedonceacalendaryearoneachandeveryaccount.An additionaldelinquentservicechargeoftwelvedollars($12)willbe assessedon each water,sewer,orgarbageaccountoranycombinationofwater,sewer,orgarbage servicewhich is billedonone(1)account ifnot paid by the date and time shown upon the delinquent notice provided noextensionsaregrantedassetforthinSection13.12.053.The seven dollar ($7)and twelvedollar($12)service charges are subject tothe limitations of Subsections F and G ofSection13.12.060.Ifwater service is terminatedfor non-payment of the account,the twelvedollar($12)charge shall include turningthe water back on from 8 a.m.to 4 p.m.on normalcityworkingdaysprovidedtheoccupantdoesnotchange.This fee is in addition to thefeeimposedbySubsectionC. C.A service fee of eight dollars ($8)shall be added to each new water,sewer,or garbageOaccountoranycombinationofwater,sewer or garbage service which is billed on one (1)account.A service fee of eight dollars ($8)shall be added for each change of service toanotheroccupant.This fee shall include one (1)water turn-onifapplicablefrom 8 a.m.to4p.m.on normal city working days. Section 2.The CityCouncildeclares that an emergency exists and thisordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of the entire CityCouncil present vote in favor ofpassage.
