ANORDINANCEAMENDINGCHAPTER 17.13 OF THE MOSES LAKEMUNICIPALCODEENTITLED"SHORT SUBDIVISIONS"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAINAS FOLLOWS:
Section 1.Chapter 17.13 ofthe Moses Lake Municipal Code entitled"Short Subdivisions"is amended asfollows:
17.13.030 Preliminary Plat Conditionsand Requirements:
A.General Conditions and Requirements:
1.The subdivision shall make adequate provision for roads,streets,curbs,gutters,sidewalks,street lighting circuits,alleys,extension of municipal utilities (sewerandwater),drainage ways,irrigation water right-of-ways,other public ways orany municipalimprovementsasdeemednecessaryinconformancewithcityCommunityStreetandUtilityStandardsandcityDesignStandardsineffectatthetimeofplatapproval.
2.The subdivisionshall front on a existingstreet.There shall be adequate access toallparcels.Streets shall be improved tocity standards.Street lighting shall be provided.
3.The subdivisionshall complywithallzoning and health regulations.
4.The subdivisionshallbe consistent withthe city'sComprehensive Plan.
5.Environmental information shall be prepared and submitted in accordance with theguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended,Said information is a part of and mustaccompanythepreliminary platapplication.
6.The subdivision shall provide for irrigation water right-of-wayspursuant to RCW58.17.310 as nowenacted or hereafter amended.
7.A street lighting planas may be required by theCity Engineermust be provided.TheplanmustbeapprovedbytheGrantCountyPUDandincludecertificationthatallstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUDhavebeenmadeforthepaymentofrequiredfees.
8.The subdivisionshallnot have been previouslydivided in a short subdivision within thelastfive(5)years and willnot be furtherdivided in any manner unless such proposedresubdivisioncomplieswithallprovisionsrelatingtomajorsubdivisionsineffectatthetimethefurthersubdivisioniscommenced.
9.Unless an applicantfor a preliminary plat approval requests otherwise,and the PlatAdministratoragrees,a preliminaryplat shall be processed simultaneously withtheapplicationforrezones,variances,plannedunit developments,site planapprovals,andsimilarquasi-judicial or administrative actionstotheextent that proceduralrequirementsapplicabletothoseactionspermitsimultaneousprocessing,
10.Every decision or recommendation made under thischapter by the Council orPlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation.
11.Preliminary plats ofany proposed short subdivisionshall be approved,disapproved,or returned to theapplicantfor modificationwithinthe timelimitations established byRCW58.17.140.
12.In the event thatthe short subdivision does not border upon adjacent property towhichmunicipalutilitieshavebeenextendedoruponadjacentpropertyfrontinguponimprovedstreets,the propeityownermayrequest a variancetothe shortsubdivisionprovisionsformunicipalimprovementsasdeemednecessary.In lieuofthecomple-tionoftheextension of municipal utilities(sewerand water)and the completionofstreetimprovements,a covenanttotheland titlemay be created.Saidcovenant shallpledgethepropertyownertoinstallmunicipalimprovementsasdeemednecessaryatsuchtimeastheadjacentpropertyisimprovedbytheinstallationofmunicipalutilitiesand/or at such time as the improvement ofstreets uponwhichtheadjacentpropertyisfrontingoccursasanysucheventisdeemedtooccurinthesolediscretionOofthePlatAdministrator.Said covenant shallalso pledge theproperty ownerto par-ticipateinany future local improvement districts for such improvements.
13.At thediscretion ofthe Plat Administrator,therequirement that a preliminary shortplatbesubmittedmaybewaived.Subject tothe approvalofthePlat Administrator,a short plat withoutimprovements maybe submittedas a final plat for review andapproval.
14.Aplatcertificate from a titlecompanylicensed todo business intheState ofWash-ington dated withinthirty(30)days ofthedate offilingof thefinal plat and applicationwiththePlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication.
B.Specific Conditions and Requirements:
1.Prior tosubmission of a short subdivision preliminary application and preliminary plat,thesubdividerorthesubdivider's representative shall schedule a pre-application conferencewiththePlatAdministratorandrepresentativesofotheraffectedcitydepartments.Thesubdividershallpresentaconceptualideaoftheplat.The Plat Administrator and
representatives ofaffectedcitydepartments willrespondinformallyandaddress potentialitemsofconcerntoaidthesubdividerinpreparingtheshortsubdivisionpreliminary
applicationand preliminary plat
2.The preliminaryshortsubdivisionapplicationand plat shallbe filedwiththePlat Adminis-tratoron formsprescribed bytheCommunity Development Department The applicationshallbeaccompaniedbytwelve(12)copies ofthe preliminary plat.At thediscretion ofthePlatAdministrator,therequirementthattwelve(12)copies ofthepreliminary plat besubmittedmaybewaived.Processing of the preliminary plat may require fewer thantwelve(12)copies ofthe plat
3.The preliminary plat shall be a neat and accurate drawing,stamped and signed by aregisteredprofessionallandsurveyorlicensedbytheStateofWashingtononreproduc-ible material at a decimal scale.The platmap shall measure eighteen inches (18")by
twenty-fourinches (24").The preliminary plat shall be drawn inblack permanent ink ontwo(2)or more sheets ifthescale necessary to accommodate themapon one (1)sheetwouldundulycongestthedrawing.
4.A non-refundable fee of threehundred dollars ($300)shall accompany each and everyapplicationforapreliminaryshortsubdivision.
5.The preliminary platshall contain the following:
a.Name of proposed subdivision.
b.Boundaries of proposed subdivisionestablished by thepreliminary survey.
c.Location anddimension ofallexistingand proposed streets,alleys,utilitiesand right-
of-waysand/or easements on and adjacent to the proposed subdivision.
d.Location and dimensionsof allexistingand proposed irrigation water right-of-ways
on and adjacent totheproposed subdivision.
e.Legal description of land within the proposed subdivision.Of.Any proposed land dedications.
g.Name,address,and seal ofthe registered land surveyorwho made the preliminary
survey,
h.The date ofthe preliminary survey.
i.Horizontal scale of theproposed platshallbe notmorethanone hundred feet (100')tothe inch.Except thattheCity Engineer,subjecttoa request prior toplat submittal,
may approvean alternativeplatmap scale notto exceed one hundred feet (100')totheinch.
j.Monuments found and established during thepreliminary survey.
k.Date map is prepared,scale,and northpointofthemap.Approximate proposed lot
lines with theirdimensions,including lot numbers and block numbers.
I.If any of the parcels can be further divided or if only a portion of a tractis being
divided,location offuture streets,alleys,and lot lines shall be shownby dotted lines.
m.Avicinity mapat a scale ofnotmorethanfour hundred feet (400')totheinch.Except
that the City Engineer,subject to a request prior toplat submittal,mayapprove analternativevicinitymapscaleexceedingfourhundredfeet(400')totheinch.The
vicinitymap shall show all adjacent parcels.Itshall show how thestreets and alleys
in the proposed subdivision may connect with existing and proposed streets and
alleysinneighboringsubdivisionsorunplattedproperty to produce an advantageousdevelopmentoftheentireneighborhood.
n.Provide recommendedstreet names for approval.
o.United States Bureau of Reclamation horizontal and vertical data including bench
marks.
p.A site planon a separate sheet showingthe following information:
1)Location and sizing of existing and proposed utilities including water,sewer,
storm drains,electricity,gas,street lighting,curbsand sidewalks,telephone,and
cablevisionlines.Minimumsize and scale shall be the same as thepreliminaryplatmap.
2)Existing andproposed structures and naturalfeatures and all proposed improve-ments withinand adjoiningtheproposed subdivision.
3)Topography of thearea witha maximumof twofoot (2')intervals ofcontoursasrequiredbytheCityEngineer.
4)Present zoningclassification on and adjacentto property.
5)Any proposed dedications for park land subject totheapprovalofthePlanningCommission.
O 6)Any deed restrictions orcovenantsexisting orproposed shallbe drawn onthesiteplanandpreliminaryplatmap.
17.13.040 Referral toOther Departments.Agencies,and Offices:
A.Uponreceiptofa completeand satisfactorypreliminaryplatapplication,thePlat Administra-torshalldistribute copiesofthepreliminaryplattoeach ofthefollowingoffices,departments,or agencies withintwo(2)workingdays from receipt:
1.Public UtilityDistrict
2.Gas Company
3.Telephone Company
4.Engineering Division of theMunicipal Services Department (threecopies)
5.Fire Department
6.Building Division oftheCommunityDevelopment Department
7.GrantCounty Health District
8.Any irrigation district withjurisdiction
9.Grant County Assessor
10.Communications Company
B.The Plat Administrator shall further notify the Police Department,Park and RecreationDepartment,and City Manager thata preliminary plathas been received.
C.Notice of the filingof a preliminary platof a proposed subdivision located in the cityandadjoiningthemunicipalboundariesthereofshallbegiventotheGrantCountyPlanningDepartment.
D.Notice of thefiling of a preliminary plat ofa proposed subdivision located adjacent totheright-of-way of a state highway shall be giventotheState Department ofHighways.
E.Each office,department,oragency shalifilewritten recommendations withthePlat Adminis-tratorwithin eight (8)calendardays from thedate offilingofthepreliminary platand applica-tionwiththe Plat Administrator.Ifanysuchoffice,department,oragencyfails tofile a writtenrecommendationwithinthetimelimitation,itmaybe presumed thatsuchoffice,department,or agency has no recommendation.
F.Ifthepreliminaryplat is found to be unacceptable,a certifiedletter shall be mailedtothesubdividerwithinten(10)calendar days ofreceipt of the applicatiorL
G.The Plat Administratormaydetermine thata meeting shall be held to resolve major issuesidentifiedasaresultoftherecommendationsofotheroffices,departments,or agencies.Such meeting shall be attended by thoseoffices,departments,or agencies responsiblefortherecommendationsandmustincludetheapplicantandthePlatAdministrator.The pro-ceedings and results ofthe meetingshall be documented by minutes.
17.13.050 Variances:
A.The subdivider may make applicationtothe Plat Administrator on forms prescribed by theOCommunityDevelopmentDepartmentforavarianceofanyprovisioncontainedinthistitle,providedthattherequest is receivedprior tothepreliminary short plat approvalby thePlatAdministrator.
B.The Plat Administratorshallfonward thevariance applicationtothePlanning Commission.The Planning Commission shall reviewthevariance request at itsnext regular meetingandshallrecommendthattheCouncilapprove,conditionally approve,ordisapprove thevarianceapplication.
C.A variance may be granted in conformancewithallof the following conditions and require-ments:
1.There are specialphysicalcircumstancesor conditions affecting said real propertysuchthatstrictapplicationoftheprovisionsofthistitlewouldcauseanunusualandunneces-
sary hardship on thesubdivider.
2.The granting of thevariance willnot be detrimental tothepublicwelfareor injurious tootherpropertyinthevicinity.
3.In grantirig variances,theCouncil may requiresuch conditionsas willsecure,inso far
as practicable,theobjectivesoftherequirementvaried.Any varianceauthorizedshallbeenteredintheminutesoftheCounciltogetherwiththecircumstancesthatjustifythevariancegranted.
D.Upon receipt of a Planning Commission recommendation the Council at its next regularmeetingshallconsiderandadoptorrejectthePlanningCommission'srecommendation with
respect tothe variance application.
E.A preliminary short plat accompanied by an application for a variance shallnotbe approvedbythePlatAdministratoruntilsuchtimeastheCouncilapproves,conditionally approves,ordisapprovestheapplicationforavariance.Application fora variance totheprovisionsofthistitleshallconstituteapprovalinwritingbytheapplicantforasixty(60)day extension oftheshortsubdivisionpreliminaryplatapprovalperiodassetoutinSection17.13.030 (A9)ofthischapter.
F.Iftheshort plat has not been completed and has not been recorded and filedwith theGrantCountyAuditorwithintwelve(12)monthsofthedate of preliminary short plat approval,thevarianceshallbecomenullandvoid.Ifan extensionof thepreliminary short plat isgranted,
said variance shall run concurrently with the short plat extension.
17.13.070 Preliminary Short Subdivision Application ReviewProcedures:
A.Upon receipt of the short plat application,the Plat Administrator shall within the timelimitationsestablishedbyRCW58.17.140,respond totheapplicantin one of the following
manners:
1.Preliminary approval is granted as submitted.
2.Preliminary approval is granted with modifications requested.
3.The proposed subdivisionis denied and reasons stated.
4.Preliminary approval is withheld until PlanningCommissionand/orCouncilapprovalofdedicationsorvariancerequests.
B.The shortsubdivisionpreliminaryapplication shall require approvalofthePlat AdministratorandtheCityEngineerindicatedbytheirdatedsignaturesthereontobevalid.
C.The decision ofthePlat Administrator shallbefinal,unlessan appeal byany aggrievedpartyismadetothePlanningCommissionwithinten(10)calendardays ofthedate of decision of
the Plat Administrator.Said appeal shall be in writingto the Planning CommissionandsubmittedthroughtheCommunityDevelopmentDepartment.The Community Development
Department shallrecord and date the receiptof thatappeal.The Planning Commissionshallactonthatappealwithinforty(40)days unless an extensionis agreed to in writing by theapplicant.The decision ofthePlanning Commission shall be final and conclusive unless,
withinten (10)days,any aggrieved party files withtheFinance Director a written appeal.The
Council shall hear thatappeal withintwenty(20)calendar days of thedate of appeal.
D.Approval of the preliminary plat shall constitute approval for the applicant/subdivider todevelopconstructionplansandspecificationsforallfacilitiesandimprovementsandto
prepare the final plat
17.13,110 Final Short SubdivisionPlat Application:
A.General Requirements:
1.The finalshort subdivision applicationand plat willbe filedwith the Plat Administrator onformsprovidedbytheCommunityDeveloprnentDepartment.
2.AIIrequired street and utilityimprovements must be constructed by the applicant and
mustbe accepted by the City of Moses Lake or a subdivisionbond or other approvedsecurityshallbesubmittedinanamountsufficienttocoveronehundredandfiftypercent
(150%)of the estimated cost of completingall required utilityextensions and street
improvementsas determined by theMunicipalServices Director.UponcompletionoftherequiredpublicimprovementsandpriortoacceptancebytheCouncil,the subdivi-
der/developer must submit a maintenance bondor alternativesecurityapproved by theCityAttorneyinanamountdeterminedbytheCityEngineerandapprovedbythe
Municipal Services Director,The maintenance bond amount shall be one hundred
percent (100%)of theactual cost ofconstruction.An alternative security shall be in an
amount not less thanten percent (10%)nor morethan one hundred percent (100%)of
theactualcost ofconstruction.The amountshallbe determined on a case bycase basis
based uponthe City Engineer's estimated cost ofrepairor maintenance should repair or
maintenancebe required.The subdivider/developer shall submit documentationofthe
costofconstruction totheCityEngineer for his review and approvaland use in determin-ing therequired bond oralternativesecurity amount.Said bond shall be in effectfor one(1)year from thedate of acceptance.
3.The instrument ofdedication ofallstreets,right-of-ways,parks,playgrounds,easements,reservations,irrigation water right-of-ways,and any area tobe dedicated topublic use,togetherwith any restrictionsor limitations thereonshall be submitted as a part of thefinalplat.
4.The applicationshall be accompanied by thefollowing:
O a.A plat certificatefrom a titlecompany licensed todo business in theState of Wash-ington dated within thirty(30)days of thedate offilingofthefinal plat and applicationwiththePlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication.
b.A celtificate fromtheGrant CountyTreasurer indicating thatalltaxesand assess-ments ontheproperty includedinthefinal plat,subdivision,ordedicationhave beenpaidaccordingtotheprovisionsofRCW58.08.030 and RCW58.10.040 as nowenactedorhereafteramended.
c.A certificate fromthe city Finance Director indicating thatthereare no delinquentspecialassessmentsorliensonthepropertyincludedinthefinalplat,subdivision,ordedication.
d.A check payable tothecity in the amount of twohundreddollars ($200)to cover thecostofcheckingthefinalshortplat.
e.Allcovenants proposed to run with theland.
5.The final short plat[twelve(12)sets ofprintsplus the originaltracingand a reproduciblemylarcopy]shallinclude allitemsinSection 17.13.030 (B4)andany additional informa-tionand modifications requested inthepreliminaryapproval.Atthediscretion ofthePlatAdministrator,therequirementthattwelve(12)copies ofthefinal platbe submittedmaybewaived.Processing ofthefinal platmay require fewer thantwelve(12)copies.
The finalplat shall be prepared ina neatand legible mannerin black permanent drawinginkonmylardraftingfilm.Alldocuments,maps,and survey notes shallcontainthenameofthesubdivision,thename(s)of the subdivider(s),the name of the registered landOsurveyorresponsibletothesubdivider(s).The trimmedsize of thefinal plat shall beeighteeninches(18")by twenty-fourinches (24")with a oneand a halfinch (1½")marginonthetoporleftmarginandaonehalfinch(1/2")border on the remaining three(3)margins.The finalplat shallbe recordedontwo(2)or more sheets ifthescale necessarytoaccommodatethemaponone(1)sheet wouldundulycongest thedrawing.
6.The final short subdivisionplat shall be approved or disapproved within the timelimitationsestablishedbyRCW58.17.140 from thedate offilingofthefinal platwith thePlatAdministrator.This timeperiod shall be binding unless theapplicant consents to anextensionoftimeinwriting.
7.No final short subdivision plat may be approvedunless thecity makes a writtenfindingoffactthattheproposedsubdivisionisinconformancewithanyapplicablezoningordinances,or other land use controls which mayexist.
8.No final short subdivisionplat shall be approved for anysubdivisionwhich lies inwholeorinpartinanirrigationdistrictorganizedpursuanttoChapterRCWS7.03 unless therehasbeenprovidedanirrigationwaterright-of-waypursuant to RCW 58.17.310 as nowenactedorhereafteramended.
B.Specific Requirements:
1.The final plat shall clearlyshow thefollowing information:
a.The lines and names of allstreets or other public ways,parks,playgrounds andeasementsintendedtobededicatedforpublicuse,or granted for use of inhabitantsofthesubdivision.
b.The lines and names of all existingor platted streets or other publicways,parks,playgrounds and easements adjacent tothefinal plat,subdivision,or dedication,including municipal boundaries,townshiplines,and section lines.
c.The lengths and bearings of allstraight lines,curve radii,arcs,andsemi-tangents ofallcurves.
d.AIIdimensions along the lines ofeach lot,with thetruebearings and also any otherdatanecessaryforthelocationofanylotlinesinthefield.
e.Suitable primary control points,approved by the CityEngineer or descriptionsandtiestosuchcontrolpoints,towhich alldimensions,angles,bearings,and similardatagivenontheplatshallbereferred.
f.The location ofall permanent monuments.
g.The names of all subdivisions immediately adjacent thereto.
h.The date,truenorth point,scale,datum plane,and date of survey.
i.The boundary ofthetract,thecourses and distances marked thereon,as determinedbyafieldsurveymadebyaregisteredandqualifiedlandsurveyorofthestateandtoclosewithanallowableerrornottoexceedonefoot(1')in five thousandfeet(5,000')and notto exceed one foot (1')in tenthousand feet (10,000')intheCentralBusinessDistrict,
j.The elevationsofallpermanentmonumentsbased ona datum plain approvedby theCityEngineer.
k.A vicinity sketch map of not more than four hundred feet (400')tothe inch.ExceptthattheCityEngineer,subjectto a request prior to plat submittal,may approve analternativevicinitymapscaleexceedingfourhundredfeet(400')totheinch.
I.Street names,
m.Certification by registered land surveyorofaccuracy of plat and survey.
n.Statement by ownerdedicating streets,right-of-ways,and any sites for public use.
o.Location and dimensions of all irrigation water right-of-ways.
p.Provide legal descriptionof the plat boundaries.
2.All linear dimensions shall be given in feet and decimals of a foottothenearest hun-dredth.
3.The scale of thefinalplat shall be not more thanone hundred feet (100')to the inch.
Except that the City Engineer,subject toa request priortoplatsubmittal,mayapproveanalternativeplatmapscalenottoexceedonehundredfeet(100')to the inch.
4.Ifthe plat constitutes a replat,the lots,blocks,streets,etc.,of the original plat shall be
shownby dotted lines intheirproper positions in relation tothenew arrangement of theplat,the new plat being so clearly shown in solid lines as toavoid ambiguity.
5.The final plat shall be accompanied by improvement plans and specificationsincludingutilities,streets,grades,and appurtenances as provided for in Section 17.13.100,
improvements.
6.The subdivider'sland surveyorshallset all requiredmonumentsand shallstake all lot
corners as shown on thefinal plat before theplatis submittedforfinal approval.
7.The final plat shall contain the legal description of the subdivisionand the following
dedication,acknowledgment,andendorsement statements shall appear inthefollowing
sequence in black permanent ink either by hand or mechanical device:

17.13.120 Final Plat Review Procedure:
A.Upon receiptofthefinalsubdivision application and plat,the Plat Administrator shall,withintwo(2)workingdays of receipt,distributecopies to all offices,departments,and agenciesreceivingthepreliminaryplat.Each office,department,or agency shall file writtenrecommendationswiththePlatAdministratorwithinfifteen(15)calendar days from thedateoffilingofthefinalplatwiththePlatAdministrator.Ifany such office,department,oragencyfailstofileawrittenrecommendationwithinthetimelimitation,itmay be presumed thatsuchoffice,department,or agency has no recommendation.
Alloffices,departments,and agencies issuing recommendations forfinal plat approval shallnotmodifythetermsofpreliminaryplatrecommendationswithoutthewrittenconsentofthesubdivider.
B.Within fifteen (15)days of filingof thefinal plat theCity Engineer shall review thefinal platandsubmittothePlatAdministratorawrittenreportwithrespecttothefollowingconditions:
1.Thatthe proposed final platbears the required certificates and statements of approval.
2.That a titlereport furnished by the subdividerconfirmsthe titleof the land and theproposedsubdivisionisvestedinthenameoftheownerwhosesignatureappearsontheplatcertificate.
3.Thatthe facilitiesand improvements requiredtobe provided by thesubdividerhave beenOcompletedoralternativelythatthesubdividerhassubmittedwiththeproposedfinalplataperformancebondorothersecurityinconformancewithSection17.13.100 of thischapter.
4.That the plat is technicallycorrectas certified by theland surveyor responsible for theplat.
C.Within fifteen (15)days offiling of the final plat,the Grant County Health District or other
agency furnishing sewage disposal and supplying water shall review thefinalplat and submittothePlatAdministratorawrittenreportrecommendingapprovalordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofsewagedisposalandwatersupply.
D.Within fifteen (15)days of filingof thefinal plat the appropriate irrigation district serving orfromwhichtherealproperlyisentitledtobeservedwithirrigationwatershallreviewthefinal
plat and submit to the Plat Administrator a written report recommending approval ordisapprovalofthefinalplatastotheadequacyoftheproposedmeansofthedeliveryofirrigationdistrictentitlementwaterandastotheadequacyoftheproposedmeansofremovalofirrigationwastewater.
E.Final Plat Approval:
1.The Plat Administrator shall approve ordisapprove thefinalplatwithinthetimelimitations
established by RCW 58.17.140,unless thesubdividerconsents to an extensionof thattimeperiodinwriting.
2.If the Plat Administrator finds that the subdivisionproposed for final plat approvalconformstoalltermsofthepreliminaryplatapproval,therequirements of RCW Chapter
58.17,other applicablestate laws,and any other requirements,the Plat Administratorshallapprovethefinalplat
3.The decision ofthe Plat Administrator shallbe final,unless an appeal by any aggrieved
partyis made tothe Planning Commission within ten(10)days ofthedate ofdecision ofthePlatAdministrator.Said appeal shall be in writing tothe Planning CommissionandsubmittedthroughtheCommunityDevelopmentDepartment.The Community Develop-
ment Department shall date and record the receipt of said appeal.The PlanningCommissionshallactonthatappealwithinforty(40)calendar days unless an extension
is agreed to inwriting by theapplicant.The decision of thePlanning Commission shallbefinalandconclusiveunless,within ten (10)days,any aggrieved party fileswith theFinanceDirectorawrittenappeal.The Councilshall hear that appeal withintwenty(20)days ofthedate ofappeal.
4.Acertificateofoccupancy shallnotbe issued untilthefinalshort plathas been recorded
with theGrantCountyAuditor.

B.The Plat Administrator shall transmit the originalmylarplat to theCountyAuditor for final
filing.One reproducible copy shall be forwarded with the original to be confirmedandreturnedtotheCityEngineerfortheCityEngineer's record.One paper copyshall be filed
with the County Assessor.
Section 2.The City Council declares thatan emergency exists and this ordinance shall takeeffect asprovidedbylawupononereadingif2/3 oftheentire City Council present vote in favor of passage.
