1898_00001ORDINANCE NO.1898 ANORDINANCE AMENDINGCHAPTER 17.17 OF THE MOSES LAKEMUNICIPALCODEENTITLED"MAJOR SUBDIVISIONS" THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN ASFOLLOWS: Section 1.Chapter 17.17 oftheMoses LakeMunicipal Code entitled"Major Subdivisions"is amended asfollows: 17.17.030 Preliminary Plat Conditionsand Requirements: A.General Conditions and Reauirements: 1.The subdivision shall make adequate provisionfor roads,streets,curbs,gutters,sidewalks,street lightingcircuits,alleys,theextensionofmunicipal utilities (sewerandwater),irrigationwater right-of-ways,drainage ways,other public ways,publicaccess,or any municipal improvements as deemed necessary inconformancewithCommunityStreetandUtilityStandardsandcityDesignStandardsineffectatthetimeofplatapproval. 2.The subdivisionshall front on a existing street There shall be adequate access to allparcels.Streets shall be improved tocitystandards.Street lightingshall be provided. 3.The subdivision shallcomplywithallzoningand health regulations. 4.The subdivisionshall be consistent with the city'sComprehensivePlan. 5.The subdivision shall provide for irrigation water right-of-ways pursuant toRCW58.17.310 as now enacted or hereafter amended. 6.A street lighting plan as may be requiredby the CityEngineer must be provided.TheplanmustbeapprovedbytheGrantCountyPUDandincludecertificationthatallstreetlightingfeeshavebeenpaidorthatarrangementsacceptabletothecityandthePUDhavebeenmadeforthepaymentoftherequiredfees. 7.Environmentalinformationshall be prepared and submitted in accordance with theguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended.Said information is a part of and must accompany thepreliminaryplat application. O 8.Unless an applicant for a preliminary plat approvalrequests otherwise,and the PlatAdministratoragrees,a preliminary plat shall be processed simultaneously withtheapplicationforrezones,variances,plannedunitdevelopments,site plan approvals,andsimilarquasi-judicial oradministrativeactions totheextent thatprocedural requirementsapplicabletotheseactionspermitsimultaneousprocessing. 9.Everydecision or recommendationmade under thischapter bythe Council or PlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation. 10.Preliminary plats of any proposed subdivision and dedication shall be approved,disapproved,or returned totheapplicantformodification within ninety (90)days fromthedateoffilingunlesstheapplicantconsentstoanextensionofsuchtimeperiod;Pro-vided,that if an EnvironmentalImpact Statement is required as provided in RCW43.21C.030,the ninety (90)day periodshall not include thetimespent preparing andcirculatingtheEnvironmentalImpactStatementbythelocalgovernmentalagency. 11.A platcertificate from a titlecompanylicensed todo business intheState ofWashingtondatedwithinthirty(30)days of the date offilingofthe final plat and application withthePlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameoftheownerssigningthesubdivisionplatorinstrumentofdedication. B.Specific Conditionsand Requirements: 1.Prior tosubmissionofa majorsubdivision preliminary applicationand preliminary plat,the subdivider or the subdivider's representative shall schedule a pre-applicationconferencewiththePlatAdministratorandrepresentativesofotheraffectedcitydepart-ments.Thesubdivider shallpresenta conceptual idea ofthe plat.The Plat Administrator O and representatives of affected citydepartments willrespond informally and addresspotentialitemsofconcernorclarificationtoaidthesubdividerinpreparingthemajorsubdivisionpreliminaryapplicationandpreliminaryplat. 2.The preliminary major subdivision application and plat shall be filed with the PlatAdministratoronformsprescribedbytheCommunityDevelopmentDepartment.Saidapplicationshallbeaccompaniedbytwelve(12)copies ofthepreliminary plat. 3.The preliminaryplatshall be a neat and accurate drawing,stamped and signed by aregisteredprofessionallandsurveyorlicensedbytheStateofWashingtononreproduc-ible material at a decimalscale.The plat map shallmeasure eighteen inches (18")bytwenty-fourinches (24").The preliminaryplatshallbe drawn inblack permanent inkontwo(2)ormoresheets ifthescale necessary toaccommodate themaponone (1)sheetwouldundulycongestthedrawing. 4.A non-refundable fee offive hundred dollars ($500)shallaccompany each and everyapplicationforapreliminarymajorsubdivision. 5.The subdivider shall submit a list ofthe names and addresses ofall owners of record ofpropertywithinthreehundredfeet(300')oftheexternal boundaries of the proposedsubdivision.Inaddition,thesubdividershall submit a list of thenames and addressesofallownersofrecordofrealpropertywithinthreehundredfeet(300')of real propertywhichliesadjacenttotheexternalboundariesoftheproposedsubdivisionandisownedbythesubdivider. 6.The preliminary plat shall contain the following: a.Name ofproposed subdivision. b.Boundaries of proposed subdivision established bythe preliminary survey, c.Location anddimension ofallexistingand proposed streets,alleys,utilities,andright-of-ways and/or easements on and adjacent to the proposed subdivision. d.Location and dimensions ofallexistingand proposed irrigation water right-of-ways on and adjacent totheproposed subdivision. e.Legal description ofland within theproposed subdivision. f.Any proposed land dedications. g.Name,address,and seal of the registered land surveyor who made thepreliminary survey. h.The date ofthepreliminarysurvey. i.Horizontal scale oftheproposed platshall be no morethanone hundred feet (100')totheinch.Except thattheCityEngineer,subjecttoa request priortoplatsubmittal, mayapprove an alternativeplat map scale nottoexceed one hundred feet (100')totheinch. j.Monuments foundand established duringthepreliminarysurvey. k.Date mapis prepared,scale,and north pointof themap.Approximate proposed lotlineswiththeirdimensions,including lot numbersand blocknumbers.OI.If any of the parcels can be further divided or ifonly a portion of a tractis being divided,location offuture streets,alleys,and lot lines shall be shown by dotted lines. m.A vicinity map at a scale ofnot more than four hundred feet (400')tothe inch.ExceptthattheCityEngineer,subjectto a request prior to plat submittal,may approvean alternativevicinity map scale exceedingfour hundred feet (400')totheinch.The vicinity map shall show alladjacentparcels.Itshallshowhow thestreetsandalleysintheproposedsubdivisionmayconnectwithexistingand proposed streetsand alleysin neighboringsubdivisionsor unplattedpropertytoproduceanadvantageousdevelopmentoftheentireneighborhood. n.Provide recommended street names for approval. o.United States Bureau of Reclamation horizontal and vertical data including bench marks. p.A site plan on a separate sheet showing the following information: 1)Location and sizing of existing and proposed utilities including water,sewer,storm drains,electricity,street lighting,and gas,telephone,cablevisionlines,and curb and sidewalk.Minimumsize and scale shall be thesame as the preliminary plat map. 2)Existing andproposed structures and natural features and allproposed improve- ments within and adjoiningthe proposed subdivision. 3)Topography of thearea with a maximumoftwofoot (2')intervals of contours asrequiredbytheCityEngineer. 4)Present zoning classificationon and adjacent to property, 5)Any proposed dedications for parkland subject to theapprovalofthePlanning Commission. 6)Name(s)of owner(s)of the proposed subdivision, q.Anydeed restrictions or covenants existingor proposed shall be drawn on the site planand preliminaryplatmap. 17.17.040 Referral toOtherDepartments,Agencies,and Offices: A.Upon receiptofa complete and satisfactorypreliminary plat application,thePlat Administra-torshalldistribute copies ofthepreliminary plat toeach ofthefollowingoffices,departments, or agencies within two(2)working days from receipt: 1.Public UtilityDistrict 2.Gas Company 3.Telephone Company 4.EngineeringDivisionoftheMunicipalServices Department (threecopies) 5.Fire Department 6.Building Divisionof theCommunity Development Department 7.Grant County Health District 8.Any irrigation district withjurisdiction 9.Grant County Assessor 10.CommunicationsCompany B.The Plat Administrator shall further notifythe Police Department,Park and RecreationDepartment,and CityManager thata preliminary plathas been received. C.Notice of thefilingof a preliminary plat of a proposed subdivision located in the city andadjoiningthemunicipalboundariesthereofshallbegiventotheGrantCountyPlanningDepartment D.Notice ofthefilingofa preliminary platof a proposed subdivision located adjacent totheright-of-way of a state highway shall be giventotheState Department of Highways. E.Each office,department,oragency shallfilewritten recommendationswiththePlat Admini-strator withinfifteen (15)calendar days fromthedate of filingofthe preliminaryplatandapplicationwiththePlatAdministrator.Ifany such office,department,or agencyfailstofileawrittenrecommendationwithinthetimelimitation,it may be presumed thatsuch office,department,oragency has no recommendation. F.Ifthe preliminary plat is found tobe unacceptable,a certifiedletter shall be mailedtothesubdividerwithinthetimelimitationsestablishedbyRCW58.17.140. O G.The Plat Administrator may determine thata meeting shall be held to resolvemajorissuesidentifiedasaresultoftherecommendationsofotheroffices,departments,or agencies.Such meetingshall be attended by those offices,departments,oragencies responsible fortherecommendationsandmustincludetheapplicantandthePlatAdministrator.The pro-caedings and results ofthemeeting shall be documented byminutes. 17.17.080 Planning Commission Action: A.The Plat Administrator shall transmitthe application,the plat,respective comments andrecommendationsfromotherofficesandagencies,commentsand recommendations fromcitydepartments,and Community Development Divisien-Deoartment comments andrecommendationstothePlanningCommissionpriortothehearing. B.The Planning Commission shall review the preliminary plat,municipal recommendations,testimony,and exhibits submittedat thehearing andmakerecommendations thereontotheCounciltoassureconformanceoftheproposedsubdivisionwiththeComprehensivePlan,Zoning Ordinance,CommunityStreet and UtilityStandards,and cityDesign Standards.ThePlanningCommissionshallrecommendtheCouncilapprove,conditionally approve,ordisapprovethepreliminaryplat. 17.17.130 Final MajorSubdivision Plat Application: A.General Requirements: 1.The final majorsubdivision application and plat willbe filedwiththePlat AdministratoronformsprovidedbytheCommunityDevelopmentDepartment. 2.Allrequired street and utilityimprovements mustbe constructed by the applicant andmustbeacceptedbythecityorasubdivisionbondorotherapprovedsecurityshallbesubmittedinanamountsufficienttocoveronehundredandfiftypercent(150%)of theestimatedcostofcompletingallrequiredutilityextensionsandstreetimprovementsasdeterminedbytheMunicipalServicesDepartment.Upon completion of the requiredimprovementsandpriortoacceptancebytheCouncil,the subdivider/developer mustsubmitamaintenancebondoralternativesecurityapprovedbytheCityAttorneyinanamountdeterminedbytheCityEngineerandapprovedbytheMunicipalServicesDirector.The maintenance bond amountshall be one hundred percent (100%)of theactualcostofconstruction.An alternativesecurityshallbe in an amountnot less thantenpercent(10%)nor more than one hundred percent (100%)of the actual cost ofconstruction.The amount shallbe determined on a case bycase basis based upon theCityEngineer's estimated cost of repairor maintenance should repair or maintenanceberequired.The subdivider/developershall submit documentation of the cost ofconstructiontotheCityEngineerforhisreviewandapprovalanduseindeterminingtherequiredbondoralternativesecurityamount.Said bond shall be in effect forone (1)year from thedate ofacceptance. 3.Required dedication of all streets,right-of-ways,parks,playgrounds,easements,reservations,irrigationwater right-of-ways,and anyarea tobe dedicated to public use,togetherwith any restrictionsor limitations thereonshall be submittedas a part ofthefinalplat. 4.The applicationshallbe accompaniedby the following: a.A plat certificate from a titlecompany licensed to do business intheState ofWash- ington dated withinthirty(30)days ofthedate offilingofthefinal plat and application with the Plat Administrator confirming thatthe titleof the lands as described and shown on the plat is in the name of the owners signing the subdivisionplat orinstrumentofdedication. b.A certificatefrom the Grant County Treasurer indicating thatalltaxesand assess-ments on theproperty included inthefinalplat,subdivision,or dedication have beenpaidaccordingtotheprovisionsofRCW58.08.030 and RCW 58.10.040 as nowenactedorhereafteramended. c.A certificatefrom the city Finance Directorindicating thatthereare no delinquent specialassessments or liens on the property included inthefinal plat,subdivision,ordedication, d.Acheck payableto the cityinthe amountoffour hundred dollars ($400)tocover thecostofcheckingthefinalplat. e.Allcovenants proposed to run withthe land. 5.The final major plat (twelvesets of prints plus theoriginaltracingand a reproduciblemylarcopy)shallincludeallitems in Section17.17.130 Band anyadditionalinformation and modifications requested inthepreliminary approval.The finalplat shall be prepared ina neat andlegible mannerin black permanent drawing inkon high grade tracingcloth or drafting film.AIIdocuments,maps,and surveynotes shall contain thename ofthe subdivision,thename(s)ofthesubdivider(s),thename of theregistered land surveyorresponsibletothesubdivider(s).The trimmedsize of the final plat shall be eighteeninches(18")bytwenty-fourinches (24")with a one and a half inch(1½")marginon thetoporleftmarginandaonehalfinch(½")border on the remainingthree(3)margins.The final plat shall be recorded on two(2)or more sheets if the scale necessary toaccommodatethemaponone(1)sheet would unduly congest the drawing. 6.The final major subdivisionplat shall be approved or disapproved within the timelimitationsasestablishedbyRCW58.17.140. 7.Nofinal major subdivision plat may be approved unless the citymakes a writtenfinding of fact that the proposed subdivisionis in conformancewith any applicable zoning ordinances,or other land use controlswhichmay exist 8.No finalmajorplatshall be approved for any subdivision which lies in whole or in part inan irrigation district organized pursuantto Chapter RCW87.03 unless therehas been provided an irrigationwater right-of-way pursuant toRCW58.17.310 as now enacted orhereafteramended. B.Specific Reguirements: 1.The final platshall clearly show the following information: a The lines and names of all streets or other public ways,parks,playgroundsandeasementsintendedtobededicatedforpublicuse,or granted for use ofinhabitantsofthesubdivision. b.The lines and names of allexistingor platted streets or other publicways,parks, playgrounds and easements adjacent to the finalplat,subdivision,or dedication, including municipalboundaries,townshiplines,and section lines. c.The lengths and bearings of all straightlines,curve radii,arcs,and semi-tangentsof all curves. d.Alldimensions along thelines ofeach lot,with the truebearings and also any otherdatanecessaryforthelocationofanylotlinesinthefield. e.Suitable primary controlpoints,approved by theCity Engineer or descriptions and tiestosuchcontrol points,towhich all dimensions,angles,bearings,and similar data givenon the plat shall be referred. f The location ofallpermanent monuments, g.The names of all subdivisions immediately adjacent thereto, h.The date,true north point,scale,datum plane,and date of survey. i.The boundaryofthetract,thecourses and distances markedthereon,as determined by a field survey made by a registered and qualified land surveyorof thestate and to close withan allowableerror not to exceed one foot(1')in five thousandfeet (5,000')and not to exceed onefoot(1')in terithousandfeet (10,000')in the Central Business District j.The elevations ofallpermanent monumentsbased on a datum plainapproved bytheCityEngineer. k.Avicinitysketch mapofnot more thanfourhundred feet(400')totheinch.ExceptthattheCityEngineer,subjecttoa request prior toplat submittal,may approve analtemativevicinitymapscaleexceedingfourhundredfeet(400')totheinch. I.Street names. m.Certification by registered land surveyorofaccuracy of plat and survey. n.Statement by ownerdedicating streets,right-of-ways,and anysites for public use. o.Location and dîmensions ofallirrigation water right-of-ways. p.Provide legal descriptionoftheplatboundaries. q.Provide block and lotlocations including dimensions and number designations. 2.AIIlinear dimensions shallbe given in feet and decimals ofa foot to the nearest hun-dredth. 3.The scale of thefinal platshall be notmore thanone hundred feet (100')tothe inch.Except thattheCity Engineer,subject toa request prior toplat submittal,may approveanalternativeplatmapscalenottoexceedonehundredfeet(100')totheinch, 4.Ifthe platconstitutesa replat,thelots,blocks,streets,etc.,oftheoriginalplat shall beshownbydottedlinesintheirproperpositionsinrelationtothenewarrangementoftheplat,thenew platbeing so clearlyshownin solidlines as toavoid ambiguity. 5.The final platshall be accompaniedbyimprovementplansand specificationsincludingutilities,streets,grades,and appurtenances as provided for in Section 17.17.120,Improvements. 6.The subdivider's land surveyor shall set all required monuments and shall stake all lotcornersasshownonthefinalplatbeforetheplatissubmittedforfinalapproval. 7.The final plat shall contain the legal descriptionof the subdivisionand thefollowingdedication,acknowledgment,and endorsement statements shallappear inthefollowing Dedication sequence in black permanent inkeither by hand or mechanicaldevice: The owner of the land described herein in fee simple is and .Theowner declares thisplatand dedicates tothepublic forever,allstreets,roads,alleys,easements orwhatever publicproperty thereis shownthereonfor any and allpublic purposes notinconsistentwiththeusesshownonthisplat Dated Signed Acknowledqment State of WashingtonCountyofGrant Icertifythat I know or have satisfactoryevidence that signed thisinstrument andacknowledgedittobehis/her freeand voluntaryactfortheuses and purposes mentionedin theinstrument Dated Signature of Notary PublicMyappointmentexpires Surveyor's Certification and Declaration Ihereby certifythat thisplat is a trueand correct representation of thelands actuallysurveyed.O IHEREBYDECLARE thattheplatof is based onactual surveyand subdivi-sion of a portion of Section Township _North,Range East,W.M.,thatthe distances andcoursesandanglesareshownthereoncorrectlytothebestofmyknowledge,information,and belief;andthatpropermonumentshavebeensetandlotcornersarestakedontheground. Section 2.The City Council declares thatan emergency exists and this ordinance shall take effect immediately as provided by law upon one reading if2/3 of the entire City Council present vote in favor of passage.
