ANORDINANCEAMENDINGCHAPTER 18.67 OFTHE MOSESLAKEMUNICIPALCODEENTITLED"PLANNED DEVELOPMENT DISTRICT ZONE"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAIN AS FOLLOWS:
Section 1.Chapter 18.67 oftheMoses Lake Municipal Code entitled"Planned Development District Zone"is amended as follows:
18.67.030 General Planned Development District Application Requirements:
A.Pre-Application Conference:
1.Prior tosubmissionofa planneddevelopment districtapplicationand map(s),thepropo-nent shall schedule a pre-application conference with the CommunityDevelopmentDirectorandrepresentativesofotheraffectedcitydepartments.The proponent shallpresentaconceptualplanoftheplanneddevelopmentdistrictincludingageneraloutlineoftheproposalrepresentedbysketchplans.The Community DevelopmentDirector willrespondinformallyandaddresspotentialitemsofconcerntoaidtheproponentinpreparingtheplanneddevelopmentdistrictapplicationandmap(s).
2.The Community Development Director shall furnishthe proponentwitha written review oftheconferenceregardingtherelationshipoftheplanneddevelopmentdistricttotheComprehensivePlanandanyapplicablecityzoningordinances,design standards,andpolicies.
B.Studv Session:Prior tothesubmissionofthe planned developmentdistrictapplicationandmap(s)tothePlanning Commissionfor action,theCommunity DevelopmentDirectorshallscheduleaPlanningCommissionstudysession.The CommunityDevelopment Director andtheplanneddevelopmentdistrictproponentshallpresenttheconceptualplanneddevelopmentdistricttothePlanningCommissionsothatthePlanningCommissionmaystudytheproposal.
C.Planned Develooment District Application and Mans;The planned development districtapplicationandmap(s)shall be filedwiththe CommunityDevelopment Department on formsprescribedbytheCommunityDevelopmentDepartment.The applicationshall be accompa-nied byeleven(11)copies oftheplanneddevelopment district applicationand map(s).A non-refundable fee oftwohundreddollars ($200)shallaccompany each and everyapplicationforapreliminaryplanneddevelopmentdistrict
D.EnvironmentalInformation:Environmentalinformation shall be prepared and submitted inaccordancewiththeguidelinesestablishedundertheStateEnvironmentalPolicyActof1971,as amended and Chapter 14.04 oftheMoses Lake MunicipalCode entitled"EnvironmentalRegulations."Said information is a part ofand must accompany theplanned developmentdistrictapplicationandmap(s).
E.Variance(s):Requests for variance(s)of cityDesign Standards and Community Street andUtilityStandardsshallbesubmittedasapartofandmustaccompanytheplanneddevelop-ment district application and map(s).The Planning Commissionshall recommend to theCouncilthattherequestedvariance(s)beeitherapproved,conditionally approved,ordenied.The Councilshalleither approve,conditionallyapprove,or deny the requested variance(s)based uponthe recommendation ofthePlanning Commissionandtestimonypresented beforetheCouncil.
Variance(s)of city Design Standards and Community Street and UtilityStandards shall belistedintheordinanceconditionallyapprovingandestablishingtheplanneddevelopmentdistrict.
F.Comprehensive Plan:The planned development district shall be consistent with the city'sComprehensivePlan.
G.Findings ofFact:Every decision orrecommendation made underthischapter by the PlanningCommissionorCouncilshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedecisionorrecommendation.
H.Subdivision Approval:Aplanned developmentdistrictfor whichsubdivisionor bindingsiteplanOapprovalisrequiredmaybesubmittedasaPlannedDevelopmentDistrictShortPlat,aPlannedDevelopmentDistrictMajorPlat,ora Planned DevelopmentDistrict Binding Site Plan.Such a planned development district shallbe submitted and processed inconformance withtheappropriatesubdivisionchapteroftheMosesLakeMunicipalCodeandtherequirementsofthischapter.Redundantprocedures or technicalrequirements shall be incorporated intotherequirementsandproceduresoftheappropriatesubdivisionchaptersoastonotcreateunnecessaryhardshipordelay.Procedurally thepreliminary and finalplanned developmentdistrictelementofaPlannedDevelopmentDistrictShortPlat,Major Plat,or Binding Site PlanmustbeapprovedbytheCouncilpriortotherequiredsubdivisionapprovals,Such approvalsmaybegivenconcurrentlybytheappropriateapprovingbody.
I.Titles:Planned development districts shall be appropriately entitled,i.e.Planned UnitDevelopmentDistrict,Planned Unit ResidentialDevelopmentDistrict,Planned CommercialDevelopmentDistrict,or Planned Industrial Development District
18.67.060 Referral to Other City Departments:
A.Upon receipt of a complete and satisfactory preliminary planned development districtapplicationandmap(s),the CommunityDevelopmentDirectorshall distributecopies of thepreliminaryplanneddevelopmentdistricttoeachofthefollowingoffices,departments,oragencieswithintwoworkingdaysofreceipt:
1.Public Works Divisionofthe Municipal Services Department
2.Fire Department
3.PoliceDepartment
4.Building Divisionof theCommunity Development Department
5.Park and Recreation Department
6.PUD
7.Gas Company
8.Telephone Company
9.Cable Company
B.Each department,office,or agency may filewrittenrecommendations with the Community
Development Director within fifteen(15)days from the date of filingof theplanned develop-
ment district with the Community Development Department.
C.The Community Development Director may determine thata meeting shall be held toresolvemajorissuesidentifiedasaresultoftherecommendations.The proceedingsand resultsofsuchameetingshallbedocumentedbyminutes.
18.67.070 Planning CommissionPublic Hearing:When the Community Development Director determines
thatthe completedplanned development district application and map(s)isacceptable theDirector
shall set a date for a public hearing on the planned developmentdistrict before the Planning
Commissionnot less thantwenty(20)days nor more thanforty-five (45)days afterthe receiptof
thecompletedplanned developmentdistrictapplication.
18.67.080 Notice of Public Hearing:The CommunityDevelopment Director shallgive noticeofthe time,location,and purposeofthepublichearing in thefollowingmanner:
A.At least one public notice shall be published notless thanten(10)days prior tothehearing in
a newspaper of general circulation within thecityand thearea wherethe realproperty that is
proposed for the planned development district is located.
B.Three (3)notices shall be posted on or adjacent to the land proposed for a planned develop-
ment district at least ten (10)days prior tothepublichearing date.
C.One (1)noticeshallbe mailed toeach ownerofpropertywithinthree hundred feet (300')ofthepropertyproposedforaplanneddevelopmentdistrictatleastten(10)days prior tothepublic
hearing.
D.Ifthe owner of thereal property which is proposed for a planned development district ownsanothertractoflandwhichliesadjacenttotherealpropertyproposedforaplanneddevelop-
ment district,one (1)notice shall be mailed to each owner of real properly located within threehundredfeet(300')of any portion ofthe boundaries of such adjacent located parcels of real
property.
18.67.090 Planning Commission Action:
A,The Community Development Director shall transmit the planned development district
application and map(s),respective comments and recommendations from other offices,
agencies,and city departments,and CommunityDevelopment Department comments and
recommendations tothePlanningCommission priortothe hearing.
B.The Planning Commission shall review the planned development district application and
map(s),municipal recommendations,testimony,and exhibits submitted at the hearing and
make recommendations to the Council to assure conformance of the proposed planned
development district with the provisionsofthis chapter and a determination that:
1.The planneddevelopment district shallbe compatiblewithnearby developments anduses.
2.Peripheral treatmentinsures propertransitionbetween planned development district uses
and nearby externaluses and developments.
3.The development willbe consistent withtheComprehensive Plan and withthepurpose of
a planneddevelopment district.
4.The planned developmentdistrict can be completedwithina reasonable periodoftime,
C.The Planning Commission shall recommend thatthe Councilapprove,conditionallyapprove,ordisapprove an ordinanceproviding for theestablishment ofa planned development district.
18.67.100 Preparation of the Planned Development District Ordinance:
A.Upon Planning Commission review of a planned development district application and map(s),theCommunity Development Director shallprepareanordinanceproviding forthedesignationofthesubjectpropertyasaplanneddevelopmentdistrict.That ordinance shallestablish theplanneddevelopmentdistrictasafloatingdistricttobesuperimposedovertheexistingzoneandprovideforspecificmodificationsofthebulkanduseregulationsandperformancestandardsasprovidedforintheordinance.The ordinance shallspecifythespecific modifica-tionsto the underlyingzone3 bulk regulationsand performancestandards.The ordinanceshallprovidethattheapplicantortheapplicant's successor in interest shall be bound totheusesandmodificationsspecifiedintheordinance.
B.The ordinanceproviding forthe designation ofthe subject property as a planned developmentdistrictshallconditionallyapprovethepreliminaryplanneddevelopmentdistrict.The ordinanceshallonlyconferdevelopmentrightsupontheapplicantortheapplicant'ssuccessorin interest
upon the submission and approval of a finalplanned development district application andmap(s)whichshallbe in substantial conformitywith the preliminaryplanned developmentdistrictapplicationandmap(s).Approval for the applicanttoproceed withconstructionshallbecontingentuponreceiptandapprovalbytheCityCouncilofafinalplanneddevelopmentdistrictapplicationandmap(s).
18.67.120 Final Planned Development District Application and Map(s):Upon preliminary planneddevelop-ment district approval,theapplicantshall prepare a final planned development district applicationandmap(s)as needed.
The final application and map(s)shallbe prepared insubstantial compliancewiththeapprovedpreliminaryplanneddevelopmentdistrictapplicationandmap(s);containor depict allinformationrequiredinthepreliminaryapplicationandmap(s);andshallincorporate any changes requiredbytheCouncilingrantingpreliminaryplanneddevelopmentdistrictapproval.
Preliminary map(s),ifsuitable,may be submitted as final map(s)withthefinalapplication iftheyaretobeunalteredorareabletobealteredtosatisfythefinalplanneddevelopmentdistrictmap(s)requirements.
In addition,the final planned development district applicationand map(s)shall contain and/ordepictthefollowinginformation:
A.A titlereportfroma titlecompany licensed todo business intheState ofWashingtondatedwithinthirty(30)days ofthe date of filingofthe final planned development district applicationandmap(s)confirmingthatthetitleof the lands described and shown ontheapplicationand/ormap(s)is in the name oftheowners signing theplanned development district applicationandmap(s)and/orinstrument of dedication.
The holder of the owner's power-of-attorney may sign the planned development districtapplicationandmap(s)and/or instrumentof dedication providedthat the titlecompanyconfirmsthatthepersonsigningthedocumentsisinfacttheholderoftheowner's power-of-attorneyand that titletothe land is in thename ofthe person granting power-of-attorney.
B.Three (3)complete sets of preliminary construction plans and specificationsprepared by aprofessionalengineerlicensedbytheStateofWashingtonshowingallstreetandutilityim-provements required by the Council in granting planneddevelopmentdistrictapproval.AIIconstructionplans and specifications shall be in confor-mance withcitydesign standards and thecommunitystreetand utilitystandards.ConstructionplansandspecificationsmustbeapprovedbytheCityEngineerpriortothesubmissionofthefinalplannedDevelopmentDistricttotheCouncilforapproval.
1.Preliminary constructionplans and specificationsshallbe submitted in compliancewithChapter17.17.120 (Aand B)oftheMosesLake Municipal CodeentitledMajorSubdivision,subsection Improvements.
C.Required dedication ofallstreets,rights-of-way,parks,playgrounds,easements,reservation,irrigation water rights-of-way,and any area to be dedicated to public use,togetherwithanyrestrictionsorlimitationsthereonshallbesubmittedforCouncilapprovalandacceptanceasapaitofthefinalplanneddevelopmentdistrictplanmap(s)or as a separate instrument ofdedication.
D.AIIcovenants proposedto run with the land.
E.Anon-refundablefee oftwohundredand twenty-fivedollars ($225)shall accompany each andeveryapplicationforafinalplanneddevelopmentdistrictapproval.
18.67.130 Planninq CommissionAction:Withinforty-five(45)days offilingofthecomplete and satisfactoryfinalplanneddevelopmentdistrictapplicationandmap(s)with the CommunityDevelopmentDepartment,theCommunity Development Directorshall set a date for Planning Commissionreviewofthefinalplanneddevelopmentdistrictapplicationandmap(s).ThePlanning Commission
shall review thefinalplanned development district application and map(s)as tocompliance withalltermsofthepreliminaryapprovalandshallrecommendtotheCouncilthatsaidplanned
development district be approved or disapproved.
18.67.180 Extension of Bond or Security Time Limit
A.The council may grant one (1)extension of any performance bond or approved security
required by thischapter not toexceed one(1)year providedthattherequest for an extension
isfiledwiththeCommunity Development Director at least sixty (60)days priorto theexpirationdateofthebondorsecurity.
B.In the event that a time extension is granted,a new performance bond or other approved
securityshall be submitted in an amount sufficientto cover one hundred and fiftypercent(150%)ofthe costofcompletingutilityand street improvements orlandscaping improvements.The bond willbe updated with new estimates of cost on all uncompleted improvements andallincreasedcostsshallbepassedontothebond.
C.Departments issuing recommendations fornewperformance bonds orapprovedsecurityshallnotmodifythetermsandrequirementsofthebondorsecurityotherthantopassonallincreasedcostestimatesasdeterminedbytheMunicipalServicesDirectortothebondorsecuritytocoverthecostofcompletingutilityandstreetimprovementsand/or landscaping
.improvements withoutthewrittenconsent oftheapplicant
18.67.210 Changes and Modifications:
A.Majorchanges intheapproved finalplanned development district shall be consideredas a newapplicationforpreliminaryplanneddevelopmentdistrictapproval.Majorchanges include,but
are not limited to,the following:
1.Change in use.
2.Major change in vehicularcirculationsystem.
3.Increase indensity or relocationofdensity pattern.
4.Change in exterior boundaries except survey adjustments.
5.Increase in building height.OB.The Community Development Director mayapprovechanges inthefinalplanned development
district which are minor and of a technicalnature and which are consistent with the approved
plan.
18.67.220 Repeal of Planned Development District Ordinance:
A.The CommunityDevelopment Director shall prepare and submit tothe Council an ordinance
providing for the repeal of theordinance establishing the planneddevelopment district upontheoccurrenceofthefollowing:
1.Afinal planned development district application and map(s)has not been submitted within
three (3)years of adoption oftheordinance conditionallyapprovingand establishing theplanneddevelopmentdistrictunlessanapplicationforanextensionhasbeenapproved
by the Council.
2.Construction has notcommencedwithintwo(2)years offinalplanned development district
approvalor in compliancewiththefinalapprovedplanned development district construe-
tionschedule unless an application for an extension has been approved by theCouncil.
B.Application for Time Extension:
1.Sixty (60)days priorto thefirst reading ofan ordinanceto repealthe ordinanceestablish-ing the planned development district,the responsible party of record representing theplanneddevelopmentdistrictshallbenotifiedbycertifiedletterviaU.S.mailof thepending
actionand shall be afforded theopportunitytosubmit an application or an extension of theplanneddevelopmentdistrictordinance.
2.The Council may grant one (1)extension not to exceed one (1)year of the ordinance
establishing theplanned development district.
3.Application for an extension shall be made tothePlanning Commission at least thirty(30)calendardays priortothescheduled dateof afirstreadingofthe repealordinance.Anon-
refundable application fee ofone hundred dollars ($100)shallaccompany each and every
applicationforan extension.
4.The applicationshall include a statement of mitigatingand/or hardship circumstances
necessitating therequest for an extension.
5.The Planning Commissionshall review theapplicationfor an extension and recommend
tothe Council that the applicationbe approved or rejected.
6.There shallbe a first readingoftherepeal ordinance.Atthefirst readingoftheordinancetheCouncilmaygranttherequestedextensionbasedupontherecommendationofthePlanningCommissionandtestimonygivenatthefirstreading.
7.Iftheextension is approved,therepealing ordinancewillbe redocketedfor a first readingattheterminationoftheone(1)year extension period.In the event thata final planneddevelopmentdistrictapplicationandmap(s)has not been submittedwithintheone(1)yearextensionperiodorintheeventthatconstructionhasnotcommencedwithintheone(1)year extension,thereshall be a first and second readingand adoption of theordinancerepealingtheplanneddevelopmentdistrict.
Section 2.The City Council declares that an emergency exists and this ordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of theentire CityCouncilpresent vote in favor ofAadop
