1905_00001ORDINANCE NO.1905 AN ORDINANCEAMENDINGCHAPTER 18.32 OF THE MOSESLAKEMUNICIPALCODEENTITLED"C-2,GENERAL COMMERCIALAND BUSINESS ZONE" THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 18.32 of the Moses Lake Municipal Code entitled"C-2,General Commercial andBusinessZone"is amended as follows: 18.32.040 ConditionalUses:The following specificand generallydescribed uses shall be permitted intheC-2 Zone onlyas a conditionaluse subject to the approval of the Planning Commission incompliancewiththeprovisionsofthischapterandChapter18.51 of thistitleentitled"ConditionalandUnmentionedUses." A.Churches B.Schools C.Hospitals D.Bulkstorage of hazardous,combustible or explosivesubstances E.Manufactured home parks F.Airports,landing strips,heliports,and airtransportationfacilities G.Recreational vehicle parks H.Keepingof livestock,poultry,rabbits,orbees forcommercial or privatepurposes I.Any commercialuse not on citysanitary sewer. J.Permanent storage facilitiesutilizing steel sea or ocean-goingcontainers marked with theAmericanBureauofShipping'sEmblem or meeting theInternational Standard Organization'sstandardswhichcanbedetachedfromatrailer,chassis,or frame and,whichwere formerlyusedfortransportingseaorocean-going cargowhen intended tobe used as storage facilitieswiththefollowingconditionsbeingrequiredasaminimum: 1.Be used as an appurtenance totheprimaryuse;such primaryuse being situated in anenclosedadjoiningbuilding. 2.Be placed onconcrete,asphalt,or level,compacted,hard surface at alltimes. 3.Be painted so as to blend in withthe buildingtowhich itis associated. 4.Not be visibleto the motoringpublic or from residential neighborhoods immediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingseaoroceangoingcargo,which measures shallbe approved by thePlanning Commission,provided,thatthePlanning Commission does not needtorequiremitigation measures ifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted. 5.Havea maximum allowablesquare footageof container storage area not toexceed fivepercent(5%)ofthegross floor area of thebuildingwith whichthecontainer(s)isassoci-ated.In no event shallthenumberofcontainersallowed as appurtenant storage facilitiesexceedthree(3)in number. 6.Be located on premises as an appurtenant storage facility. 7.Not be stacked. 8.Abide by allset back requirements applicableto the zone in whichitis located. 9.The recipient of theconditional use permit is theonly party allowedto use thecontainer. 10.The conditionsas requiredby 1 through9 shall be met withinten (10)workingdays aftertheconditionalusepermithasbeengrantedandtheten(10)day appeal period hasexpired. 11.If any additional conditionsare specified by thePlanning Commission,the Commissionshallsetadatefortheconditionstobemetbytheapplicant.O K.Temporary seasonal shortage facilities utilizing steel sea or ocean-going containers markedwiththeAmericanBureauofShipping's Emblem or meeting the International StandardOrganization's standards whichcan be detached from a trailer,chassis,or frame and,whichwereformerlyusedfortransportingseaorocean-goingcargowhen intendedtobe used asstoragefacilitieswiththefollowingconditionsbeingrequiredasaminimum: 1.Be used as an appurtenance tothe primaryuse;such primaryuse being situated in anenclosedadjoiningbuilding. 2.Be placed on concrete,asphalt,or level,compacted,hard surface at all times. 3.Not be visible to the motoring public or from residential neighborhoods immediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingseaorocean going cargo,which measures shall be approved by the Planning Commission,provided,thatthePlanning Commission does not need torequire mitigation measures ifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted. 4.Have a maximumallowablesquare footage of containerstorage area not to exceed five percent (5%)ofthegross floor area ofthebuildingwith which thecontainer(s)is associ-ated.Subjecttothesquare footage of container area to gross floor area limitation,uponapplicationforaseparatepermit,uptoan additionalfifteen(15)containersmaybe allowed on a temporaryseasonal basis not toexceed ninety (90)days.The ninety (90)day periodshallbespecifiedbytheproponentintheconditionalusepermitapplication.Aconditional use permit fora temporaryseasonal usage shallonlybe grantedonce inevery twelve(12)monthperiodforeach location. 5.Be located on premises as an appurtenantstorage facility, 6.Not be stacked. 7.Abide by allset back requirements applicable to the zone inwhich itis located. 8.The recipient of theconditional use permit is theonly party allowed touse thecontainer. 9.The conditions as required by 1through9 shall be met within ten(10)working days after the conditionaluse permithas been granted and the ten (10)day appeal period has expired. 10.If any additionalconditionsare specifiedbythe Planning Commission,theCommission shallset a date for theconditionstobe metby theapplicant. 11.The use of temporarystorage shall not exceed ninety (90)consecutive days.The ninety(90)days shall begin after the conditional use permit has been granted and theten(10)day appeal period has expired.A conditionaluse permitshall only be granted once in every twelve(12)month period for each location. 12.A separate conditionaluse permitshall accompany each temporary,seasonal storage usage sought. 13.Aseparate fee ofsixtydollars ($60)shall be required tomitigate additionalexpenses tothecity. L.Other unmentioned uses ruled by thePlanning Commissionto be a conditionaluse or usespermittedbyspecificprovisionofthischapterasaconditionaluse. M.Site built and factory built,detached housing units,whether occupied by theowner,rented, leased,oroccupiedby aresident watchman,custodian,or attendant,when set back according to Moses Lake Municipal Code 18.32.220. N.On-site hazardous waste treatmentandstorage facilities in compliance with theperformancestandardsoftheStateofWashingtonsitingcriteriaforon-sitehazardous waste treatmentand storage facilities andtherequirementsof thischapter;provided that,on-site hazardous wastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste. O.Manufactured detached housing units whether occupied by the owner,rented,leased,oroccupiedbyaresidentwatchman,custodian,orattendantwhen set back one hundred and fifty feet (150')fromany arterial street. P.Residential uses as an accessory use to a commercialstructure,whether occupied by the owner,rented,leased,or occupied by a resident manager,watchperson,custodian,orattendant.Accessory use shall be defined as a use of a portion of a building which is incidental and subordinatetothe principal use of thebuilding. Q.Multi-familyresidentialuses (apartments) 18.32.200 Landscaping:Landscaping shall be in compliance withChapter 18.57of thistitle. Section 2.The City Councildeclares that an emergency exists and this ordinance shall take effect immediately as provided by law upon one reading if 2/3 of the entire City Council present vote in favor of passage.
