AN ORDINANCE CREATING A NEW CHAPTER 8.26 OF THE MOSES LAKEMUNICIPALCODEENTITLED"FIRE ALARMS"
THE CITYCOUNCIL OF THE CITYOF MOSESLAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 8.26 oftheMoses Lake MunicipalCode entitled "Fire Alarms"is created as follows:
8.26.010 Purcose:The purpose ofthischapter is to attemptto reduce the numberof false fire alarmsexperiencedintheCityofMosesLakeandrecoverpartofthecostforrespondingtofalsefirealarms.
8.26.020 False Alarm:False Alarm shall mean theactivation of a fire alarmand/or automatic sprinkleralarmforotherthanafire,smoke scare,or an emergency building evacuation,which may becausedbymechanicalfailure,malfunction,improper installation,lack of maintenance,ornegligenceoftheownerorlesseeofafirealarmsystemortheiremployeesoragents.
8.26.030 Fire Department Response:For a Fire Department response toanyfalse alarmthe Fire ChiefshallinformtheFinanceDirectorandtheFinanceDirectorshallchargeandcollectfromthepersonhavingormaintainingsuchfireand/or automaticsprinkler alarm system on premisesownedoroccupiedbyhim/her,fees as follows:
A.For a response topremises at which no otherfalse alarm has occurredwithintheprecedingthree(3)month period,hereinafter referredtoas a "firstresponse,"no fee shallbe charged,but theperson having ormaintainingsuch firealarmsystemand/orautomaticsprinkler alarmsystemshall,withinthree(3)working days after noticetodo so,make a written report to theFireChiefonformsprescribedbyhimsettingforththecourseofsuchfalsealarm,thecorrectiveactiontaken,whether such alarmhas been inspected by an authorizedservice-man,and such other information as theFire Chief mayreasonablyrequire to determine thecauseofsuchfalsealarmandcorrectiveactionnecessary.
B.For a second response toa premises within three (3)months after a first response,nofeeshallbecharged,but a writtenreportshall be requiredas for a first response and the FireChiefshallbeauthorizedtoinspectorcausetobeinspected,the alarm system and/orautomaticsprinkleralarmsystematsuchpremises,prescribenecessary correctiveaction,andshall givenoticeto theperson having or maintainingsuch alarmsÿstemof theconditionsandrequirementsofthissection.
O C.Fora thirdresponse toa premises within three(3)monthsaftersuch second response,andforallsucceedingresponseswithinthree(3)months of the last response,a fee of onehundreddollars($100)shallbe charged,and ifsuchthirdfalse alarmorany such succeedingfalsealarmisasaresultoffailuretotakenecessarycorrectiveactionprescribedbytheFireChief,the Fire Chiefmay order the disconnection of such alarm system and it shall beunlawfultoreconnectsuchalarmsystemuntilsuchcorrectiveactionistaken;provided,thatnodisconnectionshallbeorderedastoanypremisesrequiredbylawtohaveanalarmsysteminoperation.
D.For a first response caused by a failure of maintenance personnel to provide propernotificationtotheMosesLakeFireDepartmentthattesting,maintenance,or service work istobeperformedonafirealarmand/or automaticsprinkleror suppression system,a fee offiftydollars($50)shall be charged to the servicecompanyperforming the work.
E.Second,and subsequent responses caused bythefailure toprovideproper notificationshallresultinachargeofonehundreddollars($100)being assessed.
Section 2.The City Council declares that an emergency exists and thisordinance shall take effectimmediatelyasprovidedbylawupononereadingif2/3 of the entire City Council present vote in favor ofpassage.
