AN ORDINANCEAMENDINGCHAPTER 13.12 OF THE MOSES LAKEMUNICIPALCODEENTITLED"WATERANDSEWER RATES"
THE CITY COUNCILOF THE CITYOF MOSES LAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 13.12 oftheMoses Lake MunicipalCode entitled"Water and Sewer Rates"is amended asfollows:
13.12.053 Water Service Termination Procedures:
A.The provisions ofthissection shall govern allterminationsofwater servicefornon-paymentofcitychargeand/or installments and surcharges.
B.If by the payment date shown on a water and sewer bill,the city has not received completepaymentoftheamountshownonthebillthecityshallmailto,or personally serve upon,thecustomeranoticeoftermination.Thenoticeofterminationshall be sent withthe currentmonth'sbill.The noticeshallindicate the amount past due.
C.The notice ofterminationshall contain thefollowing:
1.The amount past due and the amount ofthe currentmonth's billing.
2.The date of the notice oftermination.
3.The date oftermination,which shall be no less thanten (10)days from the date ofthe noticeoftermination.
4.Noticethatunlessthecityreceives completepayment oftheamount past due priortothedateoftermination,water service shall be terminated.
5.Notice that in lieu of paying the entire amount shown,a customer,prior to the date oftermination,may notifythe citythathe disputes the correctness of all or part of the amountshown,ifallor part oftheamount shownwas:not thesubjectof a previous dispute.
6.Noticethatseven dollars ($7)willbe assessed as a delinquent service charge ifnot paid andreceivedbytheFinanceDepartment,UtilitiesDivision,by 5 p.m.on the day priortothedateshownonthedelinquentnoticeandthattwelvedollars($12)willbe assessed as an additionalservicechargeifnotpaidbythedateandtimeshownonthedelinquentnoticeprovidedthepaymentisnotextendedassetforthinthissection.
7.An informationaltelephonenumber.
8.Notice that thirtydollars ($30)willbe assessed as a service charge for allwater turn-ons orturn-offsafter4:00 p.m.and before 8:00 a.m.and at any other timewhich is not a normalworkingdayofthecity,such as weekends or legal holidays.
D.If,priortothe date of termination,
1.The cityhas not received complete payment ofthe past due amount shown on the notice oftermination,or
2.The customerhas notnotifiedthe citythathe disputes the correctness ofallor part of theamountshownonthenoticeoftermination,thenthecityshallterminatewater service providedtothecustomeronthedateoftermination,provided,thata community service organization,namely the Grant CountyCommunityActionCouncil,may make arequest for uptoa fourteen(14)day extension for any.person,firm,association,sole proprietorship,co-partnership,corporation,or any other business entitywhatsoever.The citywillrefer allrequests it receivesfromtheaforementionedaccountstotheGrantCountyCommunityActionCouncilwhowillscreenallrequests.Allrequests by theGrant County Community Action Council shall bemadeinwritinganddeliveredtotheCityofMosesLake's Finance Department before thewaterserviceisterminated.Atthe expirationoftheextension,ifthepast due amount shownonthelastnoticeofterminationisnotpaid,thewater service shall be terminatedandservicewillnotbepermittedtoberesumeduntilallpastdueamountshavebeenpaid,
E.Ifthe cityreceives payment of the past due amountshown on the notice of termination,suchpaymentshallbeconsideredatimelyandcompletepaymentforpurposesofthisordinance.
Section 2.The CityCouncildeclares thatan emergencyexists andthisordinance shall take effect immediatelyasprovidedbylawupononereadingif2/3 oftheentire CityCouncil present vot avor of passage.
