1916_00001ORDINANCE NO.1916 ANORDINANCE CREATINGCHAPTER 16.70 OF THEMOSESLAKEMUNICIPALCODEENTITLED"lNTERCEPTORS" THECITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 16.70 oftheMoses Lake Municipal Code entitled"Interceptors"is created as follows: 16.70.010 Definition:For thepurpose ofthis chapter the following definitions shall apply: A."Interceptor"means a device (akaclarifier)designed and installed to separate and retaindeleterious,dangerous,and undesirable substances fromthewastewater(grey water)priortodischargeoftheliquidwasteintoapublicsanitarysewerwhilepreventingtheback- passage of gases from thesewer system into a confinedspace for human occupancy. B."Industrial User"means any non-domesticsource ofwastewater discharged tothePubliclyOwnedTreatmentWorks(POTW). 16.70.020 Background:The CityofMoses Lake operates thePubliclyOwnedTreatment Works (POTW),and isthereforeresponsible tomaintainitscollectionsystem,treatment plants,and theeffluenttherefromwithincity,state,and federalstandards.Anyservicedischarginginto thePOTW mustcomplywithallgovemmentalrequirements,orthe privilegeofusingthatservicewillbe rescindedandappropriatecivilactionwillbetaken. 16.70.030 Purpose:The purpose ofthischapter is toallow plating shops,auto repair shops,auto washracks,mechanical shops,or any other industrial user that may potentiallydischarge totalsuspendedsolids(TSS),oils and greases (O&G),or totalmetals in concentrationsthat mayexceedthecity,state,or federal effluent limitations for discharges to the POTWwith thestipulationthattheymeetalltherequirementsofthischapter. 16.70.040 Requirements:The ownerofany property requiringan interceptor willbe responsible toinsurecomplianceofallofthefollowing: A.Prevent all antifreeze,waste solvents,waste oil,waste transmissionfluid,flamma-blelexplosive liquids,and any other dangerous wastes from entering anydrain.Dangerouswastesshallbecaptured,stored in appropriate containers,and shipped off site to anauthorizedwastedisposalcompany. O B.All liquid chemical products shall be stored using best management practices and in amannerwhichwillprevententryofthesesolutionsintoanydrain. C.Anyspillsofcontaminantsshallbecontained byabsorbent materials,cleaned up accordingtoalllawsandregulations,stored in appropriate containers,and shipped toan authorizedwastedisposalcompany. D.In theevent ofa dangerous waste orpetroleum spillthathas entered a drain connected tothePOTW,the Public WorksSuperintendentshall be notifiedimmediately. E.At its discretion,thecitymay require a manholeimmediately downstream oftheinterceptorforsamplingpurposes.Only drains from the shop,the equipment wash bays,or otherindustrialusesshallpassthroughtheinterceptor,and the manhole(ifrequired).Sanitarywastesareprohibitedfrompassingthroughaninterceptor.The city shall be allowedtoaccessmanholesandinterceptorsforinspectionuponrequest. F.AIIinterceptors,manholes,and othercollectiondevices on private propertyshallconformtotheapplicablestandardsineffectatthetimeofconstruction.Standards are available at theMunicipalServicesDepartment. G.Constructionplansforallimprovements toa facility's sewer systemshallbe submittedtoandapprovedbytheMunicipalServicesDepartmentpriortobeginningthework.AllworkshallbepermittedandconstructedinaccordancewithMosesLakeMunicipalCoderequirements. H.AIIfacilities thatare requiredto discharge to an interceptor shall be enclosed to preventdischargingstormand/or ground water totheinterceptor. 16.70.050 Interceptor Cleaninq Schedule:The property ownershall be responsible forallrequiredcleaningandinspectionsinaccordancewiththefollowingschedule: A.Withintwelve(12)monthsofuse,anda minimumofeverytwelve(12)monthsthereafter,theownerofthepropertyshallarrangetocleantheinterceptor.This servicemust beperformedbyanauthorizedcontractorapprovedbythelocalorstateauthorityforthistypeofcleaninganddisposal.Immediately after being cleaned,allchambers shallbe inspected for sludgeandoilandthenrefilledwithwaterbeforebeingplacedintoorreturningtoservice.Priortocleaning,the depth oftheoil and sludge shallbe recorded on an inspectionreport 8.In addition,the propertyowner willarrange tohave theauthorized contractor inspect andmeasurethesludgeandoildepthintheinterceptormidwaybetweentheminimumcleaningcycle.Should theaccumulated sludge depth reach sixinches (6")or the oildepthreachfourinches(4"),atthetimeof inspection,the propertyowner willmakeimmediate arrangementstocleantheinterceptor.The depth of the oiland sludge shallbe recorded on an inspectionsheet C.Ifa history develops indicating thatthe minimumtwelve(12)monthcleaningcycleis not oftenenoughtostayincompliancewiththesixinch(6")sludgedepth and four inch (4")oildepthlimitation,a morefrequent cleaningand/or inspection schedule willbe imposed as directed by the Municipal Services Director. D.AIIcopies of cleaning invoices and inspection reports shall be submitted to the BuildingOfficial. 16.70.060 Maintenance Of Interceptor:AIIcosts associated with purchase,installation,cleaning,inspec-tions,replacement,maintenance,parts,and repairs ofinterceptors arethefinancial responsibilityofthepropertyowner. 16.70.070 Notice to Cease Violation:Any person,firm,orcorporation found to be violating any provisionofthischaptershallbeservedbytheBuildingOfficialwithwrittennoticestatingthenatureoftheviolationandprovidingareasonabletimelimitforthesatisfactorycorrectionthereof.Theoffendershall,within theperiod of timestated insuch notice,permanentlycease all violations. 16.70.080 Penalty for Continued Violation:Any person,firm,or corporation who continues any violationbeyondthetimelimitprovidedforintheNoticeToCeaseViolationisdeemedtohavecommitted a civilinfraction,and uponconvictionthereof,shallbe subject toa C-2 penalty and punishable as defined inChapter 1.08 ofthe Moses Lake MunicipalCodeentitled "GeneralPenalty".Failure or refusal tocomplyshall also constitute groundsfor discontinuing water and sewer service tothepremisesuntilsuchrequirementshavebeensatisfactorilymet. Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication of its summary as provided by law.
