AN ORDINANCE AMENDINGCHAPTER 5.07 OF THE MOSESLAKEMUNICIPALCODEENTITLED"ITINERANTMERCHANTS ANDVENDORS"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DOORDAIN AS FOLLOWS:
Section 1.Chapter 5.07 oftheMoses Lake Municipal Code entitled "Itinerant Merchants and Vendors"isamendedasfollows:
O 5.07.050 Investigation and Determination:Upon receipt of such application,the Community Develop-ment Directorshallcause such investigation ofsuch person or persons'business responsibilitytobemadeasisdeemednecessaryfortheprotectionofthepublicgoodandshallrefertheapplicationtotheCommunityDevelopmentDepartmentforitsdeterminationastocompliancewithstandardsandrequirementsofthischapter.An application shall be denied by theCommunityDevelopmentDirectoruponwrittenfindingsthattheapplicant's business responsi-bilityis unsatisfactory or thatthe proposed business activity willviolate any applicablelaw,rule,
or regulation.Any license issued under thischapter shallcontain the number on the license,thedate same was issued,the nature of thebusiness authorized to be carriedon,theamountoflicensefeepaid,theexpiration date of said license,the place where said business may becarriedonundersuchlicenseandthenameornamesofthepersonorpersonsauthorizedtocarryonthesame.The Community Development Department shall keep a record of alllicensesissuedunderthischapterandshallpromptlyprovidetheWashingtonStateDepart-ment of Revenue a copyofany license issued under thischapter.
5.07.100 Revocation of License:Anylicense pursuant tothischapter may be revoked,in writing,by theCommunityDevelopmentDirectorforanyofthefollowingcauses:
A.Any fraud,misrepresentation,or false statement contained intheapplicationfor license.
B.Any fraud,misrepresentation,or false statement made in connection with the selling ofproducts.
C.Any violation of thischapter.
D.Convictionofthelicensee ofany felonyor of a misdemeanor involving moral turpitude.
E.Conductingthe business licensed under thischapter in an unlawfulmanner or in such amannerastoconstituteabreachofthepeaceortoconstituteamenacetothehealth,safety,or generalwelfareofthepublic.
Section 2.This ordinanceshall takeeffect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
