ANORDINANCE AMENDINGCHAPTER 8.08 OF THE MOSES LAKEMUNICIPALCODEENTITLED"GARBAGE COLLECTION"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter8.08 of theMoses Lake Municipal Code entitled"Garbage Collection"is amended asfollows:
8.08.150 Administration:
A.If a home occupation is carried on in a residential zone as allowed by the CommunityDevelopmentDirectororothersimilarpositionordesigneeundertheMosesLakeMunicipalCode,theresident shallpay onlyfor residentialserviceso long as thereis never morethanfourgarbagecansperweekputoutforcollection.In theevent a dispute arises over whether
a home occupationshould be required to payresidential orcommercialrates,theSanitationTechnicianshallmakethedeterminationastowhatserviceisbeingusedorshouldbeusedandthereforwhatserviceistobecharged.The decision oftheSanitation Technician shall befinal.
B.Ifa commercialbuildingwitha singleentrance,exclusiveof fireexits,has multipletenants,theowneroftherealestateshallhavetheoptionofpayingforserviceforallthetenantsortheowneroftherealestateuponnotifyingtheCityofMosesLakeonaformprovidedbythecity
can requirethetenantstopay for individual services.The form shallprovide thatin theeventthetenantfailstopayfortheservicerendered,the owner of the real estate shall assumeresponsibilityforthedebtandagreetopaythesame.The form shall also providethat iftheserviceisconvertedfromasingleservicetomultipleservicesorviceversatheaccountoraccountsmustbepaidinfullbeforethechangeismade.
C.Iftwoor more typesofserviceare availabletoa garbage account,both which adequately andsatisfactorilyservetheaccount,theowner oftherealestate orthe party receivingtheservice,depending upon thecircumstances,shall have theoptionof selecting theservice he wishestoreceivesolongasnounsanitaryconditioniscreatedasaresultoftheserviceselectionoftheowneroftherealestateorthepartyreceivingtheservice.Ifa dispute arises between theowneroftherealestateorthepartyreceivingtheserviceandthecollectorofrefuseconcern-ing thetypeofcollectionservice an account should be receiving,theSanitationTechnicianshallmakethedeterminationastowhattypeofserviceistobecharged.The decision oftheSanitationTechnicianisfinal.
D.The typeof service to be utilizedby commercialaccounts and theattendant fee shall beagreeduponbytheowneroftherealestateservedorthepartyreceivingtheservice,depending uponthe circumstances.Ifa dispute arises between the owner ofthe real estateorthepartyreceivingtheserviceandthecollectorofrefuseconcerningthetypeofcollectionserviceanaccountshouldbereceiving,theSanitationTechnician shallmake thedetermina-tionas towhattypeofservice is tobe charged.The decision oftheSanitationTechnician shallbefinal.
E.Ifa singlecommercialbuilding containsmore thanone business,theownerofthereal estateorthepartyorpartiesreceivingtheservice,depending upon thecircumstances,mayelect asingleservicetoservetheentirebuildingorcomplex.Thecity may requirethattheowneroftherealestateorthepartyoroneofthepartiesreceivingtheserviceberesponsiblefortheentireaccount.
F.The city shall have the power,from timetotime,by resolution or after Council considerationbymotiondulymadeandpassed,toset forth and determine additional rules and regulationsandothermattersasmaybenecessaryinthediscretionoftheCityCouncilfortheproperexecutionofthischapter.
Section 2.Thisordinanceshall take effectand be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
