ANORDINANCEAMENDINGCHAPTER 14.06 OF THE MOSESLAKEMUNICIPALCODEENTITLED"STATE ENVIRONMENTALPOLICYACT"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 14.06 of theMoses Lake Municipal Code entitled"State Environmental Policy Act"isamendedasfollows:
14.06.020 General Requirements:
A.Purpose:This partcontainsthebasicrequirementsthatapplytothe SEPA process.The cityadoptsthefollowingsectionsofChapter197-11 of the Washington Administrative Code byreference:

B.Additional Definitions:In additionto thosedefinitionscontained withinWÀC 197-11-700through197-11-799,when used inthisordinance,thefollowingterms shallhavethefollowingmeanings,unless thecontextindicatesotherwise:
1."Department"means any division,subdívision,ororganizationalunitofthe cityestablishedbyordinance,rule,or order.
2."SEPA rules"means Chapter 197-11 WAC adopted by theDepartment of Ecology.
3."Ordinance"means theordinance,resolution,orotherprocedure used by thecitytoadoptregulatoryrequirements.
4."Early notice"means the city's response to an applicant stating whether it considersissuanceofadeterminationofsignificancelikelyfortheapplicant's proposal [mitigateddeterminationofnon-significance(DNS)procedures].
C.Designation of Responsible Official:
1.For those proposals forwhichthecityis thelead agency,theresponsible officialshall betheCommunityDevelopmentDirector.
2.For allproposalsfor whichthecityis thelead agency,theresponsible oificialshall makethethresholddetermination,supervisescoping,supervise the preparationofany requiredEnvironmentalImpactStatement(EIS),and performany other functionsassigned tothe"leadagency"or "responsibleofficial"by these sections of the SEPA rules thatwereadoptedbyreferenceinWAC173-806-020.
Any party aggrieved bya decision rendered by theCommunityDevelopment Director onathresholddeterminationmayappealthedecisiontothePlanningCommission,subjecttotheprovisionsofMLMC18.74 ofthistitle.
3.The cityshallretain all documents required by theSEPA rules (Chapter 197-11 WAC)andmakethemavailableinaccordancewithChapter42.17 RCW,
D.Lead Aqenev Determination and Responsibilities:
1.The department withinthe city receivingan application for or initiating a proposal thatinvolvesanonexemptactionshalldeterminetheleadagencyforthatproposalunderWAC197-11-050 and 197-11-922 through197-11-940;unless the lead agency has beenpreviouslydeterminedorthedepartmentisawarethatanotherdepartmentoragencyisintheprocessofdeterminingtheleadagency.
2.When thecityis thelead agency for a proposal,thedepartment receiving theapplicationshalldeterminetheresponsibleofficialwhoshallsupervisecompliancewiththethresholddeterminationrequirements,and ifan EIS is necessary,shallsupervise preparation of theEIS.
3.Whenthecityis not thelead agency fora proposal,all departments of thecity shall useandconsider,as appropriate,eithertheDNSorthefinal EISofthelead agency in makingdecisionsontheproposal.No city department shall prepare or require preparationof aDNSorEISinadditiontothatpreparedbytheleadagency,unless requiredunder WAC197-11-600.In some cases,thecity may conduct supplementalenvironmentalreviewunderWAC197-11-600.
4.Ifthecityoranyofits departments receives a lead agency determination made by another
agencythatappears inconsistentwiththecriteriaofWAC197-11-922 through197-11-940,
it mayobjecttothedetermination.Any objectionmust be made to theagency originally
makingthe determination and resolved withinfifteen (15)days ofreceipt ofthedetermina-
tion,or thecitymust petition the Department ofEcology for a lead agency determination
underWAC197-11-946 withinthefifteen(15)daytimeperiod.Any such petitiononbehalf
of thecitymay be initiatedbytheCommunityDevelopment Director
5.Departmentsofthecityare authorized tomake agreements as tolead agency status orsharedleadagencydutiesforaproposalunderWAC197-11-942 and 197-11-944;
Provided,thattheresponsible officialand any department thatwillincurresponsibilitiesastheresultofsuchagreementapprovetheagreement
6.Any department makinga lead agency determination fora private project shall require
sufficientinformation from theapplicantto identify which other agencies have jurisdiction
over the proposal.
E.Transfer of Lead Agency Status to a State Agency:For any proposalfor a private project
where the city would be the lead agency and for which one or more state agencies have
jurisdiction,thecity'sresponsible officialmayelecttotransferthelead agencydutiestoa state
agency.The state agency withjurisdictionappearing first on the prioritylisting inWAC
197-11-936 shall be the lead agency andthe city shall be an agency with jurisdiction.To
transferlead agencyduties,thecity'sresponsible officialmusttransmita noticeofthetransfer
togetherwith any relevant information available on the proposal to the appropriate state
agencywithjurisdiction.The responsibleofficialof thecityshallalsogivenotice of thetransfer
tothe privateapplicantand any otheragencies withjurisdictionover theproposal.
F.Additional Timinq Considerations:
1.For nonexempt proposals,theDNSor Final EISfortheproposalshall accompany thecity's
staffrecommendationtoany appropriateadvisory body.
2.Ifthecity'sonlyaction on a proposalis a decisionon a building permitor other license thatrequiresdetailedprojectplansandspecifications,theapplicant mayrequest inwritingthat
the city conduct environmentalreview prior to submission of the detailed plans and
specifications.
14.06.040 Environmental Impact Statement:
A.Purpose and Adoption by Reference:This part containstherulesforpreparingEnvironmental
Impact Statements.Thecityadopts the followingWashington Administrative Code sections
by reference,as supplemented by thispart:

B.Preparation of EIS -Additional Considerations:
1.Preparation ofdraft and finalEISs (DEIS and FEIS)and draftand finalsupplemental EISs
(SEIS)istheresponsibility oftheCommunityDevelopment Director.Before thecityissues
an EIS,theresponsible officialshall be satisfiedthatitcomplies with thisordinanceand
Chapter 197-11 WAC.
2.The DEIS and FEIS or draft and final SEIS shallbe prepared by city staff,the applicant,
or by a consultantselected bythe city or theapplicant Iftheresponsible officialrequires
an EIS for a proposal and determines thatsomeone other than the citywillprepare the
EIS,theresponsibleofficialshallnotifytheapplicantimmediately aftercompletionof the
thresholddetermination.The responsibleofficialshallalsonotifythe applicant ofthecity's
procedurefor EISpreparation,including approval oftheDEISand FEIS prior todistribu-
tion.
3.The city may require an applicant to provide information the city does not possess,including specificinvestigations.However,theapplicantis not required tosupplyinforma-tionthatis not required under this ordinance or that is being requested from another
agency.(Thisdoes notapplytoinformationthecitymayrequest underanotherordinance
or statute.)
Section 2.This ordinanceshalltakeeffectand be in force five(5)days after its passage and publicationofitssummaryasprovidedbylaw.
