1932_00001ORDINANCENO.1932 AN ORDINANCE AMENDINGCHAPTER 8.14 OF THE MOSES LAKEMUNICIPALCODEENTITLED"NUISANCES" THECITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTON DOORDAINAS FOLLOWS: Section 1.Chapter8.14 of theMoses Lake MunicipalCode entitled"Nuisances"is amended as follow: 8.14.030 Nuisance Defined.Each of thefollowingconditions,unless otherwisepermittedby law,isdeclaredtoconstituteapublicnuisance,and whenevertheCodeCompliance OfficerdeterminesthatanyOoftheseconditionsexistuponanypremisesorinanystream,drainage way orwetlands,theofficermayrequireorprovidefortheabatementthereofpursuanttothischapter. A.The existence of any trash,dirt,filth,and carcass of any animal,waste shrubs,accumulationoflawnoryardtrimmingsorotheroffensivematter. B.Defective or overflowing septicorsewage systems,and theexistenceof any noxious,foul,orputridliquidorsubstancewhichposesahealthhazardorcreatesanoxiousodor. C.Any man-caused pool ofstandingorstagnant water,except stormdrainage systems,whichservesasabreedingareaforinsects. D.Accumulation ofgarbage,decaying vegetation,manure,dead animals,or othernoxiousthingsinastreetoralley,oronpublic or private propertytoan extentinjurious tothepublic health asdeterminedbytheHealthOfficer. E.AIIother acts,failure toact,occupations,oruse ofpropertywhich is determined by the HealthOfficertobeamenacetothehealthofthepublic. F.Alllimbs oftreeswhichare less thanseven (7)feet above thesurface ofany public sidewalk,or twelve(12)feet above thesurface of any street G.All buildings,other structures,or portions thereofwhich have been damaged by fire,decay,neglect,or have otherwise deteriorated or become dilapidated so as toendanger thesafetyofthepublic. H.All explosives,flammable liquids,and other dangerous substances stored or used in anymannerinviolationoftheUniformFireCode.O I.The keeping or harboring of any dog,fowl,or other animalwhich by frequent or habitualhowling,yelping,barking,crowing,or in themakingof other noises,annoys or disturbs thepublic,orthehabitualallowingofdogs kept at any one address to runat large in violation ofChapter6.05 of theMoses LakeMunicipalCode entitled "Animal Control". J.Making or causing to be madeby any means whatsoever any noise of any kind which is aviolationofChapters8.28 of the Moses Lake Municipal Code entitled "Noise Control". K.Dumping,throwing,placing,leaving or causing or permitting tobe dumped,thrown,placed orleft,anyfilth,paper,cans,glass,rubbish,trashgarbage,grass trimmings,shrubtrimming,andshrubberyofanykind,inoruponany street,alley,sidewalk,ditch,orpublic orprivate propertyofanotherinthecity. L.The erecting,maintaining,using,placing,depositing,leaving or permitting tobe or remain inoruponanyprivatelot,building,structureor premises,orinorupon any street,alley,sidewalk,park,parkway or other public or private place inthe city,any one or more ofthefollowingdisorderly,disturbing,unsanitary,fly-producing,rat-harboring,disease-causing places,conditionsor things: 1.Any putrid,unhealthyor unwholesome bones,meat,hides,skins,orwhole or any partofanydeadanimal,fish or fowl,or waste parts offish,vegetable or animalmatter in anyquantity;but nothingherein shall prevent thetemporaryretention of waste in approvedcoveredreceptacles. 2.Any privies,vaults,cesspools,sumps,pits or likeplaces which are not securely protectedfromfliesandrats,or whichare foul or malodorous.O 3.Anyfilthy,littered ortrash-covered dwellings,cellars,house yards,barnyards,stable yards,factory yards,vacant areas in the rear of stores,vacant lots,houses,buildingsor pre-mises. 4.Anyanimal manure in any quantity which is not securelyprotected from flies or weatherconditions,orwhich is kept or handled inviolationof any ordinance ofthecity. 5.Any poison oak or poison ivy,Russian thistle or other noxious weeds,as defined byChapter8.22 of the Moses Lake Municipal Codeentitled"Noxious Weed Control"whethergrowingorotherwise;but nothingherein shall preventthe temporaryretentionof suchweedsinapprovedcoveredreceptacles. 6.Anybottles,cans,glass,ashes,smallpieces ofscrap iron,wire,metalarticles,bric-a-brac, brokencrockery,broken glass,broken plasterand allsuch trash,orabandoned material, unless it iskeptin approved covered bins or galvanizediron receptacles. 7.Any trash,litter,rags,accumulationsor empty barrels,boxes,crates,packing cases, mattresses,bedding,excelsior,packinghay,straworother packing material,lumber not neatly piled,scrap iron,tinorother metalnot neatlypiled,or anything whatsoeverinwhich fliesor rats may breed or multiply or which may be a firehazard. M.The permitting to remain outside any dwelling,building,or other structure,or within anyunoccupiedorabandonedbuilding,dwelling,or other structure,in a place accessible tochildren,any abandoned,unattended,or discarded ice chest,refrigeratoror other airtight contained,which does nothave the door,lidorother locking device removed. N.Any pit,hole,basin or excavation which is unguarded or dangerous to life or has been abandoned,or is no longer used forthepurpose constructed,or is maintainedcontrary to statutes,ordinances,or regulations. O.Anywell or storage tankpermittedto remainon any public or privateproperty without being securely closed or barring any entrance or trapdoor thereto,or withoutfillingor cappingany well. P.The repair or abandonment of any automobile,truck,or other motorvehicle of any kind uponthepublicstreetsoralleysofthecity. Q.The keeping or permitting theexistence of any bees orother insects,reptiles,rodents,fowl, or any other animals,domestic or wild,in anymanner contrary to law,orwhich affectthesafetyofthepublic. R.The existence of any fence,otherstructure,orthingon private or publicpropertyabutting orfrontinguponanypublicstreet,sidewalk,or place,whichis sagging,leaning,fallen,decayed or is otherwisedilapidated and creatingan unsafe condition. S.The existence of any vine,shrub,or plant growingon,around,or in frontofany fire hydrant, utilitypole,utilitybox,or any otherappliance or facilityprovidedfor fire protection,public orprivateutilitypurposesinsuchawayastoobscurefromvieworimpairaccessthereto. T.Except for anydesignated publicparkland,natural area,orenvironmentallysensitivearea,or any undeveloped parcels of land not adjacentto developed areas or which are used for agriculturalpurposes,allgrasses,weeds,orothervegetationgrowingorwhich has grownand died,which is determined tobe a fire or safety hazard or a nuisance to persons,shall not exceed twelveinches (12")in height measured above the ground. 1.The above exception may be waived and additionalmaintenance required by the Code ComplianceOfficerif he determines such action is necessary to protect the safety of persons or adjoiningproperty. 2.All maintenance shall be done in a manner so that soilstabilitywill not be disrupted ordisturbed.Grass,weed,or vegetation control shall not include plowIrig,discing,or scraping the soil to eliminate the grasses,weeds,or other vegetation unless a soil stabilization plan,whichwill minimize blowing dust and maintainsoilstability and which shall be approved by thecityprior toany plowing,discing,or scraping,is implemented immediately. V.The existence ofany dead,diseased,infected,ordying tree,shrub,or other vegetation which may pose a danger to vegetation,crops,property,or persons. W The existence of any accumulation of materials or objects in a location when the same endangers property,safetyor constitutesa fire hazard. X.The depositing orburning orcausing tobe deposited or burned in any street,alley,sidewalk, parkway or other public place which is open totravel,of any hay,straw,paper,wood,boards, boxes,leaves,manure or other rubbish or material. Y.The storage or keeping on any premises for more thanthirtydays of any used or unused building materialsas defined in Section 8.14.010 (B),whose retail cost new would exceed one hundred dollars,without a specialpermit fromthe building official;provided,thatnothingherein shall: 1.Prohibit suchstoragewithouta permitwhen done inconjunctionwitha constructionproject for which a building permithas been issued and whichis being prosecuted diligently to completion. 2.Prohibitsuch storage without a permit upon the premises ofa bona fide lumber yard, dealer in building materialsor other commercialenterprise when the same is permitted under the zoningordinance and other applicablelaws. 3 Make lawfulanysuch storageor keeping whenitis prohibited by other ordinancesorlaws. Z.The existence on any premises of anyunused and abandoned trailer,house trailer,automo-bile,boat or other vehicle or major parts thereof. AA.The keepingor maintenance in any area on privateproperty whichis clearlyvisible from apublicstreet,sidewalk,park orotherpublicarea any accumulation,collectionor untidy storageofanyofthefollowing:old appliances orparts thereof;old iron,steel,aluminum or othermetal;inoperable vehicles,vehicle parts,machinery or equipment;mattresses,bedding, O clothing,rags or cloth;straw,packingmaterials,cardboard or paper,tincans,wire,bottles,glass,cans,barrels,bins,boxes,containers,ashes,plaster or cement;or wood.Thisdeterminationshallnotapplytoconditionscompletelyenclosedwithinabuildingorfencingsoasnottobevisiblefrompublicproperty. BB.The keeping,permitting or harboring of any fowl,rabbits,hoofed orcloven footed animals. CC.The depositing of any debris,vegetation,lawnclippings,Iµmber piles,woodpiles,auto partsorbodies,garbage and the like,or storing of any materialof any kind,providedthat inresidentialzonesthatshallincludegarbagecansorrefusecontainersinthealleysofthecity,except on garbage pickupday. DD.The existence ofgraffiti,whichis definedas a defacing,damaging,or destructiveinscription,figure or designpainted,drawn orthelike,ontheexteriorofany building,fence,gate,orotherstructuresoronrocks,bridges,trees,or other realorpersonal property. EE.The locating ofautomobiles,trucks,recreational vehicles,trailers,boats,or any other vehicles,vessels,orthelikeforthe purpose ofadvertisingitssale on property located inanycommercialorindustrialzonenotownedbytheseller. FF.The permittingofany conditionor situationwhere thesoil has been disrupted,disturbed,ordestablizedsoastoallowblowingdusttoexist. GG.The existence on any premise any unsecured,unused,orabandoned buildingorstructure. Section 2.This ordinance shalltakeeffect and be inforcefive (5)days after its passage and publicationofitssummaryasprovidedbylaw.
