1940_00001ORDINANCE NO.1940 ANORDINANCEAMENDINGCHAPTER18.42 OF THE MOSES LAKEMUNICIPALCODEENTITLED"L-I,LIGHT INDUSTRIALZONE" THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DOORDAIN AS FOLLOWS: Section 1.Chapter 18.42 oftheMoses Lake Municipal Code entitled "L-I,LightIndustrial Zone"is amended as follows: 18.42.030 Uses intheL-IZone:Forthepurposeofclarification,thefollowing principal uses among the manyOpossibleusesmaybepermittedintheL-Izone subjecttothe provisions ofthischapter and anyconditionsimposedbythePlanningCommission: A.Lightindustrial uses B.Commercial and retail business uses incompliance withtheprovisions of thischapter desiring to locate in a less restrictive zone. C.The cultivation ofland foragricultural products,vineyards,gardening andfruitgrowingand thekeepingoflivestock,poultry,rabbits,and bees inaccordance withChapter 18,12 ofthistitleprovidedthatnobuildingsorstructuresshallbeerectedofapermanentnatureforhumanhabitationotherthanprovidedinSection18.42.030 E of thischapter. D.Administrativeand officefacilities fortheaccommodationof professionaland technicalstaffwhichareindependentfromwhataregenerallyrecognizedasbeingsupportiveofprimaryuses(i.e.corporatelawfirms,engineeringfirms,accounting firms,consultants,andtechnicalserviceagencies). E.Dwellingunitsfortheconvenienceofa resident watchmanorcustodian.Dwelling units as anappurtenantusetotheprimaryuse. F.Accessory uses appuitenant toany primary use. G.Essential public services and utilities. H.Parks and commercialor non-commercialrecreational use. I.Private or publicgroundtransportationsystems. J.On-site hazardous waste treatmentand storage facilities in compliance with theperformanceandstandardsoftheStateofWashingtonsitingcriteriaforon-sitehazardous waste treatmentandstoragefacilitiesandtherequirementsofthischapter;provided that,on-site hazardouswastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste. K.Locating steel sea or ocean-going containers marked with theAmerican Bureau ofShipping'sEmblemormeetingtheIntemationalStandardOrganization's standards which can bedetachedfromatrailer,chassis,or frameand,which were formerly used fortransportingseaorocean-going cargo when intended to be used as storage facilities with the followingconditionsbeingrequiredasaminimum: 1.Be used as an appurtenancetotheprimaryuse;such primary use being situated in anenclosedadjoiningbuilding. 2.Be placed on concrete,asphalt,or level,compacted,hard surface at alltimes. 3.Be painted so as toblend in with the building towhich itis associated. 4.Not be visible to the motoringpublicor from residential neighborhoods immediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingsea-going cargo,whichmeasures shallbe approved bythePlanning Commission,provided,thatthePlanningCommissiondoesnotneedtorequiremitigationmeasuresifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted. O 5.Have a maximumallowablesquare footage ofcontainer storage area nottoexceed threepercent(3%)of thegross floorarea of the building withwhichthe container(s)is associ-ated.Inno event shall the number ofcontainers allowedas appurtenant storage facilitiesexceedthree(3)in number. 6.Be located on premises as an appurtenantstorage facility. 7.Not be stacked. 8.Abide by all set back requirements applicableto thezone inwhich itis located. 9.The recipient of theconditional use permit is the only party allowed touse thecontainer. L.Locating steel sea or ocean-going containers marked with theAmerican Bureau of Shipping's Emblem or meeting the International Standards Organization standards which can bedetachedfromatrailer,chassis,or frame and,which were formerly used for transportingsea or ocean-going cargo or semi-trailers when intended tobe used as storage facilities or thelike at construction sites.Construction storage facilities may be located ten (10)days priortostartofconstructionandshallberemovedwithinten(10)days offinish ofconstruction.Start ofconstructionshallbedefinedasten(10)days prior tothe physical presence of construction activityon the site forwhich a buildingpermithas been issued.Finishofconstructionshallbe defined as thedate of issuance of a Certificate of Occupancy. 18.42.060 BulkRegulations:The maximum permissiblelimitsof the BulkRegulations for the L-IZone shallbeashereindefined: A.Building Heights:No building or structure shall be erected or enlarged to exceed three (3)storiesor fiftyfeet (50')inheight The Planning Commissionmayallow buildings or structurestobeerectedtoanadditionalheightafterapublichearingandexaminationofthelocationand upon due proof to the satisfaction of the Commission that such additional height willnot bedetrimentaltothesurroundingproperties.Any building or structure erected on a lot adjoining a residential orcommercialzoneshallbe limitedtoa height ensuringadjacent properties solar access subjecttothe provisions ofChapter ofthistitleentitled"SolarAccess." B.Off-StreetParking and Loading:Off-streetparkingand loading areas shall be providedin compliance with Chapter 18.54 of thistitle. C.Signs and Billboards:Signs and billboardsshall be incompliancewith Chapter 18.56 of thistitle. D.Shoreline Areas:AIIproperty developed withintwohundred feet (200')ofthehigh water line(1048'elevation)shall be in compliance with the city's Shoreline Management Plan. E.Storage Areas:AIIstorage located on a lot which adjoinsa residential or commercialzoneshallbewhollywithinabuildingorenclosedbyasightobscuringscreennotlessthaneightfeet(8')in height.Allstorage shall be kept in a manner so that itwillnot create a fire hazard or a nuisance.In thecase of theopen storage ofcombustiblematerial,a roadway shall be providedand maintainedtopermitfree access offire trucksat any time. F.Setback Requirements:No setbacks are required other than thoserequired by theUniform BuildingCode and theUniform FireCode and by Section 18.42.060 I of thischapter. G.Lot Size Requirements:No minimumor maximumlot size requirement. H.Containment Within a Building:AIIindustrial uses including but not limited to manufacturing, processing,warehousing,distribution,and fabrication shall be carried on withina building. This is notto be construed as prohibiting open sales lots or outside storage subject toSection 18.42.060 E ofthischapter, l.BufferStrio:Anyuse on a lotintheL-I2'one which adjoins a residential zone shallbe buffered from such zone with a buffer strip fifteen feet (15')inwidth.The Planning Commission mayrequiresightobscuringfencesorbermsaswellasshrubsandtrees.Buffer strips shall be suitablylandscaped and maintained. J.Landscapind:Landscaping shall be in compliancewith Chapter 18.57 ofthistitle. Section 2.Thisordinanceshall takeeffectand be in force five (5)days after its passage and publication of its summary as provided by law, Adopted by the City Council and signed by its Mayor on a ,2000.
