ANORDINANCEAMENDINGCHAPTER 18.43OF THE MOSESLAKEMUNICIPALCODEENTITLED"M-I,MEDIUMINDUSTRIALZONE"
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON DO ORDAIN ASFOLLOWS:
Section 1.Chapter 18.43 of the Moses Lake Municipal Code entitled"M-l,Medium Industrial Zone"isamendedasfollows:
18.43.030 Uses Within theM-IZone:Forthepurposeofclarification,thefollowingprincipal uses among theOmanypossibleusesmaybepermittedintheM-Izone subjectto the provisionsofthischapter and
any conditions imposed by the Planning Commission:
A.Medium industrialuses
B.Light industrial,commercialor retailbusiness uses in compliancewiththeprovisions ofthischapterdesiringtolocateinalessrestrictivezone.
C.The cultivationofland foragriculturalproducts,vineyards,gardeningand fruitgrowingandthekeepingoflivestock,poultry,rabbits,and bees in accordance withChapter 18.12 of thistitleprovidedthatnobuildingsorstructuresshallbeerectedofapermanentnatureforhumanhabitationotherthanprovidedinSection18.43.030 E of thischapter.
D.Administrative and officefacilities for theaccommodationofprofessional and technicalstaffwhichareindependentfromwhataregenerallyrecognizedasbeingsupportiveofprimaryuses(i.e.corporatelawfirms,engineeringfirms,accountingfirms,consultants,and technicalserviceagencies).
E.Dwellingunits for theconvenience ofa resident watchman or custodian.Dwellingunits as anappurtenantusetotheprimaryuse.
F.Accessory uses appurtenanttoany primaryuse.
G.Essential public services and utilities.
H.Parks and commercialor non-commercialrecreational use.
I.Private or publicgroundtransportationsystems.
J.On-site hazardous waste treatmentand storage facilities in compliance with theperformancestandardsoftheStateofWashingtonsitingcriteriaforon-site hazardous waste treatmentandstoragefacilitiesandtherequirementsofthischapter;provided that,on-sitehazardous wastetreatmentandstoragefacilitiesareaccessorytoandsubordinatetoaprimaryusewhichisageneratorofhazardouswaste.
K.Locating steel sea or ocean-goingcontainers markedwith theAmerican Bureau ofShipping'sEmblemormeetingtheInternationalStandardOrganization's standards which can bedetachedfromatrailer,chassis,orframe and,whichwereformerlyused for transportingseaorocean-going cargo when intended to be used as storage facilities with the followingconditionsbeingrequiredasaminimum:
1.Be used as an appurtenance totheprimary use;such primaryuse being situated in anenclosedadjoiningbuilding.
2.Be placed on concrete,asphalt,or level,compacted,hard surface at alltimes.
3.Be paintedso as toblend in with the building towhichit is associated.
4.Not be visible to the motoringpublic or from residential neighborhoods immediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingsea-goingcargoorsemi-trailerswhenintendedto be used as storage facilities,which measures shallbeapprovedbythePlanningCommission,provided,thatthePlanning Commission does notneedtorequiremitigationmeasuresifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted.
5.Have a maximumallowable square footage of containerstorage area nottoexceed threepercent(3%)ofthe gross floor area ofthe buildingwithwhichthecontainer(s)is associ-ated.Inno event shall thenumber ofcontainers allowed as appurtenant storage facilitiesexceedthree(3)in number.
6.Be located on premises as an appurtenant storage facility.
7.Not be stacked.
8.Abide by allset back requirements applicabletothezone inwhich it is located.
9.The recipient oftheconditionaluse permitis theonlypartyallowedtouse the container.
L Locating steel sea or ocean-going containers marked with theAmerican Bureau of Shipping's
Emblem or meeting the Intemational Standards Organization standards which can bedetachedfromatrailer,chassis,or frame and,which were formerly used for transportingseaorocean-goingcargoorsemi-trailerswhenintended tobe used as storage facilities orthelike
atconstructionsites.Constructionstorage facilitiesmaybe located ten(10)days prior tostartofconstructionandshallberemovedwithinten(10)days offinish ofconstruction.Start ofconstructionshallbedefinedasten(10)days priortothe physicalpresence of constructionactivityonthesiteforwhichabuildingpermithasbeenissued.Finish ofconstructionshall bedefinedasthedateofissuanceofaCertificateofOccupancy.
18.43.060 Bulk Regulations:The maximum permissiblelimitsoftheBulkRegulations fortheM-IZone shall
be as herein defined:
A.Building Heights:No building or structure shall be erected or enlarged to exceed three(3)storiesor fiftyfeet (50')inheight ThePlanning Commission mayallowbuildings orstructurestobeerectedtoanadditionalheightafterapublichearingandexaminationofthelocationand
upon due proof to the satisfaction of the Commission that such additional height willnot be
detrimental tothesurroundingproperties.Anybuildingorstructureerected ona lot adjoining
a residential or commercial2one shall be limitedtoa height ensuring adjacent properties solar
access subject totheprovisions of Chapter of thistitleentitled "Solar Access."
The maximum heightofanybuilding orstructureerected inanairportzone shallbe regulated
by Chapter 18.52 ofthistitleentitled"AirportZone."
B.Off-Street Parking and Loadinq:Off-street parking and loading areas shall be provided in
compliance with Chapter 18.54 of this title.
C.Sions and Billboards:Signs and billboards shallbe in compliancewith Chapter 18.56 ofthistitle.
D.Shoreline Areas:Allproperty developed within twohundred feet (200')of thehigh water line
(1048'elevation)shallbe in compliancewith the city's Shoreline Management Plan.
E.Storage Areas:AIIstorage located on a lotwhich adjoins a residential or commercialzoneshallbewhollywithinabuildingorenclosedbyasightobscuringscreennotlessthaneightfeet(8')in height This is notto be construed as prohibiting open sales lots.AIIstorage shall
be kept in a manner so thatitwillnot create a fire hazard or a nuisance.In thecase of the
open storage of combustiblematerial,a roadway shall be provided and maintained topermit
free access offire trucksat any time.
F.Setback Requirements:No setbacks are required other than thoserequired by the Uniform
BuildingCode and the UniformFire Code and by Section 18.43.060 Iofthis chapter.
G.Lot Size Requirements:No minimumor maximumlotsize requirement
H.Containment Within a Building:No requirement.
I.BufferStrip:Any use on a lot intheM-IZonewhichadjoinsa residential,commercial,or light
industrial zone shall be buffered from such zone with a buffer strip twentyfeet (20')in width.The Planning Commissionmay require sight obscuring fences,berms,or sound deadening
walls as well as shrubs andtrees.Buffer stripsshall be suitablylandscaped and maintained.
J.Landscaoina:Landscaping shallcomplywith Chapter 18.57 of thistitle.
Section2.This ordinanceshall take effect and be in force five(5)days after its passage and publication
of its summary as providedby law.
