AN ORDINANCEAMENDINGCHAPTER 18.44 OF THE MOSES LAKEMUNICIPALCODEENTITLED"H-I,HEAVYINDUSTRIALZONE"
THE CITY COUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DOORDAINASFOLLOWS:
Section 1.Chapter 18.44 of the Moses Lake Municipal Code entitled "H-I,Heavy IndustrialZone"isamendedasfollows:
18.44.030 Uses Within theH-IZone:For thepurpose ofclarification,the following principal uses amongtheOmanypossibleusesmaybepermittedintheH-Izone subject tothe provisions of thischapter and
any conditions imposed by the PlanningCommission:
A.Heavy industrial uses
B.Lightindustrial,medium industrial,commercial,or retail business uses in compliancewiththeprovisionsofthischapterdesiringtolocateinalessrestrictivezone.
C.Thecultivationofland foragriculturalproducts,vineyards,gardeningand fruitgrowingand thekeepingoflivestock,poultry,rabbits,and bees inaccordance with Chapter 18.12 ofthis titleprovidedthatnobuildingsorstructuresshallbeerectedofapermanentnatureforhumanhabitationotherthanprovidedinSection18.44,030 E ofthis chapter.
D.Administrative and officefacilities for theaccommodationofprofessional and technicalstaffwhichareindependentfromwhataregenerallyrecognizedasbeingsupportiveofprimaryuses(i.e.corporate lawfirms,engineering firms,accounting firms,consultants,andtechnicalserviceagencies).
E.Dwelling units fortheconvenience of a resident watchman or custodian.Dwelling units as anappurtenantusetotheprimaryuse.
F.Accessory uses appurtenanttoany primary use.
G.Essential public services and utilities.
H.Parks and commercialor non-commercial recreationaluse.
I,Private or public ground transportationsystems.
J.On-site and off-site hazardous waste treatment and storage facilities in compliance with theperformancestandardsoftheStateofWashingtonsitingcriteriaforon-site and off-sitehazardouswastetreatmentandstoragefacilitiesandtherequirementsofthischapter.
K.Locating steel sea or ocean-goingcontainers markedwiththeAmerican Bureau ofShipping'sEmblemormeetingtheInternationalStandardOrganization's standards which can bedetachedfromatrailer,chassis,orframeand,whichwereformerly used for transportingseaorocean-going cargo when intended to be used as storage facilities with the followingconditionsbeingrequiredasaminimum:
1.Be used as an appurtenance tothe primaryuse;such primary use being situated in anenclosedadjoiningbuilding.
2.Be placed on concrete,asphalt,or level,compacted,hard surface at alltimes.
3.Be painted so as to blend in with thebuilding towhich itis associated.
4.Not be visible to the motoring public or from residential neighborhoods immediatelyadjacenttothepropertywhereitislocatedunlessothermeasuresareemployedtomitigatethevisualimpactsofthecontainersformerlyusedfortransportingsea-goingcargoorsemi-trailerswhen intended to be used as storage facilities,whichmeasures shall beapprovedbythePlanningCommission,provided,thatthe Planning Commission does notneedtorequiremitigationmeasuresifitisfeltthatthemotoringpublicoradjacentresidentialneighborhoodsarenotimpacted.
5.Have a maximumallowable square footageof containerstorage area not toexceed three0percent(3%)ofthegross floor area ofthe building withwhichthecontainer(s)is associ-ated.Inno eventshall thenumber ofcontainers allowed as appurtenantstorage facilitiesexceedthree(3)innumber.
6.Belocated on premises as an appurtenant storage facility,
7.Not be stacked.
8.Abide by allset back requirements applicableto the zone in which itis located.
9.The recipient of theconditionaluse permit is the onlyparty allowed to use thecontainer.
L.Locating steel sea orocean-goingcontainersmarkedwith theAmerican Bureau ofShipping'sEmblemormeetingtheInternationalStandardsOrganizationstandardswhichcanbe
detached from a trailer,chassis,or frame and,which were formerly used for transportingsea
orocean-goingcargoor semi-trailerswhen intended tobe used as storage facilities or thelike
at construction sites.Construction storage facilities may be located ten(10)days priortostart
ofconstructionand shallbe removedwithin ten (10)days offinishof construction.Start ofconstructionshallbedefinedasten(10)days prior to the physical presence of construction
activityonthesitefor whicha buildingpermithas been issued.Finish ofconstructionshallbedefinedasthedateofissuanceofaCertificateofOccupancy.
18.44.060 BulkRegulations:The maximum permissible limitsoftheBulk Regulations for the H-IZone shall
be as herein defined:
A.Building Heights:
1.There shallbe no minimumheight requirements.
2.There shallbe no maximumheightrequirementprovidedthat:
a.Any building or structure erected on a lotadjoining a residential or commercial zone shall
be limitedtoa height ensuringadjacent properties solar access subjecttotheprovisionsofChapterofthistitleentitled"Solar Access."
b.Any building or structure erected in an airport zone shall not exceed theheight limitationsofsaidzonesubjectotheprovisionsofChapter18.52 of this titleentitled "AirportZone."
B.Off-StreetParking and Loading:Off-street parking and loading areas shall be provided in
compliancewithChapter 18.54ofthistitle.
C.Signsand Billboards:Signs and billboards shallbe in compliancewithChapter 18.56 of thistitle.
D.ShorelineAreas:AIIproperty developed withintwohundredfeet (200')of the high water line
(1048'elevation)shall be in compliancewiththecity'sShorelineManagement Plan.
E.Storace Areas:AIIstorage located on a lot which adjoins a residential orcommercialzoneshallbewhollywithinabuildingorenclosedbyasightobscuringscreennotlessthaneightfeet(8')in height.This shallnot be construed to prohibit open sales lots.AIIstorage shall be
kept ina manner so thatitwillnotcreate a firehazard ora nuisance.Inthecase of the openstorageofcombustiblematerial,a roadway shall be provided and maintained to permitfree
access offire trucksat any time.
F.Setback Reguirements:No setbacks are required other than those required by theUniform
BuildingCode and theUniform Fire Code and by Section 18.44.060 Iof thischapter.
G.Lot Size Recuirements:There shall be no minimum or maximum lot size requirement.
H.Containment Within a Building:No requirement.
I.Buffer Strio:Any use on a lotinthe H-IZone which adjoinsa residential,commercial,or light
industrial zone shall be buffered from such zone with a buffer strip twenty-fivefeet (25')in
width.The Planning Commission may require sight obscuring fences,berms,or sounddeadeningwallsaswellasshrubsandtrees.Bufferstrips shall be suitablylandscaped and
maintained.
J.Landscaping:Landscaping shall be in compliancewithChapter 18.57 of thistitle.
Section2.This ordinance shall take effect and be inforcefive (5)days after its passage and publichtlori
of its summary as provided by law.
