AN ORDINANCE AMENDINGCHAPTER 18.49 OF THE MOSES LAKEMUNICIPALCODEENTITLED"SITE PLANS"
THE CITYCOUNCILOF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 18.49 of theMoses Lake Municipal Codeentitled"Site Plans"is amended as follows:
18.49.030 Site Plans and Review:Any use that is subject tothe requirements for a site plan review prior toissuanceofbuildingpermitsshallbeprocessedinaccordancewiththefollowingprocedures:
A.Application:An applicationforsite plan approval may be filedby the property owner,lessee ofOthepropertywithmorethanamonth-to-month tenancy,or authorized agent of thepropertyowner.These shall be submitted tothe Community Development Department for transmittaltothePlanningCommissionwithanalysisandrecommendation.
B.Planning Commission Review:The Community Development Director shall assign a date noearlierthantwo(2)weeksafterthedate of application for a public hearing before the PlanningCommission.The siteplans willbe forwarded tothe Planning Commission which shall considertheapprovalofthesiteplanswithspecificattentiontothefollowing:
1.Compatibility withthe city's comprehensiveplan.
2.Compatibility withthe surrounding buildings'occupancy and use factors,
3.Allrelevant statutorycodes,regulations,ordinances,and compliancewiththe same.
C.The review and decision of thePlanning Commission shall be in accordance withthe provisionsofChapter18.49 oftheMoses Lake Municipal Code.
18.49.060 Application Open for Public Inspection:From the timeofthe filingoftheapplication until thetimeoffinalactionbythecity,theapplicationtogetherwithallplans anddata submittedshall be availableforpublicinspectionattheCommunityDevelopmentDepartment.
18.49.080 Amendments to a Site Plan:
A.Minor adjustments may be made and approvedwhen a building permit is issued.Any suchalterationmustbeapprovedbytheCommunityDevelopmentDirector.Minor adjustmentsarethosewhichmayaffecttheprecisedimensionsorsitingofbuildings(i.e.,lot coverage,height,setbacks)but which do notaffectthebasic character or arrangement and number of buildingsapprovedintheplan,nor the density of the development or theamount and quality of openOspaceandlandscaping.Such dimensionaladjustments shall not vary more than ten percent(10%)from the original,butshall not exceed the standards ofthe applicabledistrict.
B.Majoramendmentsare those which substantially change the character,basic design,density,openspace or other requirements and conditions ofthe siteplan.When a change constitutesamajoramendment,no building or other permit shall be issued without prior reviewandrecommendationbythePlanningCommission.
Section 2.This ordinance shalltake effectand be in force five (5)days after its passage and publication of itssummaryasprovidedbylaw.
