1946_00001ORDINANCE NO.1946 ANORDINANCEAMENDINGCHAPTER 18.55 OF THE MOSES LAKEMUNICIPALCODEENTITLED"HOMEOCCUPATIONS" THE CITYCOUNCIL OF THECITYOF MOSESLAKE,WASHINGTON DOORDAINAS FOLLOWS: Section 1.Chapter 18.55 oftheMoses Lake MunicipalCode entitled "Home Occupations"is amended asfollows: 18.55.030 Application for HomeOccupationUses and Appeals:An applicationfor a home occupation useshallbesubmittedtotheCommunityDevelopmentDepartmentforconsideration.The applicationshallbereviewedbytheCommunityDevelopmentDirectororothersimilarpositionoradesignee.Such uses may be permitted bythe CommunityDevelopment Director orthe individualdesignatedtoreviewtheapplicationssubjecttotheprovisionsofthischapter.Any party aggrieved by adecisionrenderedbytheCommunityDevelopmentDirectororotherindividualreviewingtheapplicationmayappealthedecisiontothePlanningCommission,subject tothe provisionsofMLMCChapter18.75 of thistitle. 18.55.040 General Requirements:The general requirements for a home occupationare as follows: A.There shallbe nostructuralalterationtoaccommodate theoccupation.Entrancetothespacedevotedtotheoccupationshallbefromwithintheresidence,except when otherwiserequiredbylaw. B.The use,including allstorage space,shall not occupy more than two hundred (200)squarefeetoftheresidence's floor area whichis finished for living purposes including an attachedgarage.No home occupationshalloccupy an accessory buildingor a detached garage. C.No home occupationshall have any outside storage ofgoods and materials associated withthehomeoccupation. D.Only members ofthefamilywho reside on thepremises and inany case no morethanthree(3)persons in any dwelling unit shall be engaged intheoccupation(s). E.There shall be no window displaynor shall sample commoditiesbe displayed outside thebuilding. F.Home OccupationSigns: 1.Signsidentifyinghome occupations whichare unlighted,placed flat againstthestructure,and which do not exceed two(2)square feet in size are permitted in the R-2 Zone,SingleFamilyandTwoFamilyResidential,and the R-3Zone,Multi-familyResidential. 2.Signsidentifyinghomeoccupationslocated intheR-1Zone,Single Family Residential,areprohibitedexceptasrequiredbylaw.Such signs,ifallowed,shall not exceed two (2)square feet insize except as may be allowed by thischapter. 3.Signsidentifying home occupationsmaybe permittedtoexceed two(2)square feet insizesubjecttothereviewandapprovalofthePlanningCommissionandafterithasbeenshownthatthesignwillnotadverselyaffectadjacentresidentialusesandthattheextrasizeisessentialtothesignbeingseen. G.No materialor mechanical equipmentshall be used which willbe detrimental totheresidential use of theresidence oradjoiningresidences because ofvibration,noise,dust,smoke,odor,interference withradioor televisionreception,or other factor. H.Materials orcommoditiesdeliveredtoor from the residence which are ofsuch bulk orquantityastorequiredeliverybyacommercialvehicleoratrailer,or the parking of customer'sautomobilesinamannerorfrequencycausingdisturbanceorinconveniencetonearbyresidencesorsoastonecessitateapublicparkinglotshallbeprima-facie evidence thattheoccupationisaprimarybusiness,and nota home occupation. I.Examples ofuses or occupationswhich might normallysatisfythecriteriaof thissectionare:barbers,"bed and breakfast"facilities,custom florists,beauticians,professional serviceproviders,dressmakers,photographers,home canners,watch repairers,and other similaruses. J.The followingshall not be deemed permissibleuses or home occupations:nursing homes, massage parlors,woodworkingand cabinet shops,household appliance,furniture andelectronicequipmentrepairshops,fumigation services shops,upholsteringshops,car repairshops,small engine repair shops,and other uses deemed as "similar"by the CommunityDevelopmentDirectororothersimilarpositionoradesignee. K.Ahome occupation issued toone person shallnotbetransferabletoanyotherperson norshallahomeoccupationpermitbevalidatanyaddressotherthantheoneappearingonthepermit. L.Any person engaging in a home occupationshall registeras a business under Chapter 3.16ofthiscode. 18.55.050 Notification:Application for a home occupation use shall require notification to adjacent property ownersoftheproposeduse.Notificationshallbe provided at least ten(10)days before a decision is tobe made on the application.Written or oral comments should be providedtothe CommunityDevelopmentDirectororotherindividualreviewinganapplicationbeforethedecisionistobemade on theapplication.Adjacent propertyownersshallaiso be notifiedofanyappealscheduled beforethePlanningCommission.Anoticeoftheactionbefore the Planning Commission shallbe mailedtoadjacentpropertyownersatleastten(10)days priortothescheduled appeal. Section 2.This ordinance shall takeeffect and be inforce five (5)days after its passage and publicationofitssummaryasprovidedbylaw. Adopted by theCity Council and signed by its Mayor on M 9,2000.
