ANORDINANCEAMENDINGCHAPTER 18.69 OFTHE MOSES LAKEMUNICIPALCODEENTITLED"NON-CONFORMING USES"
THECITYCOUNCIL OF THECITYOF MOSESLAKE,WASHINGTON DOORDAINASFOLLOWS:
Section 1.Chapter 18.69 of the Moses LakeMunicipal Codeentitled"Non-Conforming Uses"is amendedasfollows:
18.69.015 Non-ConforminqUses,Conditions UponContinuedExistence.When,Procedure:
A.Those non-conforminguses allowedtocontinuetoexistpursuant to Section18.69.010,asnowenactedorashereafteramended,may be conditionedas provided inthissection.
B.The Community Development Director,upon receipt of any claim,complaint,report,orinformationthatanon-conforminguse exists within the city shall investigate such claim,complaint,report,or information and makea determination as set forthbelow.
C.At theconclusionofhis investigation,theCommunityDevelopmentDirectorshalldetermineiftheuseisanon-conforminguse.
D.Iftheuse is found tobe a non-conforming use,theCommunity Development DirectorshalldeterminewhetherornottheuseisallowedtocontinuepursuanttoSection18.69.010.IftheuseisnotfoundtobeauseallowedtocontinuepursuanttoSection18.69.010,theCommu-nity DevelopmentDirector shall proceed as provided in thischapter to terminatethe use.
E.If the use is found to be a non-conforminguse allowed to continue pursuant to Section18.69.010,theBuilding Official,Fire Chief,and Community Development Director shall makewrittensummaryoftheirfindingsandsubmitthem,togetherwith any conditions that,in theiropinion,should be attached totheuse,to thePlanning Commission.
F.Upon completionofthe documentation described in subsectionB,theCommunity Develop-ment Directorshall proceed to set a date for a public hearing within sixty(60)days of thereceiptoftheinformation,unless waived bythesubject property owner,before the PlanningCommission.The purpose ofthathearingshall be todeterminewhat conditions,ifany,shallbeattachedtothecontinuingnon-conforming use pursuantto 18.69.010.Notice ofthehearingshallbepublishedatleastoncepriortothehearinginanewspaperofgeneralcirculationinthecity.Additionally,theCommunityDevelopmentDirector shall causenotice of the publicOhearingtobedeliveredtotheadjacentlandownersandoccupantsbymailing,posting,orpersonalnotification,whichever theCommunity Development Director determines is likelytogiveactualnoticeofthehearingtothosepersons.
G.Attheconclusionofthe public hearing,the Planning Commission shall make a finding onwhetherornotconditionsneedtobeimposedpursuanttoSection18.69.010.IfthePlanningCommissionfindsconditionsarenecessary,itshall make findings as towhat conditions andthereasonstherefore.
H.Anynon<onforminguse foundtobe requiredtobe conditioned,willbeallowedtocontinueaslongastheperson,firm,partnership,orcorporationresponsiblefor thatnon-conforminguseagreestoabidebyandbegovernedbytheconditionsimposedbythePlanningCommissionwithinthetimelimitsetbythePlanningCommission.The conditionsimposedbythePlanningCommissionmaybeforaperiodofupto24months.The PlanningCommissionmayrequiremorefrequentreviewoftheconditionsimposedontheuseasitmaydirectattheinitialpublichearingoranysubsequentreview.
I.Additionally,thePlanning Commissionmay bringa set ofconditionson for review before thedateprovidedatthetimetheconditionswereset,upon a complaintbeing brought to itsattentionbytheCommunityDevelopmentDirectororanycitizen.The Planning Commissionshalldeterminefromareviewofthecomplaintwhetherornottheallegationissufficienttowarrantafurtherhearingonthequestion.Ifa furtherhearing is deemed appropriate,thePlanningCommissionshallcausetobesenttotheperson,firm,partnership,or corporationresponsibleforthenon-conforminguse a noticeofa hearingbefore thePlanning Commis-sionsettingthedate,time,and place ofthehearing.The notice shall provide,in all capitalletters,ina conspicuous place thereon:"THISHEARING COULD DETERMINEWHETHERORNOTYOURNON-CONFORMINGUSEISALLOWEDTO CONTINUE."Saidnotice shallbedeliveredinthesamemanneraspersonalserviceofsummonstotheresponsibleperson,orposted upon thereal property inquestion,orsent by United States mail service,postageOprepaid,to the address of the responsible person.Said notice shallallowtheresponsiblepartyfivedaystimebeforethehearingwithinwhichtoprepare,unless the PlanningCommissionfindingsatthetimeitconsiderstheallegationofnon-compliance thatthepublichealth,safety,and morals require a hearing beforethattime.
J.Either prior to or at least at thetimeof thehearing toconsidertheallegationsofcomplaintconcemingnon-compliancewith conditions,the Planning Commissionshall inform theperson,firm,partnership,orcorporationresponsibleforthenon-conforming use ofthenoticeoftheallegedviolation.The CommunityDevelopment Director shall present theevidenceofthefailuretocomply.The responsible person shall thenbe allowed torespond ifthatpersonsodesires.The Planning Commissionshall thenmake its findings.Itshallfindwhetheror nottheconditionshavebeenviolated;whether or notany violation has occurredof such magni-tudeto require additionalconditions,more frequent reviewsof conditions,or termination.Ifterminationoftheprivilegetocontinuethenon-conforming use is determined bythePlanningCommissionastheonlymethodthatcanprotectthepublichealth,safety,and morals to an
acceptable degree,thePlanning Commissionshall determine thedate andtimeoftermination.
Once the privilege is terminatedforfailuretoobserve conditions,the Planning Commission
shall proceed to direct theCommunityDevelopment Director toenforce theprovisionsofthis
chapter to terminatetheuse.
K.Any person aggrieved by the decision of the Planning Commissionmay appeal tothe City
Council as provided in Chapter 18.75.
Section 2.This ordinance shalltakeeffectand be in force five(5)days after its passage and publication
ofits summaryas provided by law.
