ANORDINANCE AMENDINGCHAPTER 18.80 OF THE MOSES LAKEMUNICIPALCODEENTITLED"HEARINGEXAMINER"
THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS:
Section 1.Chapter 18.80 of the Moses Lake Municipal Code entitled"Hearing Examiner"is amended asfollows:
O 18.80.030 Compensation:The Hearing Examiner and Hearing Examiner Pro-Tem may be classified asregular,part-time employees orthe citymaycontractwith theHearing Examiner and HearingExaminerPro-Tem for thepedormance oftheduties described in thisordinance.
18.80.100 Applications:Applications for allmatterstobe heard bythe Hearing Examiner shall be presentedtotheCommunityDevelopmentDepartmentWhenitisfoundanapplicationmeetsthefilingrequirementsoftheCommunityDevelopmentDepartment,itshall be accepted.A completeapplicationshallcontainadetailedsiteplandescribingtherequestsoughtTheCommunityDevelopmentDirectorshallberesponsibleforassigningadateforapublichearingforeachapplication,whichdate shallnot be more thanthirty(30)days aftertheapplicanthas compliedwithallrequirementsandfurnishedallnecessarydatatotheCommunityDevelopmentDepart-ment.
18.80.110 Reoort byCommunitv Development Department:When such application has been set for publichearing,theCommunity Development Department shallcoordinate and assemble thecommentsandrecommendationsofothercitydepartmentsandgovernmentalagencieshavinganinterestinthesubjectapplicationandshallprepareareportsummarizingthefactsinvolvedandtheCommunityDevelopmentDepartment's findings and supportive recommendations.At leastseven(7)calendar days priortothescheduled hearing,thereport shall be filedwiththeHearingExaminerandcopiesthereofshallbemailedtotheapplicantandshallbemadeavailableforusebyanyinterestedpartyforthecostofreproduction,
18.80.150 Appeal of Hearing Examiner's Decision:
A.Any party who feels aggrieved by the Examiner's decisionmay submit an appeal inwritingtotheCommunityDevelopmentDepartmentwithinten(10)days from the date the finaldecisionoftheHearingExaminerisrendered,requesting a review of such decision.TheCommunityDevelopmentDepartmentwillsubmittheappealtotheCityCouncilforconsider-ation.
B.Such appeal shall be upon the record established and made at the hearing held by theHearingExaminer.Whenever a decisionoftheHearing Examinerisreviewed bytheCouncilpursuanttothissection,otherpartiesofrecordmay submit written memorandainsupport oftheirpositions.In addition,the Councilshall allow each side no more thanfifteen (15)minutesoforalpresentation.However,nonewevidence ortestimonyshallbe presented totheCouncilduringsuchoralpresentation.The Councilshall accept,modify,or rejectanyfindingsorconclusions,orremand the decision oftheHearing Examiner for further hearing;provided that any decision of the Councilshall be based on the record of the hearingconductedbytheHearingExaminer;however,the Council may publicly request additionalinformationoftheappellantandtheHearingExamineratitsdiscretion.
C.Upon suchwritten appeal being filedwithinthetimeperiodallotted and uponpaymentof feesasrequired,a review shall be held by theCouncil.Such review shall be held in accordancewithappealproceduresadoptedbytheCouncilbyresolution.
D.Further actionbytheHearingExaminer shallbe withinthirty(30)days ofthe reconsiderationrequest.
Section 2.This ordinance shall takeeffect and be in force five (5)days after its passage and publicationofitssummaryasprovidedbylaw.
