ANORDINANCEAMENDINGCHAPTER i9.030F THEMOSES LAKEMUNICIPALCODEENTITLED"INTERIM CLASSIFICATION AND DESIGNATIONOF RE-SOURCELANDSANDCRITICALAREAS ANDREGULATIONS FOR THEINTERIMCONSERVATIONANDPROTECTIONOFRESOURCELANDSANDCRITICALAREAS"
THE CITY COUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section1.Chapter19.03of theMoses Lake Municipal Code entitled "InterimClassificationand DesignationofResourceLandsandCriticalAreasandRegulationsfortheInterimConservationandProtectionofResourceLandsandCriticalAreas"is amended as follows:
19.03.050 Definitions:
A.Aaricultural Lands -lands thatare notalreadycharacterizedbyurbangrowthand areoflong-termcommercialsignificancefor the commercial production of horticultural,viticultural,floricultural,dairy,apiary,vegetable,or animalproducts,orofberries,grain,hay,straw,turf,seed,livestock,and Christmastreesnotsubjecttoexcise tax.
B.Agulfer Recharge Areas -areas which serve as criticalgroundwater recharge areas andwhicharehighlyvulnerabletocontaminationfromintensivelanduseswithintheseareas.
C.BuildingSetback Line-means thedistance beyond which thefootprint or foundation of thebuildingorstructureshallnotextend.
D.9,ig-means theCity of Moses Lake,Washington,a municipalcorporation.
E.Contaminant-means any chemical,physical,biological,or radiological materialthatis notnaturallyoccurringandisintroducedintotheenvironmentbyhumanaction,accident,ornegligence.
F.Commercial Sianificance.Lonq-Term -meansthegrowing capacity,productivity,and soilcompositionofthelandforlong-term commercialproduction,inconsiderationwith the land'sproximitytopopulationareas,and the possibility of more intense use oftheland.
G.Critical Areas -an area or combinationof areas whichinclude wetlands,aquifer recharge
areas,frequently flooded areas,geologicallyhazardous areas,and fish and wildlifehabitatconservationareas
H.Data Maps -means a series of mapsthatare maintainedby theCommunity Development0Departmentforthepurposeofgraphicallydepictingtheboundariesofresourcelandsandcriticalareas.
I.ErosionHazard Areas -areas whichare vulnerabletoerosiondue to natural characteristicsincludingvegetativecover,soil texture,slope gradient,or which have been induced byhumanactivity.Areas which have been rated as severe or very severe for building sitedevelopmentonslopesbytheUnitedStatesDepartmentofAgricultureSoilConservationServiceSoilSurveyforGrantCounty(Jan.1984)are included withinthisdefinition.
J.Fish and WildlifeHabitat Areas -areas which,in a naturalstate,serve as an important habitatforlocallyimportantspecies,including,but not limited to,riparlan ecosystems,naturallyoccurringpondsundertwenty(20)acres;or areas inwhich rare,threatened,orendangeredspecieshaveaprimaryassociation.
K.Frequently Flooded Areas -areas withintheCityof Moses Lakewhichare determined tobeatriskofhavingonepercent(1%)or greater chance of experiencinga flood inany one (1)year,with those areas defined and identified on the Federal Emergency ManagementAdministration(FEMA)Flood Insurance Rate Mapsfor theCity of Moses Lake.
L.Geologically Hazardous Areas -areas designated withinthe CityofMoses Lake which arenotsuitedforsitingcommercial,residential,or industrial development because of theirsusceptibilitytoerosion,sliding,earthquake,orother geological events.These areas shallincludeerosionhazardareas,landslide hazard areas,and seismic hazard areas.
M.Habitat ManagementPlan -means a reportprepared by a qualified wildlifebiologist for themanagementoffishandwildlifehabitatareas.
N.Hazardous Substance -means anymaterial thatexhibitsany ofthecharacteristicsor criteria0ofhazardouswaste,inclusive of waste oiland petroleum products,and which further meetsthedefinitionsof"hazardouswaste"pursuant to WAC173-303.
O.Hillsides -geologicfeatures with slopes of fifteen percent (15%)or greater.
P.Landslide Hazard Areas -areas which are susceptible toriskofmass movement due to acombinationofgeologic,topographic,and hydrologic factors.
Q.MineralLands -lands thatare not already characterized by urban growthand are of long-termcommercialsignificance fortheextractionof aggregate and mineresources,includingsand,gravel,and valuable metallicsubstances.
R.SeismicHazard Areas -areas which are susceptibleto severe damage from earthquakes asaresultofgroundshaking,slope failure,settlement,or soil liquefaction.
S.Species of Local importance -means a species ofanimalwhich are oflocal concem due totheirpopulationstatusortheirsensitivitytohabitatmanipulation.Thistermalso includes
game species.
T.Slop_e-means an inclined groundsurface,theinclination ofwhich is expressed as a ratio orpercentage.The percentage is determined by thefollowingformula:
V (Vertical Distance)/H (Horizontal Distance)x 100 =Slope %
U.Wildlife Biologist -means a person having a minimum of a Bachelor's degree in wildlifebiology,wildlifescience,wildlifeecology,wildlife management,or zoology.
19.03.060 Data Maps:The data maps maintainedby theCommunity Development Department shall beutilizedasageneralguidetodeterminethelocationandextentofresourcelandsandcritical
areas withinthecitylimits.The data maps shall be consultedwhen a development applicationisreceivedtodetermineifthesiteiswithinanyareasshownasresourcelandsorcriticalareas.It shall be the responsibility of theapplicant to notify the city of any resource lands or critical
areas which are on or near the site of the development application.The exact location of
resourcelands andcriticalareas shall be determined by a siteanalysisconductedby a qualifiedprofessionalusingtherequirementsfoundwithinthischapter
Section 2.This ordinance shall takeeffect and be in force five(5)days after its passage and publicationofitssummaryasprovidedbylaw.
