1952_00001ORDINANCENO.1952 ANORDINANCEAMENDINGCHAPTER 19.06 OF THEMOSESLAKEMUNICIPALCODEENTITLED"lNTERIM CLASSIFICATION AND DESIGNATION OFWETLANDSANDREGULATIONSFORTHEINTERIMCONSERVATIONANDPROTECTIONOFWETLANDS" THE CITYCOUNCIL OF THE CITYOF MOSES LAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter19.06of theMoses Lake MunicipalCode entitled"InterimClassification and DesignationofWetlandsandRegulationsfortheInterimConservationandProtectionofWetlands"is amended asfollows: 19.06.050 Definitions: A.Alteration -anyactivitywhichmateriallyaffectstheexistingconditionoflandimprovements 8.Apolicant -means the person,party,firm,corporation,orotherlegal entitythatproposes anyactivity.The applicantis either theowner of theland on which theproposedactivitywouldbelocated,or thedesignated representative. C.C_|ti-means the City of Moses Lake D.Clearing -means theremovalofbrush,grass,ground cover,orothervegetativematter from a site which exposes thesurface of thesite. E.Compensatory Mitigation -means mitigationfor wetland losses or impacts resultingfromalterationofwetlandsand/ortheirbuffers.Itincludes,butisnotlimitedto,creation,enhance-ment,and restoration F.Creation -means the producingor forming of a wetland through artificial means from anupland(non-wetland)site. G.Designated Wetland -means those lands identified through the classificationprocessestablishedbythischapter. H.Development -means alteration(seedefinition for Alteration) I.Earth/Earth Material-means naturally occurringrock,soil,stone,sediment,organicmaterial, or combination thereof. J.Enhancement -means actions performed to improve the conditionof existing degradedwetlandsand/or buffers so thatthe functionstheyprovide are of a higher quality (e.g.,increasing plant diversity,increasing wildlife habitat,installing environmentallycompatibleerosioncontrols,removingnon-indigenous plantoranimalspecies,removingfillmaterialorgarbage,etc.). K.Erosion -meansthewearingawayoftheearth's surface as a result ofthemovementofwind,water,or ice. L Excavation -means themanual and or mechanical removal of earth materialorfill. M.Existingand OngoinaAgricultural Activities -means thoseactivitiesconducted on landsdefinedinRCW84.34.020(2),and thoseactivities involvedin theproduction of crops andlivestock,includingbut notlimitedtooperationand maintenance offarmand stockponds ordrainageditches,irrigation systems,changes between agriculturalactivities,and normaloperation,maintenance or repair of existingserviceable structures,facilitiesor improvedareas.Activities whichbring an area into agriculturaluse are not part ofan ongoing activity.An operation ceases to be on going when thearea on whichitwas conducted has beenconvertedtoanon-agriculturaluse or has lain idle more thanfive (5)years and so long thatmodificationstothehydrologicalregimearenecessarytoresumeoperations,unless the idlelandisregisteredinafederalorstatesoilsconservationprogram. N.Fill/FillMaterial -means a deposit ofearthmaterial,placed by human ormechanical means,and which is not defined as solid waste according to RCW 70.95. O._FBng-means theact ofplacingfillmaterial on any surface. O P.Gradinq-means anyexcavating,filling,clearing,leveling,or contou ring oftheground surfaceofasite. Q.In-KindMitigation -means toreplace wetlands withsubstitutewetlandswhosecharacteristicsandfunctionsandvaluesareintendedtoreplicatethosedestroyedordegradedbyaregulatedactivity. R.Mitigation-means toavoid,minimize,orcompensate for adverse wetland impacts. S.Out-of-Kind Mitigation -means to replace wetlands whose characteristics do not closelyapproximatethosedestroyedordegradedbyaregulatedactivity. T.Permanent Erosion Control-means continuous on-siteand off-sitecontrolmeasures thatareneededtocontrolconveyanceordepositionofearth,turbidity,or pollutants after develop-ment,construction,or restoration. U.Restoration-means the re-establishment of a viable wetland froma previouslyfilled ordegradedwetlandsite. V.Significant impact -means a meaningful change or recognizable effect to the ecological function and value of a wetland,which is noticeable or measurable,resulting in a loss of wetlandfunction and value. W.Single-Family Residence orDwelling-means a buildingorstructure,orportion thereof,which is designed for and used to provide a place of residence for human habitation. X.Site -means any parcelorcombinationofcontiguousparcels,or right-of-way or combinationofcontiguousrights-of-wayunder theapplicant'sownershipor controlwhere theproposedprojectimpactsawetland(s). Y.S_lop_e-means an inclinedearth surface,theinclinationofwhich is expressed as theratio of horizontal distance tovertical distance. Z.Substrate -means the soil,sediment,decomposing organicmatter,orcombination,located on thebottom surface of thewetland. AA.Utility Line -means pipe,conduit,cable,or other similarfacility by which services areconveyedtothepublicorindividualrecipients.Such services shall include,but are notlimitedto,water supply,electric power,gas,and communications. BB.Wetland(s)-means areas thatare inundated orsaturated by surfacewater or groundwater at a frequency and duration sufficientto support,and thatunder normalcircumstances do support,a prevalence of vegetation typicallyadapted forlife in saturated_soilconditions. Wetlands generallyIncludeswamps,marshes,bogs,and similarareas.Wetlands do notincludethoseartificialwetlandsintentionallycreatedfromnon-wetland sites,including but notlimitedto,irrigation and drainage ditches,grass lined swales,canals,detention facilities,re-tentionfacilities,wastewater treatmentfacilities,farm ponds,and landscape amenities.However,wetlands include thosewetlands intentionally created to mitigate conversion of wetlands. This is an interim definition and is subject to change if necessary.The Planning Commission shall deem whenchanges Inthe definition are warranted. CC.Wetland Buffer Zone -means a designated area contiguousoradjacenttoa wetlandthatis required for thecontinued maintenance,function,and structuralstabilityofthe wetland. DD.Wetland Class -means the U.S.Fish and WildlifeService wetlandclassificationschemeusingahierarchyofsystems,subsystems,classes,and subclasses to describe wetland types. EE.Wetland Specialist -is a person witha minirnumofa four (4)year degree inwildlifesciences, biology,environmentalscience,or an equivalent academic background who also has experience in performingwetland delineations,analysis of wetland functions and values and projectimpacts,and wetland mitigation and restorationtechniques.The person must be familiar with theFederalManualforIdentifying and Delineating Jurisdictional Wetlands,andtheCityofMosesLakeWetlandsOrdinance. 19.06.060 Data Maps:The CommunityDevelopment Department shall utilizethe National Wetlands Inventory (NWI)mapsand any otherrelatedinformationand mapsas a general guideto determine thelocation and extentof wetlandswithinthecitylimits.The data maps shall be consulted when a development applicationis received to determine if the site is withinany areas shown aswetlands.Itshallbe theresponsibility of the applicant to notifythecityofanywetlandswhichareonornearthesiteofthedevelopmentapplication.The location ofwetlandsshall be determined by a wetland analysis report conducted by a wetlandsspecialist using the requirements found within thischapter. 19.06.070 Interoretation ofDataMaos:The Community Development Director is chargedwiththeadministra- tionof theCity ofMoses Lake's Zoning Ordinanceforthepurposeofinterpreting data maps.An affected property owner or other party with standing has a right to appeal the Community Development Director's determination tothePlanning Commissionwhich is further appealabletotheCityCouncil. AIIdevelopment applications are requiredto showtheboundary(s)of all wetlands on a scaleddrawingpriortothedevelopmentapplicationbeingconsideredcompleteforprocessingpurposes. 19.06.090 Site Analvsis:When an application for a development permit orlicense isreceivedbythe city,the application shall indicate whether the proposal is withintwohundred feet (200')of an affected wetland(s)area.Ifitis indicated on the applicationthat an adjacent wetlandoraffectedwetland is present,a wetland analysis reportshall be filed,unless the Division determines that a wetland is notadjacenttoorwithinan affectedwetlandon thesite.Ifthedata mapsand/or the application do not indicate the presence of a wetland,but there are other indications thata wetland may be present,theCommunityDevelopment Director or designee shallmake a determination whether a wetland analysis reportshall be required. 19.06.100 Wetland Analysis Reoort:Awetland analysis reportshall be submittedtotheCommunityDevel- opmentDepartmentfor reviewof a proposalforactivitywhich lies adjacenttoor within an affected wetland.The purpose of thewetland analysis reportis to determine the extentand function of wetlands to be impacted by theproposal. 19.06,110 Acceals:Any decision of the Community Development Director in the administration of thischaptermaybeappealedtothePlanningCommission.Such appeal shall be in writing and mustbesubmittedtothecitywithinten(10)days from the date of the Director'sdecision,which isfurtherappealabletotheCityCouncil. 19.06.140 Exemot Activities:The followingactivities shall be exemptfrom the provisions of this chapter: A.Existingand on-going agricultural activities,as definedin thischapter, B.Maintenance,operation,normal repair of existing roads,streets,utilitylines,and associated structures,providedthatreconstructionofanysuch facilitydoes notextendoutsidethescopeofanydesignatedeasementorright-of-way. C.Normalmaintenance and reconstruction of structures,provided thatreconstruction may not increase theexistinggroundcoverage. D.Site study worksuch as surveys,soil logs,and other related activitiesnecessary forthesubmittalofaland-use application. E.Activities determinedbytheCommunityDevelopment Director as having minimal adverseimpactonwetlands,such as aport fishing or hunting,scientificor educationalprograms. 19.06.150 WetlandsAnalysisReport Requirements: A.Awetland analysisreportshallbe prepared bya qualifiedwetland specialistin accordancewiththeUniformFederalManualforIdentifyingandDelineatingJurisdictionalWetlandsandsubmittedtotheDivisionforreviewforanyproposalsadjacenttoorwithinanaffected wetlandarea. B.Within forty-five(45)days ofthesubmittalofthewetlandsanalysis report,theDivision shalldeterminetheappropriatewetlandcategory,bufferingrequirement,and potential mitigationbasedupontherecommendationofthewetlandsreportanalysis.The wetland analysisreportshallbefonwardedforreviewandcommenttoagencieswithexpertiseorjurisdiction on theproposal,including,but not limitedto: 1.Washington State Department of Wildlife 2.Washington State Departmentof Fisheries 3.Washington State Departmentof Natural Resources 4.U.S.Fish and WildlifeService Comments received from review agencies withinforty-five (45)days of the wetland analysisreportshallbeconsideredbytheCommunityDevelopmentDepartment. 19.06.160 BufferAreas:FollowingtheDepartment's determination ofthecategory ofwetland associated withtheproposal,theappropriate buffer widthsshall be determined.Wetland buffer zones shall beevaluatedforalldevelopmentproposalsadjacenttoawetland(s)inordertoprotecttheecological functionand valueofthewetland.Exceptas otherwisepermitted by thischapter,thebufferareasshallconsistofanundisturbedareaofexistingnativevegetationandnon-native vegetation.Thefollowingminimumbufferwidthsshallberequiredforthefollowingwetlandcategories: Wetland Category BufferWidth Category I 100'Category11 100'Category11 25'Category IV 10'Category V 5' Section 2.This ordinanceshalltakeeffectand be in forcefive (5)days afterits passage and publicationofitssummaryasprovidedbylaw.
