ANORDINANCE VACATINGA PORTION OF BLANCHETAVENUE ANDPAXSONDRIVE
THECITY COUNCIL OF THE CITY OF MOSESLAKE,WASHINGTON DOORDAINAS FOLLOWS:
Section 1.Portions ofBlanchetAvenueand Paxson Drive described as follows,shall be vacated:
A portion of Paxson Drive legally described as:
Allthat portion of Paxson Drive dedicated on the Knolls Vista 18th Addition Plat,per GrantCountyAuditorplatrecordsVolume9,Page 7,located in the SW 1/4,SW 1/4,Section 15,Township 19 North,Range 28 East W.M..
And
That portion of Kiefer Avenue,presently named Paxson Drive,dedicated on thePlat of ParkOrchardsTractsPlat,perGrant CountyAcreage recordspage 36,locatedinthe SW1/4,SW1/4,Section 15,Township 19 North,Range 28 East,W.M.described as follows:
East ofa line that is parallel and 30.00 feet east of thewest boundary line of said SW 1/4.
and
Aportionof Blanchet Avenue dedicated on thePark Orchard Tracts legally described as:
That portion ofSixth Avenue,presently named BlanchetAvenue,dedicatedon thePlatof ParkOrchardsTracts,per GrantCountyAcreage records Page 36,located in theSW 1/4,SW 1/4,Section 15,Township19 North,Range 28 East,W.M.,described as follows:
Beginning at thesouthwesterly right-of-wayline of White Drive and extending southwesterlytothenortheasterlyright-of-way lineof Paxson Drive.Containing 1.03 acres,more or less.
Subject to a municipal easement for city utilitiesdescribed as follows:
Beginning at the most easterly corner of lot 1,H.LH.Plat,per GrantCounty Auditorrecordsvolume11,pages 56 &57;thence South 62°12'45"West,185.00 feet along the southeastboundaryofsaidlot1;thence atright angles tosaid boundary South 27°4T15"East,60.00feet;thenceNorth 62°12'45"East,30.00feet;thenceNorth 27°4T15"West,30.00 feet;thenceNorth62°12'45"East,154.98 feet tothesouthwesterlyright ofway line WhiteDrive;thenceNorth27°44'37"West,30.00feet to thepointof beginning.
Also,subject to a 30 foot widepublicutilityeasement located along thesoutheasterly one halfofthatpartofBlanchetAvenuebeingvacated.
Section 2.The city shall be compensated for one halftheappraised valueofBlanchetAvenue.There shallbenocompensationrequiredforPaxsonDrive,since theproperty owners are or willbe required toextendPaxsonDrivethroughthepropertyatanotherlocationandpayforthefullcostofimprovements.The vacationshallnotbecomeeffectiveuntiltherequiredcompensationisreceivedbythecity.
Section 3.This ordinance shall take effectand be in force five (5)days after its passage and publication ofitssummaryasprovidedbylaw.
