1955_00001ORDINANCE NO.1955 AN ORDINANCE AMENDING CHAPTER 3.18 OF THE MOSES LAKEMUNICIPALCODEENTITLED"GAMBLINGTAX" THE CITY COUNCIL OF THE CITYOF MOSESLAKE,WASHINGTON DO ORDAINAS FOLLOWS: Section 1.Chapter 3.18 ofthe Moses Lake Municipal Code entitled"GamblingTax"isamended as follows: 3.18.060 Taxes Imposed -Amounts:There is levied a taxupon allpersons,associations,and organiza- O tionswho conductoroperate gambling activities within thecity and who have been duly licensedbytheWashingtonStateGamblingCommissiontoconductoroperatesuchgamblingactivities,which taxshallbe paidon thefollowing gamblingactivitiesinthefollowing respectiveamounts: A.Bingo and Raffle Games:Any bingo or raffleactivity,a tax computed at the rate of fivepercent(5%)ofthegross receipts from a bingogame orraffle,less theamountawarded ascashormerchandiseprizesprovided,however,thatno tax shall be imposed under theauthorityofthischapteronbingoorraffleswhensuchactivityoranycombinationthereofisconductedbyanybonafidecharitableornon-profitorganizationas defined in RCW9.26.020(3),which organizationhas no paid operating or management personnel and has grossincomefrombingoorraffles,or anycombinationthereof,notexceedingfivethousand dollars($5,000)per year less the amount paid for as prizes;and provided further,thatactivitiescarriedoutbypublicorprivateschoolsorbyorganizationssponsoredbyorrelatedtopublicorprivateschools,including parentorganizationsand student body organizations,shall beexemptfromtheprovisionsofthischapterwhentheproceedsofsuchactivitiesareappliedforthebenefitofanysuchschoolorschool-sponsored or school-relatedorganization;andprovidedfurther,thatanydeviation fromexemptionrestrictions enumerated inthissubsectionshallsubjectsuchorganizationtotherequirementsofthischaptertothesameextentasifsuchexemptionhadnotbeengranted,including required payment within ten(10)days afterwrittendemandoftheFinanceDirectorofanytaxesformerlygrantedexemptionunderthissubsection. B.Punchboard or Pull-Tab:Anypunchboard or pull-tab,as ofJanuary 1,1994,a taxcomputedattherateofthreepercent(3.0%)ofthegross receipts received from theconduct of suchactivity.The taxshall be assessed at the rate oftwoand a half percent (2½%)of thegrossreceiptsbeginningthesecondquarterof1995providedthecity's sales taxrevenues exceedstheWestCoastCPIC-Wfor the year of 1994 by at least two percent (2%)over thoserevenuesfor1993.
