1966_00001ORDINANCE NO.1966 ANORDINANCEAMENDINGCHAPTER 13.07 OF THE MOSESLAKEMUNICIPALCODEENTITLED"CROSSCONNECTIONCONTROL" THECITYCOUNCILOF THECITYOF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 13.07 of the Moses Lake Municipal Code entitled "Cross Connection Control"isamendedasfollows: 13.07.010 Purpose:The purpose ofthisordinance in conjunction with thecurrent editionofthe UniformPlumbingCodeasadoptedbytheStateofWashington,and_the State ofWashington Administra-tiveCode 246-290 is toprotectthehealth of thewater consumer and the potabilityofthewaterinthecitydistributionsystem.Inspection and regulationofallcrossconnectionsbetween potableandnon-potablesystems is required inorder tominimize thedangerof contaminationor pollutionofthepublicpotablewatersupply.Controlling and preventingcrossconnectionsisaccomplishedbyeitherremovingthecrossconnectionorinstallinganapprovedbackflowpreventertoprotectthepublicpotablewatersupply. 13.07020 Responsibility: A.In accordance with WAC 246-290 of and the Uniform Plumbing Code as adopted by theStateofWashingtontheCityofMosesLakeisrequiredtoeliminateorcontrolallcrossconnectionsthroughoutitsservicearea.Therefore,anyone using water from the City ofMosesLakeisrequiredtocomplywiththeseregulations,The ownerofthepropertyinwhichacrossconnectionoccursisfullyresponsibleforalldamagesincurred. B.The Administrative Authority willenforcetheprovisionsofthischapter.When provisions ofthischapterareincludedinmorethanonecodeorregulation,themoststringentwillapply. C.When,inaccordance withWAC246-290 ortheUniformPlumbingCodeas adopted bytheStateofWashington,an approvedbackflowpreventeris required for thesafety of thecitywatersystem,the Administrative Authority shall give notice in writingto said customer toinstallsuchanapprovedbackflowpreventeratspecificlocation(s)on the customer'spremises. 13.07.030 Compliance:AIIcosts associated withpurchase,installation,inspections,testing(byWashingtonStatecertifiedtester),replacement,maintenance,parts,and repairs of thebackflow preventerarethefinancialresponsibilityofthepropertyowner. 13.07.040 Notice toCease Violation:Any person,firm,orcorporationfound to be violating any provisionofthischaptershallbeservedbytheAdministrativeAuthoritywithwrittennoticestatingthenatureoftheviolationandprovidingareasonabletimelimitforthesatisfactorycorrectionthereof.The offender shall,withinthe period of timestated in such notice,permanentlycease allviolations. 13.07.050 Penalty for ContinuedViolation:Anyperson,firm,or corporationwho continues any violationbeyondthetimelimitprovidedforinSection13.07.050 is deemed to have committeda civilinfraction,and upon convictionthereof,shall be subject to a C-2 penaltyand punishable asdefinedinChapter1.08 ofthe Moses Lake MunicipalCode.Failure or refusal to complyshallalsoconstitutegroundsfordiscontinuingwaterservicetothepremisesuntilsuchrequirementshavebeensatisfactorilymet. Section2.This ordinance shall takeeffectand be in force five(5)days after its passage and publicationofitssummaryasprovidedbylaw.
