AN ORDINANCE AMENDINGCHAPTER 5.04 OF THE MOSESLAKEMUNICIPALCODEENTITLED"LICENSINGREGULATIONS"
THE CITYCOUNCILOF THECITYOF MOSES LAKE,WASHINGTON DO ORDAIN AS FOLLOWS:
Section 1.Chapter 5.04 of theMoses Lake Municipal Code entitled "Licensing Regulations"is amendedasfollows:
5.04.030 License -Contents:AIIlicenses provided for in this chapter shall be issued by the FinanceODirectoruponpayingtotheFinanceDirectortheproperlicensefeeasprovidedinthischapter.Alllicenses shallbear thename ofthe licensee,and shall designate thenature ofthe business,trade,or profession operated by thelicensee;and shall also designate thelocation where thebusiness,trade,or profession is carriedon,the date ofexpirationof the license,the date oftheissuanceofthelicense,and theamountpaid for thelicense.Each licensee shall conspicuouslypostsuchlicenseinhisplaceofbusinessoroffice,andshallproduce such license for inspectionifrequiredtodosobyanyauthorizedcityofficial.
5.04.040 Application For New Business:Ifthe licensee is a new business,priortotheissuance of thebusinesslicense,theFinance Director shallsubmittheapplicationtherefortotheFire ChiefandtheBuildingInspectorofthecityforapprovalofthelocationwherethelicenseeistocarryonthebusiness,tradeor profession,and thebusiness license shall be issued onlyifthelocation is incompliancewithbuildingandfirecodesofthecityasthosecodesrelatetoexistingand/or newstructures.
5.04.050 Location Change;Ifan existing licensee desires tochange the location ofthebusiness,trade,or profession from thelocation designated on thebusiness license,application must be madetotheFinanceDirectorpriortothechangeinlocationandtheFinanceDirectorshall,prior totheissuanceofanewbusinesslicense,submitthe application thereforto the Fire Chief and theBuildingInspectorofthecityforapprovalofthenewlocationwherethelicenseeistocarryonthebusiness,trade,or profession,and thebusiness licenseshallbe issued onlyifthelocationisincompliancewithbuildingandfirecodesofthecityasthosecodesrelatetoexistingand/ornewstructures.There shallbe noadditionalbusiness licensefee assessed anexistingbusinesschangingitslocation,and the newbusiness license issued shall carrythesame expiration date.
5.04.060 Term of License:Alllicenses shallbe for a period ofone (1)year,unless otherwise provided inthischapter;such license is to begin January first of each year and terminate the followingDecemberthirty-first,and itmustbe renewedannuallyin advance.AIIlicenses shall expire onthethirty-firstday of December ofeach year and no reduction infee for such licenses shall beOmadeforanypartialyear.No license shall be transferable.AIIlicenses willbe renewed throughtheFinanceDirectorwithpaymentoftheyearlyfee,
5.04.070 Temporary Licenses:
A.Licenses issued forthefollowingbusinesses bytheFinance Director shallbe temporaryandapermanentlicenseshallnotbeissuedbytheFinanceDirectoruntilthebusinesshasbeenapprovedbytheGrantCountyHealthDepartment,whichapprovalmust be obtained withinthirty(30)days after theissuance ofsaid temporarylicenses:
1.Bakeries;
2.Cafes and restaurants;3.Confectioneries;
4.Grocery stores;5.Meat markets;6.Produce stores (wholesaleand retail)7.Soda fountains;8.Taverns;
9.Autocourts;10.Cabincourts;11.Hotels;12.Trailer courts.
B.Ifat any timeany ofthe businesses licensed inthissection do not meetwith theapproval oftheGrantCountyHealthDepartment,thelicense shallbe revoked andshall notbe reissueduntilsuchbusinessagainmeetswiththeapprovaloftheGrantCountyHealthDepartment.
O 5.04.080 Fee Schedule:The business license fee schedule is fixed in theamountof eighty dollars ($80)per year,payableinadvance,for each business,trade or profession,conducted or carried onwithinthecorporatelimitsofthecity;provided,thattaxexempt nonprofitcompanies,associa-tions,corporations,or copartnerships of whatever kind as defined by the federal or stategovemment,shallnot be required topay thebusiness license fee,but,nevertheless,shallobtainabusinesslicense,withoutfee,ifconductinga business in order toraise fundsfrom membersoutsidetheorganization.For the initial business license fee the eightydollars ($80)shall beproratedoverfour(4)quarters,eighty dollars($80)payable between January 1and March 31,sixtydollars ($60)payable between April1and June 30,forty dollars($40)payablebetween July1andSeptember31,and twentydollars ($20)payable between October 1 and December 31.The business license for tax exempt nonprofitcompanies,associations,corporations,orcopartnershipsofwhateverkindasreferredtohereinshallbeobtainedonceandshallbeeffectiveforthelifetimeoftheorganization.This exemption is an addition to that provided in
Section 5.04.090.No business,profession or tradeconducted or carried onina singlelocation
under one management or ownership shall pay more thanone license fee regardless of themultiplenatureofthebusinesscarriedon;Provided further that no tax exempt nonprofit
company,association,corporation,or copartnership ofwhatever kindas definedbythe federal
orstate governmentswhich operates orconducts a communityfestival or event of no more thanfourdaysindurationshallberequiredtoobtainabusinesslicenseashereinpreviouslyprovidedandtheexemptionwhichhasbeenprovidedshallextendtothefestival's or event's participantsoperatingundersanctionofsaidfestivaloreventAnybusiness,profession or trade inmore thanonelocationwithinthecityshallpayalicensefeeforeachlocationwherethebusiness,profession,or tradeis conducted.
5.04.090 Certain Businesses Exemot:Recognizing thatthereare locally ownedand operated smallorpart-time businesses whichwouldbe undulypenalized by requiringlicensing underthischapterandthepaymentofthebusinesslicensefeeasprovidedinSection5.04.080,thereis exempted
from thisbusiness licensingchapterthoselocallyownedandoperated businesses,professions,
ortradeswherein theannual gross incomeis less thantwothousanddollars ($2,000)per year,
Section 2.The City Council declares that an emergency exists and this ordinance shall take effect
immediately as providedby law upon one readingif2/3 of theentire City Council present vote in favor of
passage.
