1976_00001ORDINANCE NO.1976 AN ORDINANCEAMENDINGCHAPTER 5.16 OF THE MOSES LAKEMUNICIPALCODEENTITLED"CIRCUSES ANDCARNIVALS" THE CITYCOUNCILOF THE CITYOF MOSESLAKE,WASHINGTON DOORDAINAS FOLLOWS: Section 1,Chapter 5.16 of the Moses Lake Municipal Codeentitled"Circuses and Carnivals"is amended as follows: 5.16.030 Fee Schedule:The proprietor or manager of every show,carnival,or place of amusement,nototherwiseprovidedfor,shallpay a license fee as follows: A.Carnival:First day,one hundred fiftydollars($150);Second day,seventy dollars ($70);Third,and any days thereafter,forty-fivedollars($45)per day B.Circus:First day,one hundred fiftydollars ($150);Second,and any days thereafter,seventy dollars ($70); C.Road Show:First day,sixty dollars($60);Second,and any days thereafter,thirtydollars ($30) 5.16.040 Application for License:Before any person operates any amusement licensed under theprovisionsofthischapter,he shallapply inwritingto the Finance Director for a license thereforeandpaythelicensefeeprovidedinSection5.16.030.The application shallspecifythe following: A.The name of theperson,firm,or corporationwhich willuse the structure; B.The location or theprincipalplace of business ofsuch person,firm,or corporation; C.The names and addresses of theofficers ofsuch firmor corporation; D.The length of timethe license is intended tobe used for thepurpose appliedfor; E.Natureofactivitytobe conducted; F.Such other relative information as the Finance Director may require. 5.16.050 Deposit of Bond: A.Anapplicantfor a carnivalorcircus shall furnish evidencethata public liabilityinsurance policyintheamountspecifiedbytheFinanceDirectorisineffectbeforethepremisesareoccupiedasaplaceofpublicassemblage. B.The applicant shall deposit withtheCity Treasurer a cash bond in thesum offive hundreddollars($500)conditioned upon savingharmless thecityfrom any and all liabilities or causesofactionwhichmightarisebyvirtueofthegrantingofalicensetotheapplicant,and condi-tionedfurther thatno damage willbe done to the street,sewers,trees,oradjoiningproperty,andthatno dirt,paper,litter,orotherdebris willbe permittedtoremain upon thestreet,or uponprivateproperty,by such applicant.Such cash bond shall be returned totheapplicant uponcertificationbythePoliceChiefthatallconditionsofthischapterhavebeenfullycompliedwith. C.Theapplicantshall pay totheFinance Director all license fees which may be required by theordinancesofthecity,including theadmissiontax. D.IftheFire Chief determinesthattheattendance offire equipmentat thelocation ofthestructureduringtheuseofsuchstructureasaplaceofassemblageisnecessaryforthesafetyofpersonsandproperty,theFinanceDirector shallrequire thattheapplicant deposit withtheCityTreasurerasumequaltothereasonablevalueoftheuseoftheequipmentandthefurnishingofthenecessarypersonnelforsuchtimeaswillberequired,in orderto reimbursethecity forsuchexpense. 5.16.060 Inspection by Fire ChiefBefore Erection of Structure:The applicationshall be submittedto theFireChiefpriortothedateoftheopeningofanystructure,and he shall be notifiedat least forty-eight (48)hours prior to theerection ofsuch structure,so that he,or his authorized deputy,maymakeaninspectionduringreasonabledaylighthours. The Fire Chiefshall determine iftheapplicanthas made provisionfor thefollowing: A.Adequate aisles,seats,platforms and poles; B.Sufficient exits,well markedand properly lighted; C.Lightedand unobstructed passageways to areas leading away frorn thestructure; D.Removal,beforethestructure is to be used as a place ofpublic assembly,or any pole,rope,or other obstruction inany aisle or exit; E.Sufficient first-aid fire appliances to be distributed throughoutthe structure with operating personnel familiar withtheoperationofsuch equipment available andassigned duringthe use ofsuch structure as a placeof assembly; F.An employee at each entrance torequire theextinguishing ofallcigarettes,cigars,and other smoking materials; G.Proper safeguarding of any use of open flames or its use prohibited; I-l.The clearingofstraw,dry grass,sawdust and anycombustibletrash from the structure before it is opened to the publicand arrangements made tokeep theareas where debris may be expected toaccumulatewell serviced,especiallyunder open seats, l.Proper facilities for calling thecity FireDepartment; J.Such special fire equipment ofthecity toattendat such structureduring its use as a placeof public assemblage as theFire Chiefmay decide is necessary forproper fire protection; K.The tent and canvas parts of thestructure ad allcombustibledecorative materials,including curtains,acoustic materials,streamers,cloth,cottonbatting,straw,vines,leaves,trees,and moss to be rendered fireproof. 5.16.070 Inspection After Erection of Structure: A.Upon completion of such structure,itshall notbe used as a place ofassembly until the Fire Chief has inspected theentirepremises upon which the structure is located. B.Ifthe Fire Chief finds that all of the limitations and requirements of the chapter have been complied with,theFinance Directorshallgranta permit tooccupy such premises. C.It is unlawful for any person tocause or permit theoccupancy of such structure as a placeof assembly,withouttheissuance of such license to occupysuch structureas provided inthischapter. D.Ifthe Fire Chief finds that such structure,or the premises on which it is located,is being maintainedin violationof any ofthe provisionsof the license toerect ormaintain any of theprovisionsofthischapter,or in such a manner as to constitute a fire hazard,he mayrevoke thelicense tooccupy provided for inthischapter. E.Any person,firm,or corporation whose license tooccupy has been revoked may appeal totheCityCouncilforahearingthereon,and thedecision oftheCouncilinthisregard shallbe final. Ifno appeal is takenwithinten(10)days,theaction oftheFire Chiefshall be final.(Ord.1887, Section 2.The City Council declares that an emergency exists and this ordinance shall take effect immediately as provided by law upon one reading if2/3 of theentireCity Council present vote in favor of passage.
